Administrator's City Council Meeting Agenda Memo March 28, 2013 1. Call to Order / Roll Call 2. Pledge of Allegiance 3. Agenda Approval 4. Open Forum 5. Presentations 6. Consent Agenda a. Draft Minutes of March 14, 2013 Council Meeting. As with the Financial Report, we are unable to finish the Minutes to include in this packet delivery due to staffing and the needed preparations for the auditors who will be in next week. We will get them done on Monday or Tuesday and will send out to you immediately. Thanks for understanding. b. RMG Donation. See report c. Truck Safety Seminar. See report d. Squad Purchase. See report e. Approve Resolution 2013 -09 Hamel Rodeo Temp Liquor License. This annual request by the Lions for beer sales permit during the Hamel Rodeo on July 11 thru July 14, 2013. All requirements will be met. f. Liability Coverage Waiver. Every year, cities in the state are required (by state law) to proactively state whether they will waive liability insurance limits or not. Every year since the laws inception, the Corcoran City Council routinely passes a motion to not waive those liability limits ($500,000). I don't know of a city in the state that does otherwise and waives the limits. g. Extension of Loretto Fire Contract to April 15, 2013. Last December, the council approved a temporary contract with Loretto Fire from January 1, 2013 to March 30, 2013. The existing contract expired on December 31, 2012. This temporary contract was approved in order to give the cities and Loretto Fire time to work out a new contract with terms and costs to cities. We are almost there and the new contract will be ready to consider at the council meeting of April 11th. The action before the council is to extend the temporary contract to April 15th. It is anticipated that the new contract will have no changes in terms or costs for Corcoran. That being said, the city will have to quickly turn around an negotiate a new revised contract with Loretto Fire that becomes effective May 20, 2013 as our contract with Hamel Fire expires on May 19th. Chief Gormley and I do not expect our overall fire services costs (all fire departments) to increase beyond the approved 2013 Budgeted amounts. h. Approve Police Officer Job Description Revision. See report 7. Claims as Presented * a. Escrow Claims (Fund #500). b. All Other Claims As Presented. The claims register now includes any claims from the Building Official. The claims on this agenda are routine and nothing unusual by way of expenses. 8. Staff Reports / Memos /Commissions a. Planning Projects Update. See report b. Code Compliance Update. See report c. Financial Performance Report. As mentioned earlier, staffing challenges have delayed this report. It will be to you early next week. d. Weather Station. See report Administrator's City Council Meeting Agenda Memo March 28, 2013 9. Planning Business a. Patnode AG Preserve. See Planner's Report 10. Unfinished Business a. Approval of City Administrator Position Profile. The Consultant Richard Fursman is finishing up the Administrator Profile and will have it finished up over the weekend. He will be sending to me and I will send it to you by Sunday or Monday at the latest. b. PW Facility- Consideration of Construction Bids. The bids were opened this past week. The base bids overall came in right on the numbers with a cost of $3,770,791. An additional $360,782 is bid for the alternates. If the city were to approve all of the alternates, additional funding of around $300,000 would need to be sought. See report on the low bids and low quotes. The Building Committee will be meeting next week with the mayor (he will not be at the council meeting) and review the bids. Council member Cossette will also attend. We can convey the mayor's thoughts and that of the committee to the council. An immediate issue is what to recommend to the council on proceeding. It is noted that the construction process could be delayed if we do not get our order in for steel and concrete panels ASAP. This will be discussed at the Building Committee meeting and we will advise you on this at the council meeting. c. TIF Projects Report. I have included the Phase I report from our TIF Consultant Kirstin Barsness. Her initial assessment is that we are must amend the TIF Expenditure budget in the TIF Plan. This apparently will only take a council resolution. I will need to have a further discussion with her to better understand her comments about the 10% maximum expenditure for planning. The mayor was going to call her and discuss this report and steps to move ahead with a possible Phase 11 for next steps. At this council meeting, I would recommend that no action be taken other than preliminary discussion. This will be back on the agenda for the April 11th council meeting when all of the council members will be back and at the meeting. d. Authorize the Publication of Maple Hills Activity Center Request for Proposal (RFP); Review the Proposed Agreement with Owner of Maple Hills Estate. In your packet is the Request for Proposals (RFP). I am asking that you approve and authorize its publication. I am meeting with the county on Monday, March 25 to have them review. I am sure there will be some minor changes in the final draft. Also, prior to final approvals for the actual award for construction, the council needs to approve the agreement with Barry Hay, the Maple Hill Estates owner. In your packet is a draft agreement. Please review. 1 am not asking for your approval at this meeting. 1 have question on Sections IV and VI. The city attorney is back from vacation the first week of April so he and I can meet and review. I also need to have the county review. But at this time, I need your input particularly as to the language that of what happens after 15 years which is the minimum time that the city must control the site and the facility. 