V. Commission Discussion & Recommendation — Commission discussed and
recommended amendments to the Resolution to allow the lean to area to be
enclosed and expanded to allow the new building up to 7,000 sq. ft. in area and to
eliminate the recommendation, to remove the condition requiring removal of the 2 "d
detached accessory building and to remove the condition requiring the addition of
stone wainscoting.
Motion by Ravenholdt seconded by Kadlec to recommend approval of the amended
Resolution 2013 -xx. Voting Aye: Jacobs, Ravenholdt, Kadlec, Wu, Theis. Voting
Nay: Krueger (Motion carried 5:1). Krueger stated that he voted no because he felt
that a higher quality material was needed on the proposed metal building.
b. *Public Hearing. Funfar CUP for Accessory Building at 22730 Wagon Wheel

i. Staff Report — City Planner Kendra Lindahl presented her staff report
ii. Public Comment — David Horn, 6416 Hunter Lane, expressed concerns about
traffic increases on Hunter Road if it were connected to Gleason Road and inquired
about assessment policy for improvements. He requested that the City consider this
connection as an emergency vehicle access only and that the City prohibit
construction traffic on Hunter Lane. Karen Schultz, 6519 Hunter Lane, expressed
concerns about traffic increases on Hunter Road if it were connected to Gleason
Road. Mike Seiffert, 6423 Hunter Lane, asked how density was calculated. Joe
Jablonski, U.S. Homes /Lennar, presented information, answered questions, and
asked for feedback from the Commission, specifically on the proposed lot sizes and
density.

for Lennar's proposed development /Sketch Plan.

1. Application Request
Jeff and Kristen Ophoven, 19315 County Road 30, have submitted an Interim Use Permit application
for a Conditional Home Occupation License (CHOL). This is required due to a Code Compliance
concern raised in 2012. In May 2012, the City received an anonymous call questioning whether or
not the RV and boat storage was allowed. Such uses are not allowed in the Urban Reserve (UR)
zoning district. However, staff finds that due the historical operation on the site, the applicant could
request approval of a CHOL based on the finding that they would have been eligible to receive one in
2001 when the Home Occupation ordinance was adopted had they submitted the application at that
time as existing home occupations were requested to do.
Mr. Ophoven went before the Council on April 11, 2013 with a request to speak about his home
occupation and request that the escrow fees to process his application be lowered. The council
agreed unanimously to lower the escrow amount from $2,000 to $500. (See Letter and April 11, 2013
Council Minutes)
Under the Home Occupation Ordinance, this business requires a CHOL (which is processed as an
IUP) because the business is outside of the principal structure, there are customer visits to the
property, and there is exterior evidence visible from public roads and adjacent parcels.
2. Context
Background
The City Code (1030.100) that the Commission shall consider the following standards and criteria
when reviewing a CHOL:
1. The nature and general character of the geographic area in which the CHOL property is located.
The City may consider, in additional the other factors and not by way of limitation, the existence
and condition of gravel and paved roads in the area, existence and proximity of collector, County
and State roadways in the area, CHOL lot size, the proximity of CHOL operation to neighboring
residences, size of neighboring lots, and use of neighboring properties.
2. Consideration shall be made for potential property devaluation of adjacent and surrounding
properties.
3. Nuisance factors shall be considered, including but not limited to sight, odor, light, glare, and
noise. And any other nuisance factors than may result from issuance of the CHOL.
4. Environmental concerns. Including but not limited to drainage, wastewater, wells, and wetland
issues.
5. Compliance with all relevant Code sections.
6. Impact on the neighboring properties shall be considered before issuing a CHOL
The site in question consists of approximately 67 acres and has driveway access to County Road 30.
The applicant has indicated that they historically have had and currently have 30 -40 customers that
each translates to approximately two trips per year (a total of approximately 60 -80 trips annually).
Zoning and Land Use
The site is currently zoned as Urban Reserve and is designated for Mixed Use on the 2030 Future
Land Use Plan. The property is currently listed for sale. The owners hope to sell their property to a
developer, at which time the storage would cease.
Surrounding Properties
The surrounding properties are zoned Urban Reserve and Community Commercial and existing
Single Family Residential. The 2030 Future Land Use Plan guides the surrounding properties as
Mixed Use, Business Park, and Existing Residential.
Natural Characteristics of the Site
The center of the lot, where the business operations are to be located, is surrounded by both natural
screening by trees and screening from existing structures. (See Aerial Map)
3. Analysis of Request
The property is visible from County Road 30 and was inspected on July 11, 2013. The campers are
stored on the center of the property and are screened to the North and West by two large accessory
buildings and the primary structure (residence), as well as to the East and South by a large tree line.
The storage is only somewhat visible from the public road. (See site plan and photos). The property
owner has stated they have been operating this business since approximately 1998. The business
operations will not change or expand.
This request is nearly identical to a City approved outside storage operation located just north of the
Ophoven property at 10409 County Road 101 - Waag Conditional Home Occupation License. (See
Attached Resolution 2002 -61). The difference is that Waag applied for the CHOL when the home
occupation ordinance was initially adopted; therefore, they have been legally operating since that
time.
The Conditional Home Occupation License (CHOL) is issued as an Interim Use Permit. An Interim
Use Permit (IUP), unlike a Conditional Use Permit, is specific to both the property and the applicant.
This means that the IUP /CHOL in not transferable, and may become void due to certain changes,
such as property sale, subdivision, etc.
Staff finds the request for an Interim Use Permit for a Conditional Home Occupation License to
continue the outside storage business to be reasonable.
4. Conclusions
Staff finds the proposed outside storage business has a limited impact on the neighboring properties.
This business has been operating since approximately 1998, roughly 15 years with little to no
changes or expansion. There is a similar business, still in operation, which was approved for CHOL
in 2002 after the Home Occupation Ordinance was adopted by the City; had the Ophoven's applied
for a CHOL in 2002, it would almost certainly have been approved.
5. Recommendation
Move to recommend approval of the request, based on the findings and conditions in the attached
resolution.

