WHEREAS, David Bakke has requested a conditional use permit to exceed the maximum size and maximum sidewall height for detached accessory structures on the parcel legally described as follows: That part of the west half of the northwest quarter of Section 18, Township 119, Range 23, Hennepin County, Minnesota, lying easterly of the following described line: Commencing at the northeast corner of the said west half of the northwest quarter; thence west, along the north line of said west half of the northwest quarter, a distance of 655 feet to the point of beginning of the line being described; thence deflecting left 89 degrees 05 minutes to the south line of the north 1038.13 feet of said west half of the northwest quarter; thence west along said south line of the north 1038.13 feet of said west half of the northwest quarter, a distance of 30 feet; thence south, to appoint on the south line of said west half of the northwest quarter distant 691.08 feet west of the southeast corner of said west half of the northwest quarter and there terminating. EXCEPTING therefrom the north 1038.13 feet thereof lying easterly of the following described line: Commencing at the northeast corner of the said west half of the northwest quarter; thence west along the north line of said west half of the northwest quarter; a distance of 625 feet to the point of beginning of the line being described; thence deflecting left 89 degrees 05 minutes to the south line of the north 1038.13 feet of said west half of the northwest quarter and there terminating, according to the United States Government Survey thereof and situate in Hennepin County, Minnesota. Together with a 30-foot easement for ingress, egress and driveway purposes over that part of the west half of the northwest quarter of Section 18, Township 119, Range 23, Hennepin County, Minnesota, lying 15 feet on both sides of the following described centerline: Resolution 2004-37 Page 2 Commencing at the northeast corner of said west half of the northwest quarter; thence west along the north line of said west half of the northwest quarter, a distance of 670 feet to the point of beginning of the centerline being described; thence deflecting left 89 degrees 05 minutes to the south line of the north 1038.13 feet of said west half of the northwest quarter, and said centerline there terminating. WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request by David Bakke for a conditional use permit, subject to the following findings and conditions: 1. The conditional use permit is approved in accordance with the plans and application received by the City on April 21, 2004, except as amended herein. 2. The development shall comply with the RR district standards. 3. The applicant must revise the plans to identify the sidewall height. 4. The applicant must provide information about the proposed roof colors and materials for City review and approval. 5. The landowner shall comply with the Wetland Conservation Act. 6. Approval is subject to Elm Creek Watershed District review of the drainage plan and any conditions. 7. The accessory buildings may not be used as living space. 8. The buildings shall be used only for personal or agricultural use. No commercial use of the buildings on the property shall be allowed.
