A RESOLUTION IDENTIFYING FINDINGS FOR THE DENIAL OF A
CONDITIONAL HOME OCCUPATION LICENSE FOR
JON HANS LOCATED AT 19543 COUNTRY CIRCLE EAST
WHEREAS, Jon Hans, 19543 Country Circle East, has applied for a Conditional Home
Occupation License, (CHOL); and
WHEREAS, the ordinance states that the Commission shall consider certain standards and
criteria when reviewing a CHOL; and
WHEREAS, a public hearing was held on January 16, 2003 as required by Ordinance; and
WHEREAS, on February 27, 2003 the City Council received and acted upon the Home
Occupation Commission's recommendation to deny the application and directed staff to prepare
a resolution with the findings for the denial.
THEREFORE, BE IT RESOLVED, that the City of Corcoran does hereby identify the following
as findings for the denial of the Home Occupation License application submitted by Jon Hans:
1. The current use is illegal under the existing zoning ordinance.
2. Uncontested testimony established:
• Industrial use within a residential neighborhood.
• Observe frequent deliveries and transporting of cabinetry in vans and trailers, vehicles
which are not compatible with a residential neighborhood.
• Sounds of routers and saws heard throughout the day, into the evening hours and on
weekends. Disturbing and incompatible with the surrounding residential use.
• High pitched machine noise can be heard inside the neighboring house, even when
doors and windows are closed. More obtrusive when trying to enjoy the outdoors.
• Concerned with possible chemicals being used, such as solvents, which could be
combustible.
• The bulk of the activity is within 20 feet of a residential dwelling.
3. It is the City's responsibility to protect the heath, safety and general welfare of its
residents, and therefore without contrary testimony finds this use to be incompatible with
the dense residential neighborhood.