WHEREAS, Jeff and Kristen Ophoven have applied for a Conditional Home Occupation License
(CHOL) to operate an outside storage business at 19315 County Road 30; and
WHEREAS, the Planning Commission has reviewed the Conditional Home Occupation License
at a duly called Public Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORCORAN, MINNESOTA, that it should and hereby does approve the request by Conditional
Home Occupation License, subject to the following conditions:
A Conditional Home Occupation License is approved to allow an outside storage
business to operate in accordance with the application and plans received by the City on
May 22, 2013, except as amended by this resolution.
2. The Conditional Home Occupation License is issued to Jeff and Kristen Ophoven for the
operation of an outside storage business. This permit is non - transferable. If the
business ceases, if ownership of the business changes, or if the individual to whom a
license has been issued ceases to own the subject premises, the CHOL is automatically
revoked.
3. The Conditional Home Occupation License is approved based on the findings:
a) There are no employees.
b) This is currently not a legal operation.
c) It is located within the UR zone.
d) The site consists of 67.28 acres.
e) Hours of operation are minimal.
f) There are no environmental or watershed issues.
g) There are no accessory structures relating to this business.
h) Comp Plan guides this property toward Mixed Use.
i) Storage consists of RVs, campers, enclosed ATV /snowmobile trailers, and
boats only.

4. Storage shall be limited to RVs, campers, enclosed ATV /snowmobile trailers and boats,
not to exceed forty units on site.
5. All units to be stored must be in working condition and have all necessary registration
and current licensing.
6. No advertising signage for the business or other businesses shall be allowed on the site.
7. The site must comply with all state, federal and local regulations.
8. The Conditional Home Occupation License shall be issued for 3 years in accordance with the
procedures outlined in Section 1030.100 of the Zoning Ordinance. The permit shall be
administratively reviewed every 3 years to ensure compliance with conditions of approval and
ordinance requirements. The City may revoke or modify the CHOL upon a finding that
conditions have changed to warrant revocation or modification of the license.

Dear Mr. Donahue,
Please forward this request to the City Council for consideration
Dear Mayor and Councilmembers,
As you may be aware, I have been doing outdoor storage on my property located at 19315 County
Road 10, Corcoran, MN for about 15 years. I mainly store campers and Boats in their "off-
season." I was made aware in 2012 that this type of land use requires a Conditional Home
Occupation License (CHOL). I am willing to take the necessary steps and go through the process
to comply with the City's Ordinance regulating home occupations, but I have one request:
There is another operation located across from the KOA just north of me on County Road 101
that has an approved resolution for CHOL from 2002 that is nearly identical to my own. I have
been given indication that my application will also be approved. However, since I have been
doing storage since the late 1990's, and was just recently made aware of the need for a CHOL, I
am asking for the Council to forgive the Escrow amount of $2000.
If I was made aware in 2002 when the CHOL process was initialized, I would have gladly
complied. In 2002, the process for the CHOL was almost identical as it is today, with one major
difference: Cost. The cost for a CHOL until 2006 was a $500 flat fee, with no escrow. For one
reason or another, in 2007, an escrow amount of $2000 was added to the cost. (see attached) I am
more than willing to pay the $500 fee, as it was in 2002 -2006, but I am asking that the escrow
required be the same as it was then: $0. This was started and continues to operate as a necessity to
help cover my property taxes, and quite frankly, I just cannot afford $2,500 at this time.
I do not believe that forgiving the Escrow will in any way jeopardize the intent of the Ordinance;
I will still go through the entire application process including Administrative and Planning
Commission Review and Council Approval. I am just asking for leniency on the cost and I have
been working with both Mike Pritchard in Code Compliance and Kendra Lindahl, City Planner to
find a solution. We have agreed that they would be able to help this process along as efficiently as
possible but that any leniency in fees and escrows would have to be approved by the City
Council.
In summation, I am requesting that you forgive the $2,000 Escrow amount

