HomeMy WebLinkAboutResolution 2004-94 - Approving a Site Plan Amendment and CUP for Rush Creek Golf Club Located at 7995 Maple Hill Road w CITY OF CORCORAN RESOLUTION 2004- 94 Motion By: Gaqeby Seconded By: Bucher A RESOLUTION TO APPROVE A SITE PLAN AMENDMENT AND CONDITIONAL USE PERMIT FOR RUSH CREEK GOLF CLUB LOCATED AT 7995 MAPLE HILL ROAD WHEREAS, the applicant, Rush Creek Golf Club, has requested approval of a site plan amendment and conditional use permit to allow a 1,800-square foot accessory building on the property legally described as follows: PARCEL A: (Torrens Certificate Number: 808112) The Southeast Quarter of Section 24, Township 119, Range 23, except that part thereof embraced within the plat of Maple Hill Estates and except that part lying southerly of the plat of Maple Hill Estates and westerly of the extension Southerly of the Easterly line of Lots 1 and 2, Block 2, said Maple Hills Estates and except Tract A, Registered Land Survey No. 1621 and except Lots 1, 2, 3, 4, Block 1 and Outlot A, Petersens Oak Hill Addition, Hennepin County, Minnesota. PARCEL B: (Abstract) The Southwest Quarter of Section 19, Township 119 North, Range 22 West, Hennepin County, Minnesota, except the East 1000 feet of the North 261 feet thereof, also except: That part of the East Half of the Southwest Quarter of Section 19, Township 119, Range 22, Hennepin County, Minnesota, described as follows: beginning at the southeast corner of the east 1000.00 feet of the north 261.00 feet of the Northeast Quarter of the Southwest Quarter of said Section 19; thence South 88 degrees 07 minutes 13 seconds West, assumed bearing, 1000.54 feet along the south line of said north 261.00 feet of the east 1000.00 feet to the southwest corner thereof; thence South 18 degrees 17 minutes 19 seconds East 758.63; thence South 25 degrees 51 minutes 53 seconds East 608.89 feet; thence North 88 degrees 07 minutes 13 seconds East 496.63 feet to a point on the east line of said Southwest Quarter of Section 19; thence North 00 degrees 00 minutes 00 seconds East 1284.73 feet along said east line to the point of beginning. Except that part of the East Half of the Southwest Quarter of Section 19, Township 119, Range 22, Hennepin County, Minnesota, described as follows: Commencing at the northeast corner of said East Half of the Southwest Quarter; thence on an assumed bearing of South 0 degrees 00 minutes 21 seconds West, along the east line of said East Half of the Southwest Quarter, a distance of 593.84 feet, to the point of beginning of the property to be described; thence North 89 degrees 59 minutes 39 seconds West a distance of 758.00 feet; thence South 0 degrees 00 minutes 21 seconds West a distance of 211.16 feet; thence South 30 degrees 26 minutes 02 seconds East a distance of 562.54 feet; thence South 89 degrees 59 minutes 39 seconds East a distance of 473.00 feet, to the east line of said East half of the Southwest Quarter; thence North 0 degrees 00 minutes 21 seconds East along said east line a distance of 696.16 feet to the point of beginning. WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request by Rush Creek Golf Club for a site plan amendment and conditional use permit, subject to the following findings and conditions: 1. The site plan amendment and conditional use permit are approved in accordance with the plans received by the City on September 27, 2004, October 14, 2004 and November 10, 2004, except as amended herein. 2. A conditional use permit is approved to allow a 1,800-square foot accessory building, based on the finding that the use complies with all applicable conditional use permit standards. 3. A conditional use permit is granted to allow metal building siding and an asphalt shingle roof on the new accessory building based on the following findings: a. The proposed metal building with asphalt shingles would maintain the quality, durability and value intended by the ordinance. b. The proposed structure is compatible and in harmony with other existing structures within the immediate geographic area. The proposed building is consistent with the existing maintenance building. k„ Resolution 2004- Page 3 c. The existing maintenance building would screen the proposed building from adjacent land uses. d. The proposed maintenance building would be consistent with the conditional use permit standards in Section 1070.020 of the Zoning Ordinance. 4. The development shall comply with the existing P-I district standards. No variances are granted or implied. 5. A building permit is required prior to construction of the new accessory building. 6. The applicant must comply with the requirements of Section 1060.040 of the Zoning Ordinance (Lighting), including fixture cutoff requirements. Light fixture details must be provided for staff review and approval prior to issuance of building permits. ADOPTED by the City Council this 23rd day of November 2004.
