RESOLUTION NO. U00-1 A-
A RESOLUTION ORDERING THE ABATEMENT OF NUISANCES
AT 10290 BECHTOLD ROAD, CORCORAN, MINNESOTA
WHEREAS,the Corcoran City Council has received complaints that the property at 10290
Bechtold Road,owned by Hubert G.Theis,has accumulations of junk,rubbish, garbage and debris
in violation of the Corcoran Nuisance Code, Section 28.03; and
WHEREAS, the Corcoran Police Department and the Hennepin County Animal Humane
Officer have inspected the above property and found, in addition to the above-referenced nuisance
violations,numerous farm birds and small animals in poor health and in a neglected state,conditions
amounting to cruelty and neglect of animals; that these animals have access to the road and have
been struck by motor vehicles and said officers observed animals that have been injured and killed
by traffic; further, said officers observed animals on the above property to be sick and dying; and
WHEREAS, inspections of this property were made on 7-24-99, 4-21-00 and 6-06-00, and
Mr. Theis has been given written direction to correct the above-described nuisance and animal
neglect problems; that Mr. Theis has failed and refused to comply with the lawful orders of the
Corcoran Police Department.
NOW, THEREFORE, be it resolved by the Corcoran City Council:
1. That a Compliance Order shall be issued to Mr. Hubert G. Theis, owner of the
property located at 10290 Bechtold Road,Corcoran, Minnesota giving him 30 days
after service of said Compliance Order, by registered mail or personal service, to
abate said nuisances and Code violations.
2. That if the nuisances and Code violations are not abated within a 30 day period, and
if Mr.Theis has not made formal appeal to the City Council within that same 30 day
period, the City officials are hereby ordered to abate the nuisances at City expense,
further, the City Clerk/Treasurer is ordered to collect all expenses and costs
associated with said abatement and to certify said costs and expenses to the Hennepin
County Auditor for collection as a special tax against the property in accordance with
Section 28.09 of the Corcoran City Code.
3. That issues relating to the current neglect and cruelty of live animals shall
immediately be referred to the Hennepin County Humane Society for immediate
action.

YOU ARE HEREBY ORDERED to abate the nuisance(s) on your property located at
10290 Bechtold Road, Corcoran, Hennepin County, Minnesota.
Said abatement must be completed within 30 days of receipt of this Order,by registered mail
or personal service.
Failing compliance, or formal appeal of this Order within 30 days, the City shall abate the
nuisance(s) and assess all costs and expenses to the property for collection through the Hennepin
County Auditor.