From the Conditional Home Occupation License adoption, through 2006 a flat fee of $500 was required. In 2007 the
policy changed to keep the $500 fee and add a $2000 escrow. This policy remains the same today.

Please complete the attached Home Occupation application and return it to the City of
Corcoran by Friday, February 15, 2002. Once we have a chance to review the applications,
we will notify you of whether or not your home occupation is considered an Allowed, Special
or Conditional Home Occupation. We anticipate this notification will take place the end of
February beginning of March 2002 (for those applicants who submitted their response cards
by the December 31, 2001 deadline).
If a determination is made that your business is considered an Allowed Home Occupation, no
fee or permit will be required.
If a determination is made that your business is considered a Special Home Occupation, an
administrative permit fee of $50 will be required. Once this fee has been paid, a notice of
intent shall be sent to all property owners within 350 feet of the perimeter of your property.
The notice will request that written comments are forwarded to the City Administrator within
ten (10) days of the date of the notice. Upon expiration of this comment period, if no concerns
have been raised by any neighboring property owners and if the City has no additional
concerns, a administrative permit will be granted.
If a determination is made that your business is a Conditional Home Occupation, an
application fee of $500 will be required. Once this fee has been paid, a notice of intent shall
be sent to all property owners within 350 feet of the perimeter of your property. The notice will
request that written comments are forwarded to the City Administrator within ten (10) days of
the date of the notice. In addition to the notice of intent, the applicant will also need to appear
before the Planning Commission and City Council to demonstrate the need for the
Conditional Home Occupation License (CHOL). All applications will be reviewed and
analyzed, taking into consideration the general health, safety and welfare of the community
as a whole.

City Council Meeting Minutes
April 11, 2013 - 7:00 PM
The Corcoran City Council met on April 11, 2013, at City Hall in Corcoran, Minnesota.
Present were: Mayor Guenthner, Councilor Asleson, Councilor Cossette, Councilor Lynch, and
Councilor Thomas. Also present were: City Administrator Donahue, City Engineer Kent Torve,
Public Works Director Meister, and Code Compliance Official Pritchard.
Mayor Guenthner called the regular meeting to order at 7:OOpm.

The Regular City Council Meeting suspended for Local Board of Appeal and Equalization
Present were: Assessor Rolf Erickson, Lisa Mott, John Mott, and County Representative Luann

1. Roger Bechtold 19900 Hillside Drive, requested that the City raise his assessed value.
Rolf Erickson recommended the assessable value be adjusted from $168,000 to $192,000.
MOTION: Thomas, seconded by Asleson to approve the adjustment as recommended.

A RESOLUTION TO APPROVE A CONDITIONAL HOME OCCUPATION LICENCE
FOR THE OPERATION OF AN OUTSIDE STORAGE BUSINESS
WHEREAS, Rollie and Cami Waag, 10409 County Road 101, have applied for a Conditional
Home Occupation License, (CHOL); and
WHEREAS, the ordinance states that the Commission shall consider certain standards and
criteria when reviewing a CHOL; and
WHEREAS, a public hearing was held on August 15, 2002 as required by Ordinance.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Corcoran that a
CHOL shall be granted to Rollie and Cami Waag at 10409 County Road 101 for the purpose of
conducting an outside storage business based on the following findings and subject to the
identified conditions:
FINDINGS:
a) There are no employees.
b) This is currently not a legal operation.
c) It is located with the R1 zone.
d) The site consists of 26.42 acres.
e) Customer visits are not an issue.
I) Hours of operation are minimal.
g) Screening may be an issue, a visual nuisance.
h) There are no environmental or watershed issues.
i) There are no accessory structures relating to this business.
j) Comp Plan guides this property toward business.
k) Storage consists of recreations vehicles only, campers and boats.
1) Location is adjacent to a KOA.
CONDITIONS:
1. The CHOL is not transferable.
2. Storage shall be limited to campers and boats, not to exceed ten units on site.
3. No advertising signage for the business or other businesses shall be allowed on the site.
4. The site must comply with all state, federal and local regulations.

determimtion that the existing Home Occupation still warrants the issuance of a license.

