A RESOLUTION TO APPROVE AN EXEMPTION FROM THE MORATORIUM
TO ALLOW SUBMITTAL OF A SITE PLAN AND CONDITIONAL USE
PERMIT APPLICATION SUBMITTAL BY IMMANUEL UNITED METHODIST
CHURCH LOCATED AT 10025 COUNTY ROAD 101
WHEREAS, the applicant, Immanuel United Methodist Church, has requested an
exemption from Ordinance No. 176 Declaring a Moratorium on Subdivision or
Development within the City in order to proceed with a site plan amendment and
conditional use permit amendment to expand the existing church; and
WHEREAS, the Corcoran Planning Commission has reviewed this application for an
exemption from the moratorium on May 1, 2003,
WHEREAS, the Corcoran City Council reviewed this item at their meeting on May 22,
2003; and
NOW THEREFORE BE IT RESOLVED that the Corcoran City Council approves the
moratorium exemption based on the following findings:
1. The existing zoning and subdivision ordinances will adequately protect the
property.
2. The future right-of-way needs for expansion of County Road 101 are unclear at
this time, but we expect Hennepin County to require a total of 60 feet of right-of-
way from the center line of the road. This would require an additional dedication
of 27 feet of church property. Since the Church is 63 feet from the property line, it
is unlikely that a road expansion would encroach upon the existing or proposed
structure. Therefore,the City Council finds that the potential future road
expansion would not impact the church.
3. The existing use is not inconsistent with the City's Comprehensive Land Use Plan
guidance.
4. By granting the moratorium exemption it in no manner grants or implies approval
of the proposed site plan amendment or conditional use permit amendment.
