Approval of Site Plan for new Public Works Facility on Lot 1, Block 1, Roehlke Addition (City File 12 -010) i. Staff Report. Planner reviewed the report on the project ii. Public comment: None iii. Commission Discussion. Commissioners discussed several points about the site plan. Comments mostly centered on providing adequate landscaping on the south side of site and to provide adequate signage for users of the Three Rivers Trail to look for vehicle entering and leaving the Public Works Facility. Regarding the landscaping, It was explained that this is the side that would be expanded in the future and that city staff would be putting in landscaping at this end. iv. Motion by Krueger and seconded by Wu to approve Resolution 2013 -XX and adding additional provision #8- providing for signage at crossing of driveway and Three Rivers Trail. Preliminary Plat for "Schmids Hidden Valley Second Addition" on Oakdale Drive (PID 04- 119 -23 -42 -003, 04- 119 -23 -42 -0002, 04- 119 -23 -43 -0002 and 04- 119 -23 -34 -007) City File No. 12 -016 120 -DAY REVIEW DEADLINE: June 13, 2013 1. Application Request Ron Schmid is requesting preliminary plat approval for a replat of 2 existing lots and creation of 2 additional lots and outlots. Lot 1 and 2, Block 2 are a replat of the existing homes for Ronald Schmid and Richard Schmid respectively. Lot 1 and 2, Block 1 are two new lots created from Outlot A, Schmids Hidden Valley and Outlot A and B are remaining parcels that are not planned for development at this time. 2. Context Background On September 27, 2012 the City Council granted a Topography Exemption and Wetland Delineation Exemption for Schmid Property at 21925 Oakdale Drive, 21820 Oakdale Drive and 21800 Oakdale Drive. Zoning and Land Use The property is zoned Rural Residential and is guided Rural / Ag Residential. Surrounding Properties The surrounding properties are all zoned Rural Residential and guided Rural / Ag Residential. Natural Characteristics of the Site The draft 2030 Comprehensive Plan shows shoreland overlay district on the eastern portion of this property along the Rush Creek Corridor and medium