1. Armbruster Topography and Wetland Waiver (city file no. 09 -011). An application has been
received for a waiver from the topography and wetland requirements and was reviewed by the City
Council on November 23, 2009. The City Council expressed concerns about the concept and directed
the applicant to revise the concept plan. The applicant submitted a letter extending the review period
until January 1, 2014. Staff recommends that no further extensions be provided.
2. Administrative Permit for Special Home Occupation for Jacob Shoulak at 20475 CR 10 (23 -119-
23 -23 -0007) (City File 12 -026). This application is to allow an in -home recording studio. The
application is currently incomplete but when a complete application is received, it will be processed
administratively.
3. Lano Equipment at 23580 Highway 55 Site Plan Amendment for Cold Storage. (31- 119- 23 -34-
0007) (13 -006). This item was reviewed by Planning Commission at a public hearing on June 6th and
the City Council will consider the request on June 27th
4. PUD Sketch Plan and EAW for Lennar (City File 13 -007). The applicant submitted a PUD sketch
plan and the City Council took action initiate the completion of the required EAW (environmental
review assessment worksheet) at the April 25th Council meeting. The EAW is a process required by
the State of Minnesota. The EAW is tentatively schedule to be reviewed and ordered for distribution
and comment at the July 25th Council meeting. Following completion of the EAW, the applicant could
request approval of preliminary plat and PUD preliminary development plan and finally a final plat,
PUD final development plan and rezoning to PUD. The review of the PUD sketch plan was scheduled
for Parks and Trails Commission on May 21St, Planning Commission on June 6th and City Council
review on June 27th. Sketch plan comments are advisory only.
5. Great River Energy Administrative Permit and Site Plan Modification for replacing tower at 7251
CR 116 (26- 119 -23 -41 -0001) (city file 13 -008). This item is currently incomplete, but will be
administratively approved.
6. Funfar CUP for accessory building at 22730 Wagon Wheel (32- 119 -23 -24 -0006) (13 -009). This
item is scheduled for Planning Commission review on June 6th and City Council action on June 27th
7. Construction Science Site Plan Modification at 7545 Commerce Street (26- 119 -23 -11 -0049) (City
file 13 -011). This item is currently incomplete, but will be administratively approved.
8. Sign Ordinance Update. At the April 25th Council meeting, the City reviewed a request for the city to
initiate a sign ordinance update. Specifically, they requested that the City review the ordinance
standards relating to sign area, sign height and internal illumination and, because this is a city -wide
issue, that the ordinance update be completed by the City out of the City funds. The Council

discussed the issue and directed staff to bring a proposal back at a later date because the Council felt
that this was a significant undertaking that would involve much more than this one issue. We will work
with the City Administrator to determine the appropriate meeting to have this considered.
9. Ophoven CHOL at 19315 CR 30 (city file 13 -014). Jeff Ophoven has submitted a request for
approval of a CHOL for an existing home occupation for outside storage. This is the result of a code
enforcement issue. The item is scheduled for a public hearing at the Planning Commission on July
th and City Council on July 25th

