APPROVING A SITE PLAN AND CONDITIONAL USE PERMIT FOR GROVE
NURSERY CENTER, INC. FOR PROPERTY LOCATED AT THE SOUTHEAST
QUADRANT OF COUNTY ROAD 30 AND TRAIL HAVEN ROAD.
WHEREAS, Grove Nursery Center, Inc. has requested a site plan and
conditional use permit for a wholesale nursery on the 23.43-acre parcel legally
described as follows:
That part of Lot 1, Block 3, The Bluffs of Corcoran, which lies
westerly of the following described line: Commencing at the
northwest corner of said Lot 1, thence on an assumed bearing of
north 88 degrees 12 minutes 20 seconds east along the westerly
segment of the north line of said Lot 1 a distance of 782.82 feet to
an angle point in said north line, and the point of beginning of the
line being described; thence south 1 degree 47 minutes 40 seconds
east to the south line of said Lot 1, and said line there ending.
WHEREAS, the Planning Commission has reviewed the request at a duly called
Public Hearing; and
WHEREAS, the City Council exempts this application from the moratorium on
Nurseries and Greenhouses in the R-1 and A-1 district based on the finding that
the applicant submitted an application in good faith and the proposal adequately
addresses the City's concerns about impacts on surrounding properties;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does
approve the request by Grove Nursery Center, Inc. for a site plan and conditional
use permit, subject to the following findings and conditions:
1. The site plan and conditional use permit are approved in accordance with the
plans received by the City on June 9, 2003 and revisions received July 31,
2003, and August 21, 2003 except as amended herein.

2. The applicant shall enter into a Development Agreement with the City and a
financial guarantee for the improvements shall be required.
ADOPTED by the City Council this 28th day of August 2003.
