CALL TO ORDER AND ROLL CALL The Corcoran City Council met on May 14, 2009, at city hall in Corcoran, Minnesota. Present were Mayor Guenthner, Councilor Gmach, Councilor Hudok, Councilor Milbrandt and Councilor Thomas. Also present were City Administrator Donahue, City Engineer Torve, Police Chief Gormley, and Corporal Hamilton. Mayor Guenthner called the meeting to order at 7:00 p.m. 2. PLEDGE OF ALLEGIANCE 3. AGENDA APPROVAL MOTION made by Thomas, seconded by Milbrandt, to approve the agenda with the following additions: 8D: Update on Police Union Contract 8F: Update of UCOG Planning Grant 11D: May 28, 2009 City Council Item Update Voting Aye: Gmach, Guenthner, Hudok, Milbrandt and Thomas (Motion Carried 5:0) (Motion carried 5:0) 4. CLAIMS AS PRESENTED 4A. Escrow Claims (Fund #500) MOTION made by Thomas, seconded by Milbrandt, to approve Escrow Claims totaling $199.00. Voting Aye: Gmach, Guenthner, Hudok, Milbrandt and Thomas (Motion Carried 5:0) 4b. Building Inspection Claims "There were no Building Inspection Claims 4c. All Other Claims as Presented MOTION made by Thomas, seconded by I ludok, to approve all other claims totaling $146,733.37. PRESENTATIONS None 8. UNFINISHED BUSINESS 84. Shannon Lane Bridge Update Kent Torve, City Engineer presented an update of the Shannon Lane Bridge. He explained that Boonestroo delivered the design signs and upon receipt of the plans Public Works Director, Pat Meister and he marked construction and tree removal limits with stakes. City Engineer Torve provided an expense summary of the project. He provided an expense summary and the costs compared to estimated revenues. He explained that the available revenue will not completely cover the expenses of the project. The Council could consider assessments to benefiting properties. The level of assessment must be equal to or Tess than the benefit to the Shannon Lane Properties. He explained another financing tool used by cities, called the Street Reconstruction Bond. After talking to the bond council he has found that replacing the bridge falls under the safety factor, therefore the City can apply for the bond. He also provided the Council with a brief overview of the Chapter 429 process. City Engineer Torve gave a summary outlining the schedule assuming the Chapter 429 assessment process. It was noted that if assessments are not pursued, the schedule could be accelerated by one month. He also noted that if the City were to fund some of this project out of the general fund that a few years down the road the General Fund could get reimbursed by the sale of the future bonds. A question was asked if this could be done even if the city opted to do the assessment process. The answer was that even if the City were to opt to use the assessment process, money still can be used out of the general fund or other reserves and could be reimbursed by using the bonding process a few years down the road. There was some discussion about residents, neighboring the bridge, getting together and discussing how much they are willing to pay. After coming to some kind of agreement then a policy could be established instead of going through the assessment process. This way may save the City some money. This lead into a discussion about the uniqueness of this project and the affect it has on the formula of financing. A suggestion was made that the City find out what State or Federal dollars may be available for bridge repair before considering self funding. Comments were taken from some of the neighbors of the bridge. More comments will be taken on May 28, 2009. 813. Geo Thermal System Update Councilor Thomas reported that recommendations have been received from two suppliers. The group will be meeting to put together a package of information to submit to additional suppliers for bids. Another update will be reported on May 28, 2009. Charter Commission Applications Mayor Guenther reported that an advertisement looking for Charter Commission Members was placed in the local paper. A couple of letters of interest were submitted. MOTION made by Hudok, seconded by Milbrandt, to appoint to the Corcoran Charter Commission: Dorothy Theis, George Gmach, Ken Guenthner to till the seats of the terms that expired 2008; and to also appoint Tom Cossett and Ken Kluck to fill the terms that expired June of 2006. Voting Aye: Gmach, Guenthner, Hudok, Milbrandt and Thomas (Motion Carried 5:0) 8D. Update on Police Union Contract Council Gmach reported that they are waiting for clarification on one last matter regarding the benefit provisions. Once that is received the contract will be ready. 8E. Update of UCOG Planning Grant Councilor Milbrandt reported that she just received an email saying that the City did not receive the UCOG Planning Grant money. Next round of application is in July for the Fall Semester. There was some discussion of what was funded and a suggestion was made that the next application be detailed in the areas of what was funded for the Spring Semester. 9. PLANNING BUSINESS 9A. Project Status Mayor Guenthner reported that a memo was received from Kendra Lindahl, City Planner, regarding active Corcoran Planning Applications. 10. NEW BUSINESS 10A. NPDES MS4 Permit — Calling for a public meeting on June 25, 2009, 6:45 pm Kent Torve, City Engineer explained to the Council the purpose of NPDES MS4 permit and the reason for the public meeting. Mayor Guenthner called a Public Meeting to be held June 25, 2009 at 6:45 PM to be held at Corcoran City Hall. 11. COUNCIL AND STAFF REPORTS 11A. May 7, 2009 Planning Commission Report Liaison Gmach reported that the Planning Commission held a Public Hearing regarding the Animal Ordinance. After a long discussion the Planning Commission voted to pass the ordinance through. 11B. COPS Hiring Recovery Grant Police Chief Sean Gormley gave a brief update on the grant request. It was noted that the final grant request subtnitted was 5233,924. On April 14, 2009 the City was notified by the United States Department of Justice that the City has been accepted for the review proc3ess. Coyote & Nuisance Animals Corporal John Hamilton reported in the past the City has received complaints of Coyotes and other Nuisance Animals. In an effort to improve the options available for our community, the police department has undertaken a project to seek out additional information. A group has been assembled who will provide input, ideas and suggestions on different perspectives. The final document will be presented to the City Council for comments, suggestions and action if warranted. 1 ID. May 28, 2009 City Council Meeting Update Mayor Guenthner updated the Council on some of the items that will be discussed at the May 28, 2009 Council Meeting. 11E. Letter from Logan Peterson Mayor Guenthner read to the Council a letter received from Logan thanking the City for sponsoring the Firearms Safety Training Course. 12. UNSCHEDULED ITEMS 12A.
