HomeMy WebLinkAboutResolution 2004-57 - Denying Variances for Ernie Mayoers, Property Located at 21000 Larking Road State of Minnesota County of Hennepin City of Corcoran CITY OF CORCORAN RESOLUTION 2004-57 MOTION by BUCHER SECONDED by GAGEBY DENYING VARIANCES FOR ERNIE MAYERS, PROPERTY LOCATED AT 21000 LARKIN ROAD. WHEREAS, Ernie Mayers has requested approval of variances from: building size, side yard setback, side wall height, overhang and architectural standards on a 2.5-acre property legally described as follows: That part of the South % of the Northeast ■ of Section 27, Township 119, Range 23 West, Hennepin County, Minnesota, described as Commencing at the Southwest corner of said South Y2 of the Northeast Y, of Section 17; thence East along the South line of said South Y2 of the Northeast XI a distance of 926.75 feet to the actual point of beginning of the land to be described; thence North at a right angle 370.00 feet; thence East at a right angle 300.50 feet; thence South at a right angle 370.00 feet to the South line of said South Y2 of the Northeast Y; thence West along said South line 300.50 feet to the point of beginning. WHEREAS, the Planning Commission has reviewed the above listed variances at a duly called Public Meeting and recommends denial, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does deny the request by Ernie Mayers for the above listed variances based upon the following findings: 1. There are no unique circumstances affecting this property that would cause an undue hardship for the applicant. 2. There are no particular physical surroundings, shape or topographical conditions of the specific parcel of land involved, which would create a particular hardship to the owner would result, as distinguished from a mere inconvenience, if the strict letter of the regulations were to be carried out. 3. The conditions upon which the variation is based are not unique to the parcel of land for which the variance is sought. A number of other properties in Corcoran have farmsteads that have been separated from the existing farms, which would be subject to the same standards. Resolution 2004-57 Page 2 4. The applicant has provided no information to identify a hardship if these requirements were required to be met. ADOPTED by the City Council this 22nd day of July 2004.