1 also have question on whom and how the facility programming is handled. 11. New Business a. Renewing Building Official Service Agreement. The current agreement with Metro West for building inspection services will expire on June 30, 2013. The agreement requires the city to notify Metro West by April 1, 2013 if we do not wish to renew the contract. We don't have to tell them we are going to renew the agreement at this meeting but we do have to tell them if we are not. Metro West has informed me that they will not be altering their cost to the city or requesting changes in the agreement. Your call if you want to take action at this meeting to 2I Administrator's City Council Meeting Agenda Memo March 28, 2013 renew the agreement effective July 1, 2013. We can wait if you would prefer until next month. The new agreement would only require that we give a 90 day notice to vacate. Staff is very satisfied with Metro West performance and highly recommends that we retain their services. b. Personnel- Authorization to Hire Temporary /Seasonal Office Support Staff. See report. c. Personnel- Authorization to Hire Public Works Maintenance Worker. See report. d. City Hall Security /Camera System Upgrade. See police report. Additional comments. With the Police Department needing to replace their security camera recorder, this is a good time to revisit the 2007 council discussion of providing updated security for all of the city hall complex. In 2007, the council agreed that this increased security should take place when funding was available. At the time it was not. Staff, especially the city hall clerical staff, agrees that this should be completed ASAP. City hall is essentially wide open with absolutely no security during normal work hours and meeting hours. Entire upgrade including the replacement of the police recorder ($7,500) is not to exceed $17,000 and will be purchased off the State Bid List. Funding will come from the existing Equipment CIP. In 2013, the fund has been authorized to purchase two replacement police squad cars. Since one of the vehicles to be replaced is judged to still have a useful life and is not expected to exceed the mileage threshold, staff is recommending that only one squad be purchased and that $15,000 in CIP funds be redirected for the security system. I recommend approval. 12. Approximately 170 participants spent a half -day with public safety representatives from the Corcoran Police Department, and Minnesota State Patrol. After the seminar, the attendees where treated to a complimentary lunch. In reviewing the attendee's comments and evaluations, there is very strong desire to continue this safety training for our 7th Annual Truck Safety Seminar, February 2014. Council Meeting: March 28, 2013 Prepared By: Chief Sean Gormley Topic: Squad Car Replacement (CIP) Action Required: Approve Squad Car Purchase Background- Each year a squad car is replaced and selective years, two squads are in need of replacement based on miles and usage. Public Safety squad feet consists of 6 squads; Chief squad, x4 primary service squads (these are located in the police garage) and x1 for reserve officers & back -up squad. After in -depth review, the squad selected for 2013 was the Ford SUV Explorer (police package). The officer feedback on this squad has been extremely positive and no maintenance issues. Discussion- I am recommending for 2013, the Ford SUV Explorer as the replacement model. This is based on officer feedback, neighboring agencies feedback and review search on the internet. Staff Report / Police Department — Page 2 Financial Impact- The 2013 CIP had scheduled for two police vehicles @ $70,000. Based on estimate miles projection, only one squad replacement is needed for 2013. Lessons learned from last year squad conversion from Crown Vic to Explorer, not as much emergency lighting and other fixed equipment transformed from old squad sedan to new SUV. Squad 553 will be sold by auction and proceeds will be returned to the CIP fund. In order to secure the State of Minnesota purchase price, the order must be placed April 10, 2013. The decision to waive or not to waive the statutory limits has the following effects: If the city does not waive the statutory tort limits, an individual claimant would be able to recover no more than $500,000. on any claim to which the statutory tort limits apply. The total which all claimants would be able to recover for a single occurrence to which the statutory tort limits apply would be limited to $1,500,000. These statutory tort limits would apply regardless of whether or not the city purchases the optional excess liability coverage. If the city waives the statutory tort limits and does not purchase excess liability coverage, a single claimant could potentially recover up to $1,500,000. on a single occurrence. The total which all claimants would be able to recover for a single occurrence to which the statutory tort limits apply would also be limited to $1,500,000., regardless of the number of claimants. Schmid's Hidden Valley 2 "d Addition Topography /Wetland Waiver, Preliminary Plat and Final Plat at 21820 Oakdale Drive (PID 04- 119 -23 -34 -0007, 04- 119 -23 -42 -0002 and 04- 119 -23 -42 -0003) (City File No. 12 -016). The application for topography and wetland delineation waiver was approved at the September 27th Council meetings. This item has been tentatively scheduled for Planning Commission public hearing on April 4t , Parks Commission review on April 23rd and Council action on April 25th 3. Site Plan and