10. Triden Topographic Survey and Wetland Delineation Waiver at 23425 CR 117 (city file 13 -015).
The landowner has submitted a request for the waivers for this 56 -acre parcel and would then proceed
with a plat to split the site into two parcels as part of their estate planning. The item is scheduled for a
City Council consideration on June 27tH
11. Certificate of Compliance for accessory structure for Doug Weseman at 10545 Robert Lane
(City file 13 -016). This item will be administratively approved.
12. Sketch Plan Review for Mini - Storage at 19219 CR 10 (City file 13 -017). This was just received and
is being reviewed for completeness. It is tentatively scheduled for the August Planning Commission
and City Council meetings.
Also, there are a number of projects that have been approved, but are still not filed and closed out:
1. Ess Addition (city files 05 -017, 08 -003 and 12 -024). The City Council granted an after - the -fact
extension for this final plat at their November 29, 2012 meeting. The applicant is now working to file
the required documents to close out this file.
2. Corcoran Business Park (city file 06 -005). The City Council granted a one year extension to the
final plat approval, which expired on April 12, 2011. Staff has spoken to the applicant and is still
working to close out this project.
3. Northern Natural Gas Administrative Permit (city file 09 -009). This project has been completed
but a site inspection on May 15th I identified 5 trees that must be replaced. Upon replacement of these
trees, the project can be closed out and the landscape guarantee refunded. Staff has an inspection
scheduled for June 26tH
4. Satellite Industries Site Plan Amendment, Conditional Use Permit Amendment, Lot
Consolidation and Easement Vacation (city file 10 -007). On September 23rd the City Council
approved Resolutions 2010 -37, 2010 -38 and 2010 -39 approving the request with a number of
conditions. The applicant has addressed those conditions and has submitted a building permit
application and has begun site work. Staff inspected the site on October 12th and found that the major
site improvements had been made, but there are several items that still have to be addressed. We
have discussed these items with the landowner. The city has a financial guarantee in place to ensure
completion.
5. Park Place Storage After - the -Fact Extension of Approvals (city file no. 10 -008). On September
23, 2010, the City Council approved a site plan and conditional use permit amendment for Park Place
Storage to construct the 18th and final mini - storage building on that site. The approvals expired on
September 23, 2011. The applicant contacted the City and requested a one year extension until
September 23, 2012. The conditions have been met and a building permit was issued in September.
The applicant has completed most of the site work with final items to be completed in the spring.
6. Rocks N Blocks Site Plan Amendment and Conditional Use Permit (city file no. 10 -012). An
application was received for a Conditional Use Permit and Site Plan Amendment to continue operation
of a business with outside storage at 20010 75th Avenue North. The application was approved by the
City Council on June 23rd. This was approved as a way to correct a code enforcement issue. No work
has been done on site to correct the code violations. The applicant has not yet complied with the
conditions of approval and has asked for a 3 month extension. The approvals expired on
September 23, 2012. The applicant is working to complete the site improvements.

7. Hope Ministries Conditional Use Permit for Cemetery and Vacation of Drainage & Utility
Easement at 19951 Oswald Farm Road (city file 12 -002). Hope Ministries has submitted a request
for a conditional use permit to allow a cemetery west of the existing church. The application was
approved by the City Council on March 22nd and site work had begun.
13. Schmid's Hidden Valley 2nd Addition Topography /Wetland Waiver, Preliminary Plat and Final
Plat at 21820 Oakdale Drive (PID 04- 119 -23 -34 -0007, 04- 119 -23 -42 -0002 and 04- 119 -23 -42 -0003)
(City File No. 12 -016). The application for topography and wetland delineation waiver was approved
at the September 27th Council meeting. The preliminary plat and final plat were approved by the City
Council on April 25th. The applicant is working on complying with approval conditions so that they can
get the final plat mylar signed and recorded.
14. Site Plan and Variance for Maple Hill Estates Community Center) (City File 12 -022). The
landowner and the City received a CDBG grant to construct a new community center on land north of
the manufactured home park that is also owned by the park owner. This new building is in the process
of being designed. The building is likely to straddle a lot line or at minimum require a setback
variance. The survey has been completed and the site plan is currently being prepared. This item
was approved by the City Council on April 25th
15. Feasibility Study for Lennar (City File 12 -025). The applicant requested that the City conduct an
infrastructure feasibility study regarding property west of CR 101 and north of Hackamore. This is part
of the property that was previously proposed as the "Hedgestone" development. The applicant has
provided an escrow and the City Engineer has begun work on feasibility study. The study was
accepted by the City Council at their April 25th Council meeting.
16. Heinz Second Addition Preliminary and Final Plat at 20801 CR 117 (03- 119 -23 -14 -0002) (City file
13 -003). A wetland and topographic waiver was approved on January 24th. This item was approved
by the City Council action on April 25th. The applicant is working on complying with approval
conditions so that they can get the final plat mylar signed and recorded.
17. Kohnen /Kothrade Minor CUP Amendment at 23240 CR 30 (07- 119 -23 -13 -0003) (City File 13 -005).
This application has been received to resolve a code violation. The item was processed as a minor
CUP amendment as discussed at the October 11, 2012 City Council meeting and the request was
approved by City Council action on April 25th. The project will be closed out and any remaining escrow
refunded.
18. Certificate of Compliance for accessory structure for John Koller at 6810 Horseshoe Bend (City
file 13 -012). This item was administratively approved.
19. Certificate of Compliance for accessory structure for Dan and Cindy Patnode at 22802 CR 50
