HomeMy WebLinkAbout2009-04-23 - Council MinutesCITY OF CORCORAN CITY COUNCIL MEETING April 23, 2009 1.CALL TO ORDER AND ROLL CALL Mayor Guenthner called the meeting to order at 7:00 p.m. The Corcoran City Council met on April 23, 2009, at City Hall in Corcoran, Minnesota. Present were Mayor Guenthner, Councilor Thomas, Councilor Gmach, Councilor I ludok and Councilor Milbrandt. Also present were interim City Administrator Bodem, Public Safety Director Gormley, Public Works Director Pat Meister and City Engineer Joe Rhein of Bonestroo. 2. PLEDGE OF ALLEGIANCE Mayor Guenthner invited the audience to rise to say the Pledge of Allegiance. 3. AGENDA APPROVAL MOTION by Hudok, seconded by Gmach, to approve the agenda with the following additions: 91. Quarterly Budget 10a. UCOG Grant 12g. Co. Rd. Street Lights 12h. Police Union Update Voting Aye: Gmach, Milbrandt, Thomas, Guenthner and Hudok. (Motion Carried 5:0). 4. CLAIMS AS PRESENTED 4a. Escrow Claims (Fund #500). There were no Escrow Claims 4b. Building Inspection Claims. MOTION by Iludok, seconded by Gmach, to approve Building Inspection Claims. Voting Aye: Thomas, Gmach, Milbrandt, Guenthner and Hudok (Motion Carried 5:0) 4c. All Other Claims as Presented. MOTION by Gmach, seconded by Hudok, to approve All Other Claims as Presented. Voting Aye: Thomas, Gmach, Hudok, Guenthner and Milbrandt. (Motion Carried 5:0) 5. CONSENT AGENDA 5a. 4/08/09 Minutes MOTION by Thomas, seconded by Milbrandt, to approve of the 4/08/09 City Council minutes with the following additions: On Page 2, 7.1, last paragraph; add Denis Stieg and Public Works Superintendent Pat Meister to the Geothermal working group. Voting Aye: 'Thomas, Gmach, Iludok, Guenthner and Milbrandt. (Motion Carried 5:0) 5c. Resolution No. 2009 -14- Northwest Trails Association Sponsoring. MOTION by Gmach, seconded by Hudok, to approve Resolution No. 2009 -14. Voting Aye: Thomas, Gmach, Iiudok, Guenthner and Milbrandt. (Motion Carried 5:0) 6. OPEN FORUM Ken Streeter was present addressing a concern with the proposed guiding of the comp plan that affects a piece of property. Council directed him to provide an exhibit outlining his request to the subcommittee and staff to be included in the 2030 Comprehensive Land Use Plan discussion. 7. DUST CONTROL — Public Hearing The Dust Control Public Hearing was opened by Mayor Guenthner at 7:15 p.m. The following were present to convey their thoughts, ideas and concerns: • Pat Hank likes the dust control effort and said it has improved immensely. • Torn Cossette had a question about the breakdown of cost and how it is derived. • Tom and Carly Hoefer said the dust control helps and would Tike to see two applications per year rather than one. They indicated that paving should be considered. • Others voiced their desire to see it be funded out of the general fund rather than it being assessed to the benefited property owners. Council indicated they will be looking at paving two major roads and will evaluate a more comprehensive paving approach moving forward. Nonetheless, most people were happy with the dust control efforts of the city. MOTION by Gmach, seconded by Hudok, to close the Dust Control Public 1 Tearing closed at 7:26 p.m. Voting Aye: 'Thomas, Gmach, Hudok, Guenthner and Milbrandt. (Motion Carried 5:0) MOTION by Gmach, seconded by Thomas, to approve the Dust Control assessment in the amount of $69,226.75. Voting Aye: Thomas, Gmach, Hudok, Guenthner and Milbrandt. (Motion Carried 5:0) Open Forum Dust Control 8. PRESENTATION. Presentations Page -2- CITY OF CORCORAN CITY COUNCIL MEETING April 23, 2009 1. Adam Kramer of Progressive Consulting (PCE) was present to provide background of their company as it pertains to consulting engineering. PCE is a 13 person consulting engineering firm that specializes in the water supply area and provides solutions to drinking water quality problems, develops water rates, solves plant operation problems. PCE also provides services in water distribution system analysis and design, source development, treatment plant design, upgrading existing plants and in impact analysis of the Safe Water Act Amendments. 2. Fire Chief Brad Feist of the Rogers Fire Department gave his annual fire department overview. 3. Brandon Guest, Hamel Fire Chief gave a brief overview pertaining to the Hanover Fire Department. 