City Administrator's Notes for Corcoran Parks and Trails Commission Meeting of March 20, 2012 Note: The Commission will gather at the Park Building off of County Road 50 at 6:30 pm to tour the building and indoor restroom. 6. Old /Unfinished Business a. Hennepin County Youth Sports Grant Update i. Equipment Grant. The agreement is on the Council agenda for March 22 °d. In your packet are the grant application and the grant agreement. The implementation of the grant should be discussed with the PW Superintendent at the meeting. ii. Sports Grant. Update. There is a meeting scheduled for Wednesday, March 21St at 7:30 am with the Rockford School Superintendent, the mayor, Chad Robran, and myself to discuss this grant application later this year and other issues about the park. Robran can discuss further at the meeting. b. 2012 Parks Work Plan- Superintendent Meister* i. Park CIP. In your packet is the project list from last year that the Commission reviewed. The discussion around the CIP is to finalize this years park projects. ii. Park Maintenance. This will also be a discussion on what actually will the city be doing this year regarding maintenance of all park properties iii. Memorial Park Maintenance. See above -who will undertake and be responsible for both general maintenance (i.e. grass cutting) and specialized maintenance and upkeep. iv. Tennis Court Agreement. The Agree's have asked to again rent the tennis courts for youth tennis lessons. Same program as in 2010 and 2011. c. Park Signs. In your packet are the sign estimate and a mock up of the three park signs. The council has approved the purchase of the signs. I am asking the Commission to approve the final design and wording for the signs. Pat Meister has been working with the Police Department and will come to the meeting with his recommendations. d. Update on New Commission Appointments. Nothing to report as no new applications have come in. We did send to the schools notice of the opening for student commissioners. 7. New Business a. Code Enforcement/Licensing Position at City. This is for information only. Ms Budzynski has resigned her position with the city. Staff efforts to maintain scheduling is going to be strained this coming year. I am actively recruiting a new person for the position. b. Annual Report. The commission should talk about the annual report to the city council on 2011 activities. Minutes Corcoran Parks and Trails Commission Tuesday, February 21, 2012 7:00 PM 3b. Present: Commissioners Kevin Dale, Chad Robran (7:15 pm), Trish Krueger, Val Nybo, Tom Anderson (7:20 pm), Rachael Tessmer Absent: None Others attending: Council Liaison Asleson, Ken Guenthner, City Administrator Donahue 1) Convene Regular Parks & Trails Commission Meeting — Chair Krueger called the meeting to order at 7:05 pm in the Corcoran Community Center 2) Pledge of Allegiance 3) Approval of a) Agenda. Add: i) 7£ Discussion on Student commissioners ii) 7g. Discussion about the use of Plymouth's Zamboni ice refinisher on our hockey rink. Motion by Nybo seconded by Dale to approve the agenda as presented with additions. Voting Aye: All (Motion carried 4:0) b) Minutes of 11/15/11 Meeting. Motion by Nybo, seconded by Dale to approve the 11/15/11 meeting minutes as presented. Voting aye: All (Motion carried 4:0) 4) Open Forum -None 5) Presentations -None. 6) Old Business a) Rush Creek Plat. The commissioners reviewed the Rush Creek Plate and the dedicated park easements. They had asked to see the actual filed plat to assure that the city did indeed have easement rights for park use. b) Hennepin Youth Sports Grant and Equipment Grant Update. Donahue and Robran explained the status of the two grant programs. Corcoran and the Rockford School district were not awarded the Sports grant but were awarded the $10,000 Equipment Grant. Donahue explained that the city has not received the paperwork from the Sports Commission so no action can be undertaken until the documents have been approved by the city council. Robran said he had been contacted by the sports Commission staffers and they urged the city to consider applying for additional Equipment grant funds for tennis, this will be looked into. Robran said that he is in contact with the Rockford School District and their efforts to again apply for the Sports Grant in 2012. Robran further said that there appears to be some changes in the grant proposals as Greenfield may no longer be interested in locating the varsity level baseball field in their city. Robran will keep abreast of the activities regarding the future grant application and assess the impact the grant might have on Corcoran. c) 2012 