NOW,THEREFORE BE IT RESOLVED by the City of Corcoran that the Mayor and City Administrator are hereby authorized to enter into a contract as presented for animal control/impounding with the City of Corcoran. • Moved by member Ron Thomas, seconded by member John Bucher. • The following voted in favor of said resolution: Guenthner,Thomas, Bucher, and Lindsley. • The following voted against the same:None. • The following was absent: Gmach. • Whereupon said Resolution was declared carried. • Dated this 13th day of July,2000. /s/Kenneth S. Guenthner ATTEST: AlUA d6eil City Administrator Roberta Colotti 1 Agreement of Understanding On this 5`i' day of July, 2000, the City of Monticello, Minnesota, hereinafter referred to as the City, and the City of Corcoran, hereinafter referred to as the client, so hereby agree as follows: 1. The city, upon reasonable request from the client, shall open the Animal Impound Facility for the delivery and intake of stray, unwanted, or loose animals in the custody of the client. The client shall provide the City with all pertinent information known about animals delivered including, but not limited to, attacks on humans, ownership, veterinary medical history, deposition and any information known by the client that affects the public health and safety. 2. The city shall provide shelter, care, and feeding for the animals while impounded. 3. The client shall pay to the City a fee of$10.00 per day for impoundment. State statue requires the holding of strays for 5 business days, Saturday and Sunday are not considered a business day. 4. The city shall, upon completion of the required impoundment duration, deliver the animal to a qualified professional for humane disposal (euthanasia), or adopt the animal through the Humane Society, or private adoption. 5. The client shall reimburse the City $29.00 for any type of disposal of an animal, including euthanasia, private adoption, or Humane Society adoption. 6. The City shall prepare and issue monthly an itemized statement of charges showing dates, length of impoundment, disposal, and when possible, the name of the owner of the animal. 7. The City shall hold the client harmless for any damage to the impound facility caused by any animal and arising out of the City's negligence. The City shall hold the client harmless for any injury to and/or damage to the possessions of the City Animal Control Officer arising out of the City's negligence while the animal is impounded or otherwise under the responsibility of the City. 9. The City shall hold the client harmless against all claims of maltreatment, negligence, and/or wrongful death of any animal arising out to the City's negligence while the animal is impounded or otherwise under the responsibility of the City. 10. Either party, upon 30 day written notice to the other party, may discontinue this agreement. The shelter was built in 1998 and serves 15 different communities Enclosed you will find a copy of our impound services agreement. If a stray animal was brought into our impound facility, we would hold the animal for the required 5 business days. If an owner were found, they would pay for all fees before the animal would be released. The City would not be billed for that animal. If there is no owner at the end of the impound period, the City would be billed. I have enclosed a sample of an impound/billing report for you to see. We are able to adopt out many of the animals that are not claimed. Our shelter works closely with several animal rescue groups to find homes for adaptable animals. We euthanize those that have health or temperament problems. If you would like to arrange for an animal control officer to pick up the animals, the charge would be 30.00 per call. Otherwise we could issue a key to the proper authority in your City and they could bring the animals over. If able, residents themselves could transport animals to the shelter. It works well to have a City Official or the Sheriff's Department authorize animals to be brought into the shelter. This helps to ensure that only animals from you area are being billed to you. We are able to work with any guidelines that you wish to set up. Please review the enclosed contract. If you wish to sign up for our services, you can sign the agreement, and return it to the address on the bottom of the contract. I will mail you a second signed copy for your records.
