HomeMy WebLinkAboutResolution 2004-35 - Request of Corcoran United Taxpayers RESOLUTION NO. 2004-35 Member Gageby introduced the following Resolution and moved its adoption: RESOLUTION RELATING TO THE REQUEST OF CORCORAN UNITED TAXPAYERS WHEREAS, a citizens committee of Corcoran United Taxpayers(CUT) presented a Petition to Amend Charter to the Charter Commission in April, 2004; that this matter was considered by the Charter Commission at its regular meeting of April 12th, 2004; and WHEREAS, that no member of CUT or the citizens committee appeared at the April 12th Charter Commission meeting and the Petition was returned to the committee members with explanation as to its deficiencies; that the subject matter was placed on the Charter Commission agenda for June 21st, 2004; and WHEREAS, members of CUT approached the city council directly and asked that the matter be considered by the city; that the subject was placed on the city council agenda for May 13th, 2004; and WHEREAS, at the May 13th council meeting, the city council considered this matter and they were advised by counsel (including special bond counsel) as follows: 1. That seeking voter approval for all forms of bonding (borrowing) as presented by the petitioners conflicts with state law; that the bonding statutes in Minnesota have preempted this subject and therefore the charter cannot direct actions in conflict with state statute. 2. That the subjects of comprehensive planning and zoning are preempted by state law; that these subjects have become a matter of statewide concern for the sake of uniformity and therefore the charter cannot conflict with state laws regulating comprehensive planning and zoning. NOW, THEREFORE, THE CORCORAN CITY COUNCIL RESOLVES: 1. The request by CUT to submit the proposed charter amendments to the voters is denied. AI Dated: May 13 , 2004. ' Ken Guenthner, Mayor ATTEST.. .