Variance for Maple Hill Estates Community Center) (City File 12 -022). The landowner and the City received a CDBG grant to construct a new community center on land north of the manufactured home park that is also owned by the park owner. This new building is in the process of being designed. The building is likely to straddle a lot line or at minimum require a setback variance. The survey has been completed and the site plan is currently being prepared. This item has been schedule for Planning Commission review on April 4th and City Council action on April 25th 4. Feasibility Study for Lennar (City File 12 -025). The applicant requested that the City conduct an infrastructure feasibility study regarding property west of CR 101 and north of Hackamore. This is part of the property that was previously proposed as the "Hedgestone" development. The applicant has provided an escrow and the City Engineer has begun work on feasibility study. The study is expected to be completed at the end of February /early March. Next steps would be completion of an EAW and PUD sketch plan, then a preliminary plat and PUD preliminary development plan and finally a final plat, PUD final development plan and rezoning to PUD. 5. Administrative Permit for Special Home Occupation for Jacob Shoulak at 20475 CR 10 (23 -119- 23 -23 -0007) (City File 12 -026). This application is to allow an in -home recording studio. The application is currently incomplete but when a complete application is received, it will be processed administratively. 6. Agriculture Preserve Initiation and Expiration for Beverly J. Patnode Trust at 22650 County Road 50 (19- 119 -23 -41 -0002) (City File 13 -001). The landowner was briefly out of the Agricultural Preserve program while a parcel was subdivided for Brian and Christina Patnode as MTP West Acres. The landowner is now reenrolling the farmstead in the Agricultural Preserve Program and initiating expiration (in 8 years). This is scheduled for the March 28th Council meeting. Heinz Second Addition Preliminary and Final Plat at 20801 CR 117 (03- 119 -23 -14 -0002) (City file 13 -003). A wetland and topographic waiver was approved on January 24th. This item has been tentatively scheduled for Planning Commission public hearing on April 4th, Parks Commission review on April 23rd and Council action on April 25th 8. Sprint Cell Tower Administrative Permit /Site Plan Modification at 23400 CR 10 (07- 119- 23 -43- 0006) (13 -004). This is an administrative approval to swap antennas on an existing tower. 9. Kohnen /Kothrade Minor CUP Amendment at 23240 CR 30 (07- 119 -23 -13 -0003) (City File 13 -005). This application has been received to resolve a code violation. Staff is reviewing the application as a minor CUP amendment as discussed at the October 11, 2012 City Council meeting and has tentatively scheduled this item for City Council action on April 25tH 10. Lano Equipment at 23580 Highway 55 Site Plan Amendment for Cold Storage. (31- 119- 23 -34- 0007) (13 -006). Staff is currently reviewing the application for completeness. Also, there are a number of projects that have been approved, but are still not filed and closed out: 1. Ess Addition (city files 05 -017, 08 -003 and 12 -024). The City Council granted an after - the -fact extension for this final plat at their November 29, 2012 meeting. The applicant is now working to file the required documents to close out this file. 2. Corcoran Business Park (city file 06 -005). The City Council granted a one year extension to the final plat approval, which expired on April 12, 2011. Staff has spoken to the applicant and is still working to close out this project. 3. Northern Natural Gas Administrative Permit (city file 09 -009). An administrative permit for a meter station was approved and is under construction. The city will retain the escrow account until the project is completed to ensure that the project is completed according to the plans. The majority of the improvements and conditions of approval have been met. However, the landscaping has not yet been installed. Northern Natural Gas indicates that there are still connections that need to be made on site and landscaping cannot be installed until completed. City staff was notified that the landscaping was installed on site and conducted an inspection June 3, 2011. The landscaping and all other improvements were installed per City requirements. Staff will begin the project closeout process after the landscape guarantee period expires in 2013. 4. Satellite Industries Site Plan Amendment, Conditional Use Permit Amendment, Lot Consolidation and Easement Vacation (city file 10 -007). On September 23rd the City Council approved Resolutions 2010 -37, 2010 -38 and 2010 -39 approving the request with a number of conditions. The applicant has addressed those conditions and has submitted a building permit application and has begun site work. Staff inspected the site on October 12th and found that the major site improvements had been made, but there are several items that still have to be addressed. We have discussed these items with the landowner. The city has a financial guarantee in place to ensure completion. 5. Park Place Storage After - the -Fact Extension of Approvals (city file no. 10 -008). On September 23, 2010, the City Council approved a site plan and conditional use permit amendment for Park Place Storage to construct the 18th and final mini - storage building on that site. The approvals expired on September 23, 2011. The applicant contacted the City and requested a one year extension until September 23, 2012. The conditions have been met and a building permit was issued in September. The applicant has completed most of the site work with final items to be completed in the spring. 