HomeMy WebLinkAboutResolution 2004-98 - Approving Findings of Fact for Rezoning For Property Located at 22600 Hwy 55 City of Corcoran County of Hennepin State of Minnesota CITY OF CORCORAN RESOLUTION 2004-98 MOTION BY: Thomas SECONDED BY: Lymangood APPROVING FINDINGS OF FACT FOR REZONING FOR PROPERTY LOCATED AT 22600 HIGHWAY 55 WHEREAS, the City of Corcoran is requesting a change to the zoning designation of the approximately 10-acre portion on the north side of the site from R-2 (Single and Two Family Residential) to BP (Business Park), with respect to the 46-acre property, legally described as follows: That part of the Southwest Quarter of the Southeast Quarter of Section 32, Township 119 North, Range 23, Hennepin County Minnesota, lying West of the East 847.08 feet thereof, Except that part thereof taken for highway. Also, that part of the Southeast Quarter of the Southwest Quarter of said Section 32 described as follows: Commencing at a point of the West line of said Southeast Quarter of the Southwest Quarter a distance of 455.00 feet South of the Northwest comer thereof, thence East parallel with the North line of said Southeast Quarter of the Southwest Quarter a distance of 240.00 feet; thence on a tangential curve to the left having a radius of 111.96 feet (delta angle of 30 degrees 00 minutes) a distance of 58.62 feet; thence on a tangential curve to the right having a radius of 111.96 feet (delta angle of 30 degrees 00 minutes) a distance of 58.62 feet; thence East tangent to said curve a distance of 265.00 feet to the actual point of beginning of the tract of land to be herein described: thence North parallel with said West line a distance of 30.00 feet; thence East parallel with said North line 253.04 feet, more or less, to a line drawn parallel with and distant 1155.00 feet East of said West line; thence North parallel with said West line 365.00 feet to said North line; thence East along said North line a distance of 172.55 feet, more or less, to the Northeast corner of said Southeast Quarter of the Southwest Quarter, thence South along the East line thereof to the Southeast corner of said Southeast Quarter of the Southwest Quarter, thence West along the South line thereof to a line drawn parallel with said West line from the actual point of beginning; thence North parallel with said West line to the actual point of beginning; EXCEPT that part of thereof lying within a radius of 60.00 feet of the actual point of beginning. ALSO The East 847.08 feet of the Southwest Quarter of the Southeast Quarter of Section 32, Township 119, Range 23, except the East 220 feet of the South 535 feet thereof, also except that part taken for State Highway Number 55. WHEREAS, the Planning Commission has reviewed the rezoning at a duly called Public Hearing and recommends approval, and; WHEREAS, the City Council has adopted an ordinance reguiding the affected parcel from Urban Residential to Business Park/Light Industrial; WHEREAS, the City Council as adopted an ordinance rezoning the affected parcel from R-2 to BP, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request for a rezoning from R-2 to BP for the above referenced parcel, based on the following findings: 1. The proposed rezoning is consistent with the Comprehensive Plan, if amended, and other City policies and plans. 2. The development would allow an industrial business park, which is consistent with the Comprehensive Plan. 3. The Business Park zoning will allow for a more efficient approach to land use within the City. 4. There is adequate infrastructure planned to support the proposed rezoning and development. 5. Surrounding land uses are either compatible or will be buffered adequately. 6. Approval of the amendment would have no negative fiscal impact upon the City.