Parks Work Plan i) Park CIP Recommendations. Commissioners discussed on how to best make a recommendation to the city council on the plan discussed and developed at the October P & T Meeting. Commissioners had stated in their November 15, 2011 meeting any consideration of CIP recommendations should wait until after the status of the Hennepin Youth Sports Grant was known. The commissioners reviewed the CIP list they had on the Parks and Trails Commission Minutes, Feb. 21, 2012 November 15, 2011 agenda. They concluded the commission would recommend the following for 2012 in order of priority: (1) Playground mulch (2) Erect the three park entrance signs (3) Review existing and proposed park rest room facilities and use of portable biffs (4) Get serious about fixing and upgrading the park field lighting and the use of timers or other mechanisms to control the lights at night Motion: Robran and seconded by Tessmer to ask City Council to approve bid from Signs Now for $7,139.14 for the three park signs as detailed in their bid estimate of September 6, 2011. Voting aye: All (6:0). Donahue stated he would check with the company to determine if their bid is still current. ii) Park Maintenance. Park superintendent could not attend the meeting. The Commission had wanted to discuss this year's park maintenance plan. The superintendent will be at the March 20th P & T meeting. I � iii) Memorial Park Maintenance. Donahue asked the CommissionTo state their policy on how the Memorial Park in the back of City Hall was to be maintained and how such maintenance was to be financed. The Commission said that maintenance cost are to be covered by the Pat Puhle Fund and the Memorial Park Maintenance Fund [the two funds have a balance of $250.74 and $11,707.88 respective are not Park Dedication fees received in the past by the city] 7) New Business a) 2012 Fee Schedule. The 2012 Fee Schedule adopted by the city council was reviewed. Donahue explained that there are no changes to the previous 2011 fees as they pertain to park usage. b) Rugby Fee Request. Ken Guenthner requested that the Rugby Team, of which he coaches, be classified as a Group 1 (Corcoran youth team) instead as a Group 2 team which would mean they would be subject to fees. Guenthner stated that this team meets the criteria such as composed of many school age youth; the team is made up of many Corcoran residents, and is not a "for profit" team. The Commission was asked to agree that the team should be so classified. Guenthner said that the team was willing to make a donation to the city for the early spring use of the fields and/or provide volunteer service to park cleanup. Motion: Robran and seconded by Dale to classify the Rugby team as a Group 1 team and no fee for field use should be assessed but that the city would accept any donation of money or service the team was willing to make. All voted Aye (6:0) c) Team Scheduling. Donahue explained that the city staff did not have the ability due to limited resources to make changes in 2012 to the scheduling of the park fields. The city staff would handle as they have in previous years. Robran said that all youth field use should be handled through him. He would talk to the admin staff at city hall to work out the detail. Also, Dale asked that city staff check to make sure the Corcoran Athletic Association had a link to their web page and the field schedules on the city web page. d) Tree Give A Way. Anderson said he is again heading up the program and would be obtaining 400 trees again this years as he has done in the past using a donation from the Jaycees. The trees would not be given out at the scheduled May 12th City Cleanup day due to timing issues related to when he would have to get the trees. He will work with city staff to include an article in the City Newsletter. e) CDBG application and Maple Hills proposed community center. Donahue informed the Commission of the Community Development Block Grant (CDBG) application for $225,000 was approved by the city council for the development of about a 2,000 sq ft community center that (if approved) would be located in the Maple Hills Estate development. The Commission expressed approval of the application and said they supported. 2 Parks and Trails Commission Minutes, Feb. 21, 2012 f) Student Commissioners. The commissioners asked about the process to attract students to the commission. Donahue said that no students had applied to date. Robran suggested that the five high schools serving Corcoran youth are notified through their respective councilor offices of the opportunity to serve their community. Donahue will follow up with Robran. g) Zamboni. Donahue responded to information presented by Robran of the city's current use of a Plymouth owned Zamboni ice refinisher machine. The machine was being tried out by the Public Works Dept. to determine if this would be of benefit to the city. The commission would like more information at their next meeting when the PW Superintendent would be at the meeting. 