HomeMy WebLinkAboutResolution 2003-63 - Approving CHOL for Donald Feltl for the Operation of Landscaping and Snow Removal at 7885 Kalk Road PIP • City of Corcoran County of Hennepin State of Minnesota RESOLUTION 2003-63 Motion By: Bucher Seconded By: Thomas A RESOLUTION TO APPROVE A CONDITIONAL HOME OCCUPATION LICENSE FOR DONALD FELTL FOR THE OPERATION OF A LANDSCAPING AND SNOW REMOVAL CONTRACTOR AT 7885 KALK ROAD. WHEREAS, Donald and Kristi Felt] at 7885 Kalk Road, have applied for a Conditional Home Occupation License, (CHOL); and WHEREAS, the ordinance states that the Commission shall consider certain standards and criteria when reviewing a CHOL; and WHEREAS, a public hearing was held on September 18, 2003 as required by Ordinance. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Corcoran that a CHOL shall be granted to Donald and Kristi Feltl at 7885 Kalk Road, for the purpose of a landscaping and snow removal contractor service based on the following findings and subject to the identified conditions: FINDINGS: • The current use is presently illegal under the existing zoning ordinance. • The site in question consists of approximately 1.5 acres and has driveway access directly to Kalk Road, which is a residential road. • The site is presently zoned Rural- Residential and is guided to remain Rural- Residential in the land use plan. • They have indicated that they have one employee. • They have four business vehicles, which are pickup trucks and one dump truck, also two trailers. • They have outside storage of the vehicles and trailers. • There is utility building consisting of approximately 1,100 square feet on the premises, which is utilized for the business. • They have indicated there are no deliveries, no customers on site, and no signage. CONDITIONS: 1. The CHOL is issued to Donald&Kristi Feltl, at 7885 Kalk Road and is not transferable. 2. No advertising signage for the business is permitted on site or off site. 3. All equipment shall be kept within the accessory structure or screened from public view. 4. One employee shall be permitted, providing the dates of employment are verified to the satisfaction of the City. l • City of Corcoran County of Hennepin State of Minnesota 5. The applicant shall abide by and remain in compliance with all applicable Federal, State and City rules and regulations. 6. This license will be reviewed by the City every three years from the date of issuance to assure compliance with the conditions as defined with in this license and conditions within the Home Occupation Ordinance. 7. The City may revoke or modify the CHOL to assure the strict enforcement of the Home Occupation Ordinance, or upon a finding that conditions have change to warrant revocation or modifications of the license.