9. UNFINISHED BUSINESS 9a. Approve Sign Ordinance No. 246 MOTION by Milbrandt, seconded by Thomas to table Sign Ordinance No. 246 and set a public hearing for the May 28, 2009 City Council meeting. Voting Aye: Thomas, Gmach, Hudok, Guenthner and Milbrandt. (Motion Carried 5:0) 9b. Approve Professional Legal Firm (s) MOTION by Gmach, seconded by Thomas, to approve Carson, Clelland & Schreder as the City's criminal and civil attorney subject to acceptable engagement letter. Voting Aye: Thomas, Gmach, Guenthner and Milbrandt. Voting Nay: Hudok (desire to keep Ratwik for civil) (Motion Carried 4:1) 9c. Shannon Lane Bridge Update A Shannon Lane Bridge Committee provided an update to the City Council. The alternative access easements were signed and delivered. The Public Works Department has constructed the alternative roadway. All the necessary permits have been submitted. The Elm Creek Watershed permit was approved at the April 8th meeting conditioned upon DNR approval. Right -of -entry agreements of the three affected property owners are being worked on. The frequency of inspections has increased and the bridge has not moved. A concern recognized is that cars are avoiding pot holes in the middle of roadway over the bridge and riding the edges thereby creating extra weight which may exacerbate the integrity of the slope and bridge. Bid letting is anticipated for May 15"'. The City will receive up to $250,000 of MNDOT funding. City Engineer Rhein said the City received written confirmation that the project is in -line for funding for construction only —not for appurtenances like engineering, affiliated local road improvements and the like. Letter of Engagement MOTION by Thomas, seconded by Hudok, to approve Wenck Associates' Letter of Engagement for professional engineering services. Voting Aye: Guenthner, Thomas, Milbrandt, Hudok and Gmach (Motion Carried 5:0). 9e. City Administrator Status Report MOTION by Thomas, seconded by Hudok, to authorize the hiring of Dan Donahue effective immediately. Contract to be negotiated at a later time. Voting Aye: Thomas, Gmach, Hudok, Guenthner and Milbrandt. (Motion Carried 5:0) 9f. Approve Tom Cossette to the Technical Advisory Committee of the Elm Creek Watershed MOTION by Thomas, seconded by Milbrandt to approve the appointment of Tom Cossette to the Technical Advisory Committee of the Elm Creek Watershed. Voting Aye: Guenthner, Thomas, Milbrandt, Hudok and Gmach (Motion Carried 5:0). 9g. Pat Meister, Public Works Superintendent Pat Meister provided a report along with a Power Point presentation summarizing his department's work flow. Council added significant discussion on working towards a. comprehensive departmental strategic plan. 9h. Joe Rhein of Bonestroo — LSWMP Update Joe Rhein of Bonestroo provided the City with an update about the Local Storm Water Management Program. Council expressed concern about the I Iustad property and wanted the LSWMP modified to include the discrepancy between Maple Grove and Corcoran be resolved before its approval with the Elm Creek Watershed. 9i. Quarterly Report. A quarterly report was provided in the Council packet. It was suggested that this be a formal agenda item to review the performance -to -date. Council and Staff to prepare for a question and answer session. 10. PLANNING BUSINESS. 10a. UCOG Grant. Councilor Milbrandt has started working on a UGOG draft grant. It is due April 30 "'. Council to provide grant ideas to Milbrandt the Tuesday beforehand. 11. NEW BUSINESS There was no new business. 12. COUNCIL AND STAFF REPORTS 12a. March 11, 2009 Northwest Hennepin Human Services Council Board Minutes were provided. March 31, 2009 Draft Parks and Trails Minutes were recognized. 12c. 2030 Comprehensive Plan Update Future Meeting Schedule was provided. 12. d. April 21, 2009 Parks and Trails Commission Liaison Report — Chris Hudok Council member Iludok presented the following to Council from the April 21, 2009 Parks and Trails Commission meeting: • Comp Plan Planter Tina Goodroad provided a parks and trails map /chapter comp plan update • Parks and Trails Commission Member Cossette presented a wildlife preserve north of City Hall on a Schutte property. • Ball field lease agreement group usage discussion • Memorial Park is on hold until the Geothermal issue is resolved. 12e. May 14 City Council Agenda Item Update. The following May 14, 2009 City Council Agenda items were presented as follows: • Jeff Johnson, Hennepin County Commissioner "meet and greet" • Shannon Lane Update • Tree Ordinance • Charter Commission Status Report • Carson, Clelland & Schreder engagement letter • Budget Workshop • Code Enforcement Discussion 12f. Bonestroo Transition Letter was provided by Bonestoo prior to their departure. 12g. County Road Street Lights. 'fhe question of whether or not the street lights can be re- installed is on hold until after the County Engineer gets back from vacation. 12h. The Police Union Agreement is tentatively scheduled to come forward for review and possible approval at the May 14"' City Council meeting. 12. UNSCHEDULED ITEMS — None 13.
