RESOLUTION 2004-69

APPROVING VARIANCE FOR KEN DOBOSZENSKI ON PROPERTY LOCATED AT
6430 PIONEER TRAIL.
WHEREAS, Ken Doboszenski has requested approval of a variance from the front yard
setback requirements for the 2-acre property legally described as follows:
Lot 3, Block 1 , Doboszenski Addition
WHEREAS, the Planning Commission has reviewed the above listed variances at a
duly called Public Meeting, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the
request by Ken Doboszenski for a front yard setback variance subject to the following
conditions:
1. The variance from the front yard setback standards is approved in accordance with
the revised plans and application received by the City on July 19, 2004, based on
the finding that the variance standards have been met. Specifically:
a. There are unique circumstances affecting this property that would cause undue
hardship for the applicant. The triangular shape of the lot, steep slope, existing
structures and wooded areas limit the buildable area on the site.
b. There are conditions unique to the parcel of land for which the variance is sought
and are not applicable to other property within the same zoning classification.
c. The variance is not detrimental to the public welfare or injurious to other land or
improvements in the neighborhood as the location of the proposed home would
improve the existing non-conformity.
d. The variance will not impair an adequate supply of light and air to adjacent
property, or substantially increase the congestion of the public street, or increase
the danger of fire, or endanger the public safety, or substantially diminish or
impair property values within the neighborhood.
2. The applicant must provide detailed architectural plans, which identify building
materials, for City review and approval prior to issuance of a building permit.