6. Rocks N Blocks Site Plan Amendment and Conditional Use Permit (city file no. 10 -012). An application was received for a Conditional Use Permit and Site Plan Amendment to continue operation of a business with outside storage at 20010 75th Avenue North. The application was approved by the City Council on June 23rd. This was approved as a way to correct a code enforcement issue. No work has been done on site to correct the code violations. The applicant has not yet complied with the conditions of approval and has asked for a 3 month extension. The approvals expired on September 23, 2012. The applicant is working to complete the site improvements. MEMORANDUM 2 7. Hope Ministries Conditional Use Permit for Cemetery and Vacation of Drainage & Utility Easement at 19951 Oswald Farm Road (city file 12 -002). Hope Ministries has submitted a request for a conditional use permit to allow a cemetery west of the existing church. The application was approved by the City Council on March 22nd and site work had begun. 8. Zoning Ordinance Amendment to Section 1070.020 regarding Conditional Use Permit Amendments (City file no. 12 -017). On October 11th, the City Council directed staff to prepare a zoning ordinance amendment to allow conditional use permit amendments to be processed administratively rather than through the public hearing process as currently required. This item was scheduled for a public hearing at the Planning Commission on December 6th. No action was taken because there was no quorum. We rescheduled this item for the February 7th Planning Commission meeting. The Council approved this amendment at the February 28th City Council meeting. 9. Topography and Wetland Waiver for Brent Heinz at 20801 CR 117 (03- 119 -23 -14 -0002) (City File 12 -027). This application was approved by the City Council on January 24th. 11. Site Plan Amendment for setback flexibility for Tech Ung at 6970 Oak Ridge Road (26- 119 -23- 44 -0005) (City File 12 -028). Council Meeting: March 28, 2013 Prepared By: Chief Sean Gormley Topic: Weather Station Action Required: Information Only Background- Hennepin County Emergency Management initiative to improve monitoring of "live weather" conditions as it moves in to Western Hennepin County. This initiative began out of discussions that there was a lack of "live weather" information preceding the 2006 Rogers Tornado. Discussion- Hennepin County Emergency Management obtained funding source that provided for approximately 15 "live weather" monitor systems to be strategically placed in Western Hennepin County. In partnership with HCEM, Corcoran Public Safety offered the 50' radio tower located at City Hall as a weather system site location. The installation was completed on March 12, 2013 and is now feeding HCEM "live weather" data. In addition, located in the Corcoran Public Safety EOC (Emergency Operation Center), a digital read out display was mounted. Future plan is for a "public facing" website created by and maintained by HCEM which our residence can log into for "live weather" data. Patnode Trust (PID 19- 119 -23 -41 -0002) (city file no. 13 -001) REVIEW DEADLINE: April 15, 2013 1. Application Request The landowner is requesting city approval to re- enroll this land into the Metropolitan Agricultural Preserves Program and initiate expiration. Notice of this request was published in the local paper as required by State statute. 2. Background This property was platted in 2012 as "MTP West Acres" so that 10 -acres of the farmstead could be sold to their children. The remaining 68.75 acres would now be re- enrolled in Agricultural Preserve. Chapter 473H of the State Statutes requires that the property must be zoned long -term agricultural (or Agricultural Preserve in Corcoran). The owner must sign an eight -year perpetual covenant /agreement to leave the property in agricultural use, and farm using acceptable practices. In return, there are number of benefits to a landowner who enters into this program, including the fact that special assessments cannot be levied on Agricultural Preserve property. The property is located in the MUSA and is currently shown as Agricultural Preserve on the 2030 Future Land Use Map, as required by statute. The property is zoned Rural Residential. The City has discretion when considering designating land as Agricultural Preserve and must determine whether the designation has any negative impact for the City. The Comprehensive Plan states "The City of Corcoran encourages the continuation of agricultural use within the community. This policy expresses the City's endorsement of the Metropolitan Agricultural Preserves program. All land parcels in the City that meet the requirements for eligibility in the Metropolitan Agricultural Preserves program according to Minn. Stat. Section 473H may apply to the City for enrollment. This policy is not intended to interfere with agricultural status of any lands prior to adoption of the Comprehensive Plan." MEMORANDUM To: Dan Donahue, City Administrator — Corcoran From: Kirstin Barsness, Development Consultant Date: March 21, 2013 RE: Phase I -TIF District No. 1 Review Background The City of Corcoran requested an initial review of the TIF Plan and associated budget for District No. 1. The purpose of the review was to determine if the budget categories are sufficient to meet the needs of the proposed 2013 TIF activities, highlight areas the need to be addressed administratively, and to recommend a course of action. Additionally, Phase I included two meetings: the first with City Staff and the second to assist the City Council in developing a program for potential TIF use. This