A RESOLUTION TO DENY AN EXEMPTION FROM THE MORATORIUM
TO ALLOW SUBMITTAL OF APPLICATIONS FOR DEVELOPMENT OF A
SPLATBALL FIELD ON PROPERTY OWNED BY MAMA G'S PROPERTIES,
LLC LOCATED AT 9705 HIGHWAY 101
WHEREAS, the applicant, Mama G's Properties LLC. has requested an
exemption from Ordinance No. 176 Declaring a Moratorium on Subdivision or
Development within the City in order to proceed with a site plan amendment,
interim use permit and other necessary applications for a splatball field with
shared parking; and
WHEREAS, the Corcoran Planning Commission has reviewed this application for
an exemption from the moratorium on March 4, 2004,
WHEREAS, the Corcoran City Council reviewed this item at their meeting on
March 25, 2004; and
NOW THEREFORE BE IT RESOLVED that the Corcoran City Council denies
the moratorium exemption based on the following findings:
1 . The existing zoning and subdivision ordinances will not adequately protect
the property.
2. The proposed use is not consistent with the City's Comprehensive Plan.
3. The use is not consistent with the purpose of the zoning regulations.
4. The proposed use would be premature prior to the necessary roadway
improvements and extension of municipal sewer and water.
