HomeMy WebLinkAboutResolution 2003-74 - Approving Vacating Easements Within the Bluffs of Corcoran City of Corcoran County of Hennepin State of Minnesota RESOLUTION NO. 2003-74 MOTION BY MEMBER: THOMAS SECONDED BY MEMBER: LYMANGOOD WHEREAS, the City Council of the City of Corcoran has determined to vacate easements within the development known as The Bluffs of Corcoran; and WHEREAS, a public hearing was held on November 13, 2003 before the City Council in the city hall after due published and posted notice had been given by the administrator on October 27, 2003, a reasonable attempt was made to give personal notice to all affected property owners, and all persons interested were given an opportunity to be heard; and WHEREAS, any person, corporation or city owning or controlling easements contained upon the property vacated, reserves the right to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove or otherwise attend thereto; and WHEREAS, it appears that it will be in the best interest of the city to vacate such easements; and WHEREAS, four-fifths of all members of the City Council concur in this resolution; NOW, THEREFORE, BE IT RESOLVED, that the easements as described in Exhibit A hereto attached are hereby vacated. EXHIBIT A Resolution No. 2003-74 DRAINAGE AND UTILITY EASEMENTS TO BE VACATED IN THE BLUFFS OF CORCORAN • Existing Drainage and Utility Easements to be Vacated 1. That part of the 10 foot wide drainage and utility easement along the most easterly line of Lot 1, Block 3, The Bluffs of Corcoran, which lies south of the south line of the north 15.00 feet of said Lot 1 and north of the north line of the south 10.00 feet of said Lot 1. 2. That part of the 10 foot wide drainage and utility easement along the most westerly line of Lot 14, Block 2, The Bluffs of Corcoran, which lies south of the south line of the north 15.00 feet of said Lot 14 and north of the north line of the south 10.00 feet of said Lot 14.
