A RESOLUTION FOR CONDITIONAL USE PERMIT
TO ALLOW A TENNIS COURT TO BE CONSTRUCTED IN THE
FLOODPLAIN AND DRAINAGE AND UTILITY EASEMENT, ON PROPERTY
LOCATED AT 19725 SCHUTTE FARM ROAD.
WHEREAS, Jim Welch, buyer of the property located at 19725 Schutte Farm
Road, City of Corcoran, has requested permission to construct a tennis court located in
the flood plain and drainage and utility easement; and
WHEREAS, The Corcoran Planning Commission held a public hearing on May 4,
2000 and no one spoke; and
WHEREAS, The Corcoran City Council considered the application information
and recommendation of the Planning Commission.
NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of Corcoran
finds the following:
FINDINGS OF FACT
1. The applicant is aware of the risks of constructing improvements in a
flood plain and drainage and utility easement.
2. The applicant holds the City harmless for damage that may occur to the
tennis court due to flooding.
3. The tennis court will not impede drainage.
Based on the above findings, the Corcoran City Council hereby issues a Conditional Use
Permit to allow the construction of a tennis court, located at 19725 Schutte Farm Road,
City of Corcoran; PID # 13-119-23-23-0005 and legally described as Lot 1, Block 1,
Acacia Hills, all in Section 13, Township 119, Range 23, Hennepin County, Minnesota;
subject to the following conditions:
1. The City Engineer shall inspect the site following construction for
conformance to the plans.
2. The Elm Creek Water Management Commission shall review and approve
the plan.
Moved by Councilor Bucher seconded by Councilor Lindsley.
The following voted in favor of said resolution: Guenthner, Gmach, Bucher, Lindsley
The following voted against the same: none
Whereupon said Resolution was declared carried.
