HomeMy WebLinkAboutResolution 2003-15 - Approving Conditional Home Occupation Licese for 22610 County Rd 50 City of Corcoran County of Hennepin State of Minnesota RESOLUTION 2003-15 Motion By: Thomas Seconded By: Bucher A RESOLUTION TO APPROVE A CONDITIONAL HOME OCCUPATION LICENSE FOR MICHAEL PATNODE FOR THE OPERATION OF AN AUTO REPAIR SERVICE AT 22610 COUNTY ROAD 50 WHEREAS, Michael Patnode at 22610 County Road 50, has applied for a Conditional Home Occupation License, (CHOL); and WHEREAS, the ordinance states that the Commission shall consider certain standards and criteria when reviewing a CHOL; and WHEREAS, a public hearing was held on February 20, 2003 as required by Ordinance. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Corcoran that a CHOL shall be granted to Michael Patnode at 22610 County Road 50 for the purpose of an auto repair service based on the following findings and subject to the identified conditions: FINDINGS: • The current use is presently illegal under the existing zoning ordinance. • The site in question consists of approximately 78.36 acres and has driveway access directly to County Road 50, which is a minor arterial. • The site is presently zoned Rural —Residential and is guided to remain Rural Residential in the land use plan. • There are approximately 3 parts deliveries per day. • There are approximately 15 to 18 customers per week. • Business hours consist of 8:00 am to 4:30 pm, Monday through Friday. • The operation is conducted within an accessory structure. • There is one on-site employee. • There are no advertising signs for the business. CONDITIONS: 1. The CHOL is issued to Michael Patnode at 22610 County Road 50 and is not transferable. 2. No advertising signage for the business is permitted on site or off site. 3. All equipment shall be kept within the accessory structure or screened from public view. 4. The applicant shall abide by and remain in compliance with all applicable Federal, State and City rules and regulations. 5. This license will be reviewed by the City every three years from the date of issuance for a determination that the existing Home Occupation still warrants the issuance of a license. The City may revoke or modify the CHOL upon a finding that conditions have changed to warrant revocation or modifications of the license. 7. All wastes associated with this operation shall be stored and disposed of in accordance with State and local rules and regulations. 8. One on-site employee shall be permitted, as appropriate documentation has been supplied to the City.