8) Subcommittee and Miscellaneous Reports a) City Council Liaison Asleson updated the Commission on council activities including the i) Sewer and Water project and the review of the downtown option ii) The development and search for a Public Works site on which to build iii) The possible March 2, 2012 meeting of the downtown property owner on their interest in a sewer and water project. b) Corcoran Athletic Association. Dale updated the Commission on activities. He also talked about the recent Pancake Breakfast and thought this year's event was successful. c) Park Dedication Fund. This was reviewed. Discussion followed on the merits of combining the Pat Puhle Fund and the Memorial Maintenance Fund into one fund for the purpose of having resources to cover special maintenance on the park. It was noted that the bulk of the Pat Puhle fund ($645.10) had been spent on buying and installing a memorial as requested by the Puhle family. MEN&, Motion: Anderson and seconded by Dale to ask the council to combine the two funds. All voted in aye: (motion carried 6:0) 3 Contract No: A120212 AGREEMENT FOR CITY OF CORCORAN COMMUNITY PARK BATTING CAGES AND FIELD NETTING This Agreement is between the County of Hennepin, State of Minnesota ( "COUNTY "), A -2300 Government Center, Minneapolis, MN 55487, and City of Corcoran, 8200 County road 116, Corcoran, MN 55340 ( "LOCAL UNIT OF GOVERNMENT " or "LGU "). Recitals Minnesota Statutes Section 473.757, subd. 2 authorizes Hennepin County to make grants for youth activities and youth and amateur sports within Hennepin County from certain funds collected as part of the sales tax authorized in Section 473.757, subd. 10. Pursuant to Hennepin County Board Resolution 09- 0320R3, Hennepin County created the Hennepin Youth Sports Program. The Hennepin Youth Sports Program makes grants for youth sports and activities and amateur sports within Hennepin County. 3. In 2011, as part of the Hennepin Youth Sports Program, by Resolution No. 11- 0568R1, Hennepin County authorized an award of $8,000 to the LGU for the purchase of Batting Cages and Field Netting, as described in greater detail in the LGU's application ( "Equipment "). NOW, THEREFORE, the parties hereto do hereby agree as follows: The parties agree as follows: TERM AND COST OF THE AGREEMENT Pursuant to the terms herein and as reimbursement to the LGU for the LGU's purchase of the Equipment, COUNTY shall pay the LGU $8,000. 2. USE OF FUNDS The LGU shall use all funds received under this Agreement for the purchase of the Equipment in accordance with the application submitted by the LGU to the Minnesota Amateur Sports Commission. The application for the Equipment, dated October 13, 2011, is on file with Hennepin County and said application is incorporated into this Agreement by this reference. The LGU shall be solely responsible for securing all additional funds needed to complete the purchase of the Equipment. The LGU agrees that the Equipment will display a plaque, decal or sticker, as agreed to by the LGU and COUNTY, identifying that the Equipment was purchased with funds provided by the Hennepin Youth Sports Program. Upon the purchase and deployment of the Equipment, the LGU shall provide information, data, statistics and other metrics related to the Equipment, related projects, participants and /or related activities, including but not limited to usage numbers, who is using the Batting Cages and Fields, and what changes in usage were noted. This information shall be provided within one year of completion and on an annual basis for two years thereafter. PAYMENT FOR SERVICES The LGU shall provide an invoice for the LGU's actual cost of the Equipment. The invoice should include supporting documentation including but not limited to a receipt confirming the LGU's final, actual purchase of the Equipment, which receipt shall identify the seller, the date of sale, and confirm payment of the outstanding balance. Additionally, the LGU shall provide a duly signed certification confirming that the LGU is in possession of the Equipment and has deployed the same for use as indicated in the LGU's application. Said documentation shall be provided or before December 31, 2012. COUNTY shall not pay for Equipment (i) not supported by the necessary documentation; or (ii) for which the documentation is provided after said date. Payment shall be made directly to the LGU upon the presentation of the invoice in the manner provided by law governing the COUNTY'S payment of claims and/or invoices. Payment shall be made within forty -five (45) days from receipt of the invoice. NON - DISCRIMINATION In accordance with the COUNTY'S policies against discrimination, LGU agrees that it shall not exclude any person from full employment rights nor prohibit participation in or the benefits of, any program, service or activity on the grounds of race, color, creed, religion, age, sex, disability, marital status, sexual orientation, public assistance status, or national origin. No person who is protected by applicable Federal or State laws against discrimination shall be subjected to discrimination. INDEMNIFICATION LGU agrees to defend, indemnify, and hold harmless the COUNTY, its officials, officers, agents, volunteers and employees from any liability, claims, causes of action, judgments, damages, losses, costs, or expenses, including reasonable attorney's fees, resulting directly or indirectly from any act or omission of LGU, a subcontractor hired by the LGU, anyone directly or indirectly employed by them, and/or anyone for whose acts and /or omissions they may be liable in the performance of the services required by this Agreement, and against all loss by reason of the failure of LGU to perform any obligation under this Agreement. Nothing in this Agreement constitutes a waiver, by either party, of any statutory or common law defenses, immunities, or limits on liability. Neither party shall be required to pay to a third party, on behalf of themselves or the other party, any amounts in excess of the limits on liability established in Minnesota Statutes Chapter 466 applicable to any one party. The limits of liability for COUNTY and the LGU shall not be stacked or added together to determine the maximum amount of liability for either party. DATA PRACTICES Each party and their officers, agents, owners, partners, employees, volunteers and subcontractors shall abide by the provisions of the Minnesota Government Data Practices Act, Minnesota Statutes, Chapter 13 (MGDPA), the Health. Insurance Portability and Accountability Act and implementing regulations, if applicable, and all other applicable state and federal laws, rules, regulations and orders relating to data privacy or confidentiality. The terms of this section shall survive the cancellation or termination of this Agreement. RECORDS — AVAILABILITY /ACCESS Subject to the requirements of Minnesota Statutes Section 16C.05, Subd. 5, LGU agrees that the COUNTY, the State Auditor, the Legislative Auditor or any of their authorized representatives, at any time during normal business hours, and as often as they may reasonably deem necessary, shall have access to and the right to examine, audit, excerpt, and transcribe any books, documents, papers, records, etc., which are pertinent to the accounting practices and procedures of LGU and involve transactions relating to this Agreement. LGU shall maintain these materials and allow access during the period of this Agreement and for six (6) years after its termination or cancellation. 8. SUCCESSORS SUBCONTRACTING AND ASSIGNMENTS A. LGU binds itself, its partners, successors, assigns and legal representatives to the COUNTY for all covenants, agreements and obligations contained in the contract documents. B. LGU shall not subcontract, assign, transfer or pledge this Agreement or its obligations hereunder, whether in whole or in part, nor assign any monies due or to become due to it without the prior written consent of the COUNTY. A consent to assign shall be subject to such conditions and provisions as the COUNTY may deem necessary, accomplished by execution of a form prepared by the COUNTY and signed by LGU, the assignee and the COUNTY. Permission to assign, however, shall under no circumstances relieve LGU of its liabilities and obligations under the Agreement. 9. MERGER AND MODIFICATION A. It is understood and agreed that the entire Agreement between the parties is contained herein and that this Agreement supersedes all oral agreements and negotiations between the parties relating to the subject matter. The matters set forth in the Recitals provisions at the beginning of this Agreement are incorporated into and made a part of this Agreement. All items that are referenced or that are attached are incorporated and made a part of this Agreement. If there is any conflict between the terms of this Agreement and referenced or attached items, the terms of this Agreement shall prevail. B. Any alterations, variations, modifications, or waivers of provisions of this Agreement shall only be valid when they have been reduced to writing as an amendment to this Agreement signed by the parties. 