HomeMy WebLinkAboutResolution 2003-52 - Approving CHO License for Bruce Smith For Seal Coating and Asphalt Repair Operation at 10410 Cain Rd I ' 1 City of Corcoran County of Hennepin State of Minnesota RESOLUTION 2003-52 Motion By: Bucher Seconded By: Thomas A RESOLUTION TO APPROVE A CONDITIONAL HOME OCCUPATION LICENSE FOR BRUCE SMITH FOR THE OPERATION OF A SEAL COATING AND ASPHALT REPAIR CONTRACTOR AT 10410 CAIN ROAD. WHEREAS, Bruce Smith at 10410 Cain Road, has applied for a Conditional Home Occupation License, (CHOL); and WHEREAS, the ordinance states that the Commission shall consider certain standards and criteria when reviewing a CHOL; and WHEREAS, a public hearing was held on February 20, 2003 as required by Ordinance. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Corcoran that a CHOL shall be granted to Bruce Smith at 10410 Cain Road, for the purpose of a seal coating and asphalt repair contractor service based on the following findings and subject to the identified conditions: FINDINGS: • The current use is presently illegal under the existing zoning ordinance. • The site in question consists of approximately 1.0 acres and has driveway access directly to Cain Road, which is a residential road. • The site is presently zoned Rural— Residential and is guided to remain Rural Residential in the land use plan. • There are no deliveries and no on site customers. • There is outside storage. • They have a pick-up truck and two business trailers. • The home occupation consists of an office in the home and storage in the driveway. • They have indicated that they have no employees. • There are no advertising signs for the business. CONDITIONS: 1. The CHOL is issued to Bruce Smith at 10410 Cain Road and is not transferable. 2. No advertising signage for the business is permitted on site or off site. 3. All equipment shall be screened from the North side. 4. The applicant shall abide by and remain in compliance with all applicable Federal, State and City rules and regulations. This license will be reviewed by the City every three years from the date of issuance for a determination that the existing Home Occupation still warrants the issuance of a license. 6. The City may revoke or modify the CHOL upon a finding that conditions have changed to warrant revocation or modifications of the license. 7. Screening consisting of either shrubbery or fencing shall be placed on the north side of the property.