report is represented in two sections. I will outline my finding of the TIF Plan review and itemize considerations for moving forward. Secondly, the preliminary list of proposed uses will categorized according to timeline, budget and statutory constraints. Phase II will evaluate each activities aptitude for success. TIF Plan Review and Findings To determine the status of the Budget, I examined the existing proposed budget within the last modification (No. 4) completed in February 2007. These categories were compared to the TIF Report prepared for the Office of the State Auditor (OSA) in 2011 to determine if funds needed to be re- allocated within the Budget to reflect actual expenditures. Findings for the review include: • There are sufficient funds in the budget and corresponding categories to accomplish any proposed activities. The budget number does differ from the actual TIF revenue receipted. The budget was an estimate based on the project proposed back in 2007. This is typical in TIF plans and not an area of concern. The exception to the above statement is in the administration category. The Budget needs to be amended to be reflective of both actual expenditures to date and the anticipated end of the term administration total. Under statute, administration includes bond counsel, planning, staff time, economic development consultants and a portion of legal (related to everything, but property purchase). Cities are allowed up to io% for administration of TIF Districts, with the io% calculated as a percentage of the actual increment expended. Actions needed: 1. Amend the budget to increase the administration to lo% of TIF collected and expended or approximately $3o4,500. 2. According to the table below $231,429 has already been expended for administration. This leaves approximately $73,000 in remaining in the budget category. This amount is insufficient to pay for the Highway 55 Planning reimbursement and the proposed Design Guideline updates which equate to $120,000 collectively. 3. One course of action is to determine if engineering or certain legal activities were charged to administration and re- position them to their appropriate line item. 4. Budget changes can be handled administratively, as long as the amount of the budget is not increased. No Pre - Contractual Obligations & No Claims for Compensation: This is a request for proposals and not a call for tenders or request for binding offers. No contractual obligations will arise between the City of Corcoran and any proponent unless the City of Corcoran and a proponent enter into a formal, written contract for the proponent to perform the required work. A proponent may propose changes to the specifications for consideration by the City of Corcoran. These changes will only be considered after contract award and the City may choose not to accept any or all changes. BACKGROUND OF PROJECT The City of Corcoran and the Maple Hill Estates Neighborhood Committee known as Mobile Hope (Committee) is planning to erect a small activity center of approximately 3,500 + square feet utilizing a $225,000 Community Development Block Grant (CDBG) at a pre- selected site within the Maple Hill Estates neighborhood, 7800 Maple Hill Road, Corcoran, MN 55340. The site plan and other documentation are included in Appendix A. In Appendex B, the Maple Hill Neighborhood Committee has developed a vision and a concept for a Community Center that approximates their wishes. It is the intent of the City of Corcoran and the Committee that the winning proposer utilize and incorporate into the project donated goods, services, and labor. The proposer must be willing to work with the Committee to facilitate and coordinate this effort. PURPOSE The purpose of this Design - Build/Construction Management RFP is to identify the most qualified and best value Design - Build/Construction Management contractor for this project through a structured, open and competitive process. The designer /contractor will be chosen based on, and in no particular order of priority: • Professional qualifications • Construction experience • Project management skills • Site and building design experience • Site and building cost • The ability to work within a team approach with the City of Corcoran and the Committee • Familiarity with the contracting process required of CDBG funded projects • Ability to utilize donated professional services, donated labor, and donated building/construction equipment and materials 2 Request for Proposals City of Corcoran Maple Hill Estates Activity Center • Ability to account for all donated services, materials, equipment, and labor within CDBG accounting guidelines It is intended that a final contract will be negotiated with the successful proponent and such contract shall include, but not be limited to, site -work and building design plans, preparation of building documents for bidding project out, managing subcontractor bid process, budget monitoring, construction and project management through entire project. The total budget, including all site -work and building design, engineering and construction is $205,000. Submissions with a cost higher than the budgeted amount will be considered, however, proposals should include detailed information concerning cost saving alternatives to meet the City's limit of $205,000. If necessary, proposals can scale back the scope of work (i.e., list alternatives to meet the cost of this project per budgetary limitations). The RFP is intended to provide proponents with sufficient relevant information about the project requirements to enable them to submit an appropriate proposal. Site preparation and construction could commence in Spring of 2013 with