HomeMy WebLinkAboutResolution 2004-55a- Approving Preliminary Plat for "Arens Norling Addition" on Property Located at 6701 Pioneer Trail .► • State of Minnesota County of Hennepin City of Corcoran CITY OF CORCORAN RESOLUTION 2004-55a MOTION by BUCHER SECONDED by LYMANGOOD APPROVING PRELIMINARY PLAT FOR ROBB NORLING AND THOMAS ARENS FOR "ARENS NORLING ADDITION" ON PROPERTY LOCATED AT 6701 PIONEER TRAIL WHEREAS, Robb Norling and Thomas Arens have requested approval of a preliminary plat to create two lots and one outlot on the 52.59-acre property legally described as follows: That part of the west 932.25 feet of the east 1864.5 feet of the Northeast Quarter of Section 31 , Township 119, Range 23 which lies northerly of the northerly line of Pioneer Trail. Except that part described as commencing at the southeast corner of said Northeast Quarter; thence westerly along the southerly line thereof to the east line of said westerly 932.25 feet; thence northerly along said east line 396.57 to the point of beginning; thence continuing northerly along said easterly line 450.00 feet; thence westerly at right angles to said easterly line 300.00 feet; thence southerly to the center line of Pioneer Trail; thence southeasterly along said centerline to the point of beginning. That part of the west 932.25 feet of the east 1864.5 feet of the Northeast Quarter of Section 31, Township 119, Range 23 described as beginning at the southwest corner of said west 932.25 feet; thence northerly along the westerly line thereof to a point 200.00 feet southerly of the southerly line of Pioneer Trail; thence easterly at right angles to said westerly line 160.00 feet; thence northerly parallel with said westerly line to the southerly line of said Pioneer Trail; thence southeasterly along said southerly line to the east line of said west 932.35 feet; thence southerly along said easterly line to the southerly line of said Northeast Quarter; thence westerly along said southerly line to the point of beginning. That part of the Northeast Quarter of Section 31, Township 119, Range 23 described as beginning at the intersection of the southerly line of Pioneer Trail and the west line of the east 1864.50 feet thereof; thence southerly along said westerly line 200.00 feet; thence easterly at right angles to said westerly line 160.00 feet; thence northerly parallel with said westerly line to the southerly line of said Pioneer Trail; thence northwesterly along said southerly line to the point of beginning. } 1 Resolution 2004-55a Page 2 WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request by Robb Norling and Thomas Arens for a preliminary plat, subject to the following conditions: 1. A preliminary plat is approved to allow the creation of two lots and one outlot in accordance with the plans and application received by the City on June 2, 2004, except as amended by this resolution. 2. A 10-foot drainage and utility easement must be provided adjacent to Pioneer Trail. 3. A 10-foot wide trail easement over the drainage and utility easement must be dedicated to the City and the documents must be filed with the final plat. 4. The park dedication fee for one new lot must be paid prior to release of the final plat. 5. The lot size tabulation on the preliminary plat must be corrected to reflect 2 lots and one outlot, as well as their proper sizes, as drawn on the plat. 6. The proposed driveway shall be shown on the plat. 7. One overstory tree shall be provided for the new home. 8. Lot 1 , Block 2 is located within the MUSA. The existing septic system on the farmstead must be maintained in accordance with City and State requirements until sanitary sewer is extended to serve this property. 9. Outlot A and Lot 1 , Block 2 will continue to be farmed and, therefore, shall be exempt from the wetland buffer requirements. When development occurs, the site shall be subject to the wetland buffer and setback requirements in place at that time. 10. The applicant must comply with all conditions in the City Engineer's memo. Resolution 2004-55b Page 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request by Robb Norling and Thomas Arens for a final plat, subject to the following conditions: 1 . A final plat is approved to allow the creation of two lots and one outlot in accordance with the plans and application received by the City on June 2, 2004, except as amended by this resolution. 2. All conditions of preliminary plat approval must be met. 3. The Building Inspector must approve the soil percolation tests and septic system designs prior issuance of building permits. A primary and secondary septic site must be staked and fenced prior to beginning any construction on site. 4. Elm Creek Watershed District approval must be obtained prior to final plat approval. The applicant shall be subject to any conditions. 5. The final plat must be filed by the applicant at Hennepin County. 6. Final plat approval shall expire two years from the date of approval unless the plat has been filed at Hennepin County. 7. The applicant shall submit electronic files of the plat in a manner as required by the City Engineer. ADOPTED by the City Council this 22nd day of July 2004.