10. DEFAULT AND CANCELLATION A. If LGU fails to perform any of the provisions of this Agreement or so fails to administer the work as to endanger the performance of the Agreement, it shall be in default. Unless LGU's default is excused by the COUNTY, the COUNTY may upon written notice immediately cancel this Agreement in its entirety. Additionally, failure to comply with the terms of this Agreement shall be just cause for the COUNTY to delay payment until LGU's compliance. In the event of a decision to withhold payment, the COUNTY shall furnish prior written notice to LGU. B. The above remedies shall be in addition to any other right or remedy available to the COUNTY under this Agreement, law, statute, rule, and/or equity. C. The COUNTY's failure to insist upon strict performance of any provision or to exercise any right under this Agreement shall not be deemed a relinquishment or waiver of the same, unless consented to in writing. Such consent shall not constitute a general waiver or relinquishment throughout the entire term of the Agreement. D. This Agreement may be canceled with or without cause by either party upon thirty (30) day written notice. If COUNTY cancels this Agreement without cause upon thirty days written notice, COUNTY shall pay the LGU reasonable expenses incurred prior to the notice of cancellation. E. Provisions that by their nature are intended to survive the term, cancellation or termination of this Agreement include but are not limited to: INDEMNIFICATION; DATA PRACTICES; RECORDS - AVAILABILITY /ACCESS; DEFAULT AND CANCELLATION; PROMOTIONAL LITERATURE; and MINNESOTA LAW GOVERNS. 11. CONTRACT PROCESSING AND ADMINISTRATION Jan Craig, or successor (County Contract Administrator), shall manage this Agreement on behalf of the COUNTY and serve as contract liaison between the COUNTY and LGU. 4 12. COMPLIANCE AND NON - DEBARMENT CERTIFICATION A. LGU shall comply with all applicable federal, state and local statutes, regulations, rules and ordinances currently in force or later enacted. B. If the source or partial source of funds for payment of services under this Agreement is federal, state or other grant monies, LGU shall comply with all applicable conditions of the specific referenced or attached grant. C. LGU certifies that it is not prohibited from doing business with either the federal government or the State of Minnesota as a result of debarment or suspension proceedings. 13. NOTICES Any notice or demand which must be given or made by a party under this Agreement or any statute or ordinance shall be in writing, and shall be sent registered or certified mail. Notices to the COUNTY shall be sent to the County Administrator with a copy to the originating Department at the address given in the opening paragraph of the Agreement. Notice to LGU shall be sent to the address stated in the opening paragraph of the Agreement. 14. PROMOTIONAL LITERATURE Except as expressly indicated herein, the LGU agrees that the terms "Hennepin County" or any derivative shall not be utilized in any promotional literature, advertisements of any type or form or client lists without the express prior written consent of the COUNTY. 15. MINNESOTA LAWS GOVERN The Laws of the State of Minnesota shall govern all questions and interpretations concerning the validity and construction of this Agreement and the legal relations between the parties and their performance. The appropriate venue and jurisdiction for any litigation will be those courts located within the County of Hennepin, State of Minnesota. Litigation, however, in the federal courts involving the parties will be in the appropriate federal court within the State of Minnesota. If any provision of this Agreement is held invalid, illegal or unenforceable, the remaining provisions will not be affected. Reviewed by the County Attorney's Office COUNTY ADMINISTRATOR APPROVAL COUNTY OF HENNEPIN STATE OF MINNESOTA i County Administrator Department Director of Date: Date: City of Corcoran, MN Hennepin Youth Sports Program -Grant Application 2011 Scope of Project The City of Corcoran, MN, proposes two pieces of youth sports equipment at a total cost of $15,500 to promote the youth sports utilization of the existing Corcoran Community Park baseball and softball fields. The grant request is to cover $8,000 of the project expense. The equipment is: • Purchase and erection of field netting in order to separate the full size baseball /softball diamond from the existing four T -Ball fields. • Replace the 20 plus year old youth batting cage that is deteriorated and has been vandalized to the point that is not operational. Needs Statement In the City of Corcoran, there is one city park for organized and sports related activities and is approximately 22 acres in size. Immediately adjacent to the city park, are approximately 60 acres of land owned by the Rockford School District (RSD). Both sites are programmed extensively to provide youth sports activities through the city, the RSD, and the Corcoran Athletic Association. These parks serve the needs of a very wide area. The City of Corcoran covers an area of 35+ square miles and a population close to 5,600 people. The RSD borders include approximately half of Corcoran and several other neighboring communities. In both park properties there are six baseball /softball fields that serve youth sports including the organized RSD school teams. The field netting will serve to separate the younger T -Balls players from the balls being hit by players in the fields immediately to the west of the T -Ball fields The batting cage in the city park is very old and no longer operational. The city and the Corcoran Athletic Association would like to rebuild the cage to the standard needed by high school varsity players and make available to all youth teams. Resolution of Local Government Unit. The City of Corcoran City Council passed resolution 2011 -46 on October 13, 2011 which authorizes the filing of the application and execution of final agreements with Hennepin County. Geographic Location Map Two maps are included which shows the City of Corcoran within Hennepin County and the Corcoran Park within the City of Corcoran. Site Plan The site plan and maps indicate the location of the field netting and the batting cage. 10/12/2011 The Hennepin Youth Sports Equipment Program, Grant Application Environmental Intrusion Statement There is no existing condition known to the city within, around, or under Corcoran Community Park that would constitute a hazard or, would warrant correction or mitigation of any kind. Agreements and Arrangements The City of Corcoran is the sole owner of the park and all of the venues within the park. There are no agreement with any users or organizations that use this park and their facilities that would hinder the use of the requested equipment. Operations and Maintenance Statement The City of Corcoran intends to operate and maintain the Corcoran Community Park and all facilities located within the boarders of the park into perpetuity. The ball fields identified in the enclosed map of the park are an integral part of this park will also be permanently operated and maintained as such and certainly for more than 50 years. There are no plans envisioned, stated, or even discussed that would move, dissolve, or redevelop this park (or any parts of this park) for redevelopment into a non -park use Comprehensive Plan Compatibility The Corcoran Community Park and all of its facilities, amenities, and uses is compatible with all policies and goals as stated in the 2030 Corcoran Comprehensive Plan which has been accepted by the Met council and adopted by the City of Corcoran on June 23, 2011. Estimate of Users Children and youth up to high school age as well as youth oriented sports programs will be the primary users of the facility and will be the highest priority for use. The use of the six baseball ball fields will also be available to all members including adults as a second priority. Local Matching Funds The City of Corcoran will be the principal contributor to the purchase and development of the equipment. The city will undertake site development work, as well as assisting in the erection of the equipment. City personnel and machinery will be employed for the base development of the site. The city will also will be responsible for the ongoing maintenance and upkeep of the equipment. Budget The proposed budget for both pieces of equipment is $15,500. The proposal is for the city to cover 52% of the cost and the Hennepin Youth Sports Equipment Grant to cover 48 %. Last summer interest was even higher as word seemed to spread that tennis lessons were available in Corcoran. Affordable lease rates from the city help us keep registration costs down so area residents can afford to send their kids to tennis lessons. We are hoping to gain approval for leasing the courts again this summer, doing a similar 5 week program as last year, with this year's dates being: June 18 -21 June 25 -28 July 9 -12 July 16 -19 July 23 -26 We would like to keep the times the same, 8:30- 12:00.
