HomeMy WebLinkAboutResolution 2004-07 - Preliminary Plat - Kuehn A DOCUMENT 1- , ,,, City of Corcoran County of Hennepin State of Minnesota RESOLUTION NO. 2004-07 Motion By: THOMAS Seconded By: BUCHER APPROVING PRELIMINARY PLAT FOR TERRY KUEHN FOR "KUEHN FARM" ON PROPERTY LOCATED AT THE SOUTHWEST QUADRANT OF STREHLER ROAD AND COUNTY ROAD 19 WHEREAS, Terry Kuehn has requested approval of a preliminary plat to allow the creation of two lots on the 15-acre property legally described as follows: The north 495.00 feet of the northeast quarter of the northwest quarter of Section 19, Township 119 North, Range 23 West of the 5th Principal Meridian, Hennepin County, Minnesota. WHEREAS, the City Council reviewed the sketch plan for this property on November 13, 2003 and found that the 2 building rights were available to this landowner, WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request by Terry Kuehn for a preliminary plat, subject to the following conditions: 1 . A preliminary plat is approved to allow the creation of 2 lots, in accordance with the plans and application received by the City on December 8, 2003 and revision received on January 12, 2004, except as amended by this resolution. 2. Park Dedication shall be land dedication of a 30-foot trail easement adjacent to the wetland in the northwest corner of the site. The easement must be located a minimum of 10 feet from the wetland edge. The applicant must submit a copy of the easement location for City review and approval. This dedication will fulfill the City's park dedication requirements. 3. The applicant shall dedicate additional right-of-way for County Road 19 as required by Hennepin County, which requires approximately 57 feet from centerline on the north and 69 feet from centerline on the south end of the property line. Resolution 2004-07 Page 2 4. The applicant shall dedicate right-of-way for Strehler Road to the City of Corcoran 40 feet from the centerline. This right-of-way will be adequate to accommodate a future trail within the right-of-way. 5. Access to both lots shall be from Strehler Road. 6. The property may be subject to assessments if Strehler Road is improved in the future. 7. The existing field access on County Road 19 shall be removed when County Road 19 is improved. 8. The applicant must identify the locations for the well, a primary and secondary septic system for each lot and the house location on the new lot. 9. The Building Inspector must approve the soil percolation tests and septic system designs prior approval of the final plat. Septic sites must be staked prior to beginning any construction on site. 10. The existing septic system must be in compliance with Rule 7080 and City standards and must be inspected by the building inspector. 11 . All drainage and utility easements must be staked, surveyed and properly recorded prior to beginning any work on site. 12. The drainage easement shall encompass all of the floodplain area up to the 1004.25 elevation. 13. The landowner shall comply with the Wetland Conservation Act. 14. The applicant must provide a copy of the wetland delineation report for City review prior to final plat application. 15. No wetland impact is approved. The plantings and other impacts should be located to avoid impacts. 16. Best Management Practices (BMPs) for erosion control shall be employed. 17. Approval is subject to Elm Creek Watershed District review of the drainage plan and any conditions. Resolution 2004-07 Page 3 18. The applicant shall comply with all City requirements as noted in the comments from the City Engineer. 19. The application for final plat must be submitted to the City within 100 days of preliminary plat approval or the preliminary plat shall be considered void, unless a written request for time extension is submitted by the applicant and approved by the City Council. 20. Two building rights are granted to this landowner based on the finding that unique circumstances affect this property. Specifically: a. The applicant is in possession of a letter from the City of Corcoran dated May 25, 2001, which states that the subject property has two building rights b. The property abuts a paved road (County Road 19), but has been prohibited access by Hennepin County. c. The property has an existing field access onto County Road 19 that could be used for a new home access, but Hennepin County has indicated that this access will be closed when County Road 19 is upgraded and no access will be provided. d. The City Council finds that allowing this landowner to plat the property will allow a unique opportunity for the City and County to acquire the right-of-way and easements needed for road improvements and public trails. e. The City Council finds that the unique circumstances of this plat would not set a precedent for other properties. ADOPTED by the City Council this 26th day of February 2004.