substantial completion by November 1, 2013 and total completion by December 31, 2013. SCOPE OF WORK This is a Request for Proposals for the design - build/construction management services for the erection of an Activity Center within the Maple Hill Estates Neighborhood. The project will not exceed $215,000 in proposed costs that would be charged against the CDBG Grant. The scope of this project will include the designing, drafting plans for the proposed Community Center to include all architectural and engineering, etc., components for the preparation of all construction bid ready (code compliant) documents for the new Community Center. Site preparation and restoration will also be included in the services provided by the successful applicant. The applicant will also oversee the bid and selection process in conjunction with the City of Corcoran. Site Design: As a guideline, we anticipate the proponent's proposal should include, but not limited, to the following: • Detailed site design plan created in conjunction with our Municipal Development Ordinance, to include green space as required for the project. See Appendex A • Any required structural fill to obtain required grade /slope. (Also, compaction and any alterations needed for the proper site preparation). Soil borings are provided by City. • Water, sewer, electrical, telephone, cable, internet connection plan, including the laying of these services. • Approved parking areas (if needed) Building Design: As a guideline, we anticipate the proponent's proposal should include, but not limited, to the following: • The winning proposer will work with the City and the Committee on the concept design • Costs for detailed architectural and engineered plans for "Proposed ", new Corcoran/Maple Hill Activity Center. (Meeting all building code, OSHA, and any other required standards for a new Community Center facility. 3 Request for Proposals City of Corcoran Maple Hill Estates Activity Center • Approximate dimensions are: —3,500 square feet with approximate dimensions of 66 by 54 feet • Building may be of wood or steel frame with exterior being of an appropriate tone colored type material, (in accordance with City of Corcoran's Municipal Development Ordinance) and meeting all applicable state building code requirements. • Provide space for a future food preparation "catering style" kitchen. Plumbing and electrical wiring should be stubbed in to allow for future construction of a kitchen.. • A computer lab room with appropriate AN wiring, electrical outlets, and internet capabilities • Provide for male and female restrooms as per floor plan draft. With commercial rated toilet and sink meeting ADA requirements. • Create mechanical room with adequate electrical, mechanical, and plumbing supply and space • Create office space. • All walls, doors, windows, roofs, floors to be insulated per state building code. • An office area with appropriate telephone, internet wiring throughout building as needed. • Security system. Electronic entry system using code or "fob" system is desired. Suggest it be coordinated with a computer to record access devices. Cameras for entry and parking lot also desired • Standard hot water heater with the option for high efficiency on demand water heater which shall be properly sized to supply hot water to all points in the structure. • Exterior GFCI outlets to be installed on sides of building per code Site and Building Construction: • Detailed schedule for entire design, bidding, construction including key tasks and milestones showing completion on or before August 31, 2013. Occupancy of the building shall be possible for this project no later than December 31, 2013. • HVAC throughout the structure. • Scheduling of progress meetings regularly during project, to include periodic walk thru on premises during construction. This shall include a tentative timeline for completion by phases. 1. Designated regular meeting dates with construction manager and vendors, requiring attendance and minutes published and disseminated to all parties. Minutes should include attendance and list all attendees. 2. Development of a "Tentative Project Timeline and Phasing" list to detail benchmarks in the construction project. 3. Provisions for protection and cleanliness of surrounding buildings during demolition and construction CONTRACTOR INFORMATION: Proposals should include the following information: • Information on the experience of key personnel to be involved in the project and at least three (3) references from the proponent for work on similar projects must be provided as per the attached Schedule "B ". Proponents may be required to submit evidence of their resources and their ability to carry out the work in their respective submissions. 4 Request for Proposals City of Corcoran Maple Hill Estates Activity Center • Insurance. The proponent will be expected to have comprehensive general liability insurance in the amount of one millions dollars ($1,000,000) per occurrence. Proponents must require all subcontractors to carry and provide evidence of similar comprehensive general liability insurance and limits, including automotive liability. • Professional Responsibility. The successful proponent will be expected to provide services in accordance with a standard of care, skill and diligence maintained by a person or firm providing the design, engineering and construction and management services described herein. FEE STRUCTURE • A fixed price estimate by specific category is required for all work necessary to complete the City of Corcoran/Maple Hill Activity Center without limiting the generality of the foregoing, including all charges for: o Design (to include specific costs for architectural, engineering, etc.) o Site Preparation o Construction Costs o Management of Project Cost o Management and accounting of all donated services and donated building materials o Rate per hour for any extras in the event of any changes in the Scope of Work or other (detailed) • The proponent must specify in the proposal, the fees required to satisfy all terms referenced in the project, the work plan and methodology. The proponent must clearly identify and detail all costs separately. (i.e., the various stages of the work plan, with specific categories clearly identified). • The fee structure shall be based on milestones and deliverables to the City of Corcoran over the duration of the contract period. • Terms of Payment. The proponent must adhere to the payment requirements specified by the City of Corcoran and the regulations required of all CDBG funded projects. All payments requests will be through invoices on a monthly basis and on a schedule determined at time of award. Retainage will be 5% until occupancy and then may be reduced to 2% at city's discretion. All manuals and warranties must be provided prior to release of retainage. • Cost Controls. The proponent must provide in the proposal a description of the cost control measures that will be employed to effectively manage the project budget. MANDATORY SITE VISIT. A mandatory site visit meeting will be held on April 12, 2013, 10:00 am at Maple Hill Estates Office (adjacent to the Playground), 7800 Maple Hill Road, Corcoran, MN. 55340 PROPOSAL FORMAT. Proponents are asked to respond in a similar manner. The following format and sequence should be followed in order to provide consistency in review of proposals and to ensure each proposal receives full and complete consideration. All pages should consecutively numbered. • Title Page, including Request for Proposal title, proponent's name, address, phone number, fax number, email address and contract representative; 5 Request for Proposals City of Corcoran Maple Hill Estates Activity Center • One page Letter of Introduction signed by the person or persons authorized to sign on behalf of the proponent which will bind the proponent to statements made in the proposal; • An Executive Summary of the key features of the proposal; • The Body of the Proposal, including pricing (i.e.: the proponent's "response" to the RFP); • Any Additional Information that a proponent may choose to provide. • Bid bond or cashier's check in the amount of five percent (5 %) of the proposed bid DOCUMENTS. The successful proponent will be required to provide all documents related to the project to the City of Corcoran in hard copy and in electronic pdf format. EVALUATION OF PROPOSALS. Evaluation of proposals will be by City of Corcoran, in consultation with the Maple Hill Estates Committee, and others as may be required, and a recommendation will be referred to the City of Corcoran and its City Council. Proposals will be evaluated to determine best overall value to the City of Corcoran and the Maple Hill Estates Community based on the following criteria (listed in no particular order or priority): • Site design and approach to site preparation, servicing and foundation work; • Building design, having particular regard to the design guidelines noted above, and the ability to expedite project beginning and completion; • Fee proposal for total fixed fee, rates, charges, including details on the costs; • History of successful project completion and general reputation in the industry including similar construction management experience with public facility contracting and administration; • Nominated staff experience (technical and other) on public buildings and projects of similar size and type; • Commitment of key team members to the project for the term of the project, including consideration of current workload and ability to fast -track the project to a minimum state of completion; • Quality and completeness of proposal submission, including familiarity and understanding of the project; • Experience in methodology for communicating with owners, consultants, contractors and others; • Methodology and experience regarding cost and schedule control; • References from clients with respect to similar projects, along with summary details of project. • Ability to work with and utilize donated supplies, building materials, and donated labor • Ability to meet the Prevailing Wage Requirement in HUD Programs (see Appendex C which provides the detailed requirements including: wages, use of volunteers, sweat equity, and record keeping. The evaluation criteria may be applied on a comparative basis vis -a -vis each proposal and the objectives of the project. No totals, weights or scores will be provided to any proponent. The City of Corcoran staff may, at their discretion, request clarifications or additional information from a proponent with respect to any proposal, may make such requests to only 6 Request for Proposals City of Corcoran Maple Hill Estates Activity Center selected proponents, and may consider such clarifications or additional information in evaluating a proposal. NEGOTIATION OF CONTRACT. If the City of Corcoran selects a proponent, then it will enter into discussions with the proponent to clarify any outstanding issues and attempt to finalize the terms of a Contract, including budget and financial terms. If discussions are successful, the City of Corcoran and the selected proponent will finalize a contract. If at any time the City of Corcoran reasonably forms the opinion that a mutually acceptable agreement is not likely to be reached within 30 days, then the City of Corcoran may give the selected proponent written notice to terminate discussions, in which event the City of Corcoran may then either open discussions with another proponent or terminate this RFP and deal the project in some other manner or not at all. OWNERSHIP OF PROPOSALS AND FREEDOM OF INFORMATION. Proposals will be received and held in confidence by the City of Corcoran, subject to the provisions of the Freedom of Information and Protection of Privacy Act. All documents, including proposals, submitted to the City of Corcoran become the property of the City of Corcoran. Hay, Trustee of the Bruce B. Hay Revocable Intervivos Trust dated April 28, 1992 located at 5850 H. Teakwood Lane North, Plymouth, Minnesota ( "Owner "). RECITALS WHEREAS, City intends to use Community Development Block Grant ( "CDBG ") Funds for the construction of a Community Center ( "Project ") of approximately 3,000 square feet; said Project to be located on the property known as Maple Hills Estate Mobile Home Park within the City; and WHEREAS, the land upon which the project will be constructed is owned by Owner and legally described as: See Exhibit A attached ( "Subject Property ") and; WHEREAS, the Project will be constructed within the boundaries of Subject Property, surveyed by the City, and legally described as: See Exhibit B attached ( "Leased Property ") and; WHEREAS, City currently owns the property legally described as: See Exhibit C attached which property will provide the City access to the Leased Property; and WHEREAS, City shall own the Community Center structure for a minimum of fifteen (15) years; Owner shall Lease to the City the property upon which the Community Center is constructed for a minimum of fifteen (15) years; further Owner shall grant to the City an easement for construction purposes on Subject Property for purposes of the City completing the Project. NOW, THEREFORE, in consideration of the mutual promises, covenants and consideration herein contained, the parties agree to as follows: I. PURPOSE The City intends to construct a Community Center of approximately 3,000 square feet to be located adjacent to the Maple Hills Estates Mobile Home Park for use as a public facility that will be operated and managed by the City during the period of this Agreement. The Community Center will be available for use by all of Corcoran's citizens and may be used for the following: computer center; community classes; community events; tutoring of school children; craft activities; youth center; career assistance. The foregoing is not an exclusive list of uses for the Community Center. II. REAL ESTATE 1) Lease of Real Estate /Option to Extend. Owner of Subject Property hereby leases to the City, the Leased Property for a period of fifteen (15) years, commencing on day of 2013 and terminating on the day of , 2028. Consideration for the Lease provided by Owner is the 2 beneficial use of the Community Center by the residents of the Maple Hills Estates Mobile Home Park. 2) Extension of Lease. City in its sole discretion, may extend the Lease for additional ( ) with no additional consideration. Notice of intent to extend the Lease shall be given by the City within one year of the Lease termination date. Notice shall be given as provided in this Agreement. 3) Ownership of Community Center. For the period of the Lease provided above, or its extension, City shall own the Community Center building. At the termination of the Lease, the City may transfer ownership of the Community Center to Owner or his successor in title. III. CONSTRUCTION EASEMENT 1) Owner hereby grants a Construction Easement in favor of the City, its contractors and employees over the Leased Property and additional portions of subject property reasonably necessary for construction of the Project. ( "Easement ") 2) The Construction Easement is granted for a period of time commencing with the execution of this Agreement and terminating with completion of the Project 3) City shall use the Easement area for purposes of constructing the Community Center and therefore after City shall use and maintain said Community Center as provided in this Agreement. IV. CONSTRUCTION AND MAINTENANCE OF COMMUNITY CENTER 1) The City shall have the sole and complete responsibility and discretion of the design and construction of the Community Center. Owner will have the opportunity to provide input into 3 the Community Center, however, final decision regarding design and construction is with the City. 2) City shall be responsible for ongoing costs, maintenance and repair of the Community Center with the exception of those costs and responsibilities specifically undertaken by Owner. Owner shall provide, at no cost to the City, utilities, cleaning supplies, garbage service and picnic tables for the Community Center. V. FINANCING 1) The City is responsible for the construction of Community Center; it is anticipated that construction costs will be $407,697; that the financing of the Community Center is anticipated to be as follows: a) CDBG Funds $248,107 b) Maintenance Contribution by Owner $ 50,100 c) Volunteer Time /Value Non - Profits $ 56,430 d) Volunteer /In Kind Donations $ 48,560 e) City Fees (Waived) $ 4,500 $407,697 2) Owner shall be responsible to pay all real estate taxes, special assessments and any other charges against Subject Property during the term of this Lease. N.,A1 VI. OPERATION AND USE OF COMMUNITY CENTER 1) Purpose of the Community Center is for use by the public for those recreational and educational programs listed in this Agreement. So long as City owns the building, the City shall be responsible for coordinating daily use of the Community Center building and the City shall maintain the sole discretion of use of the facility. 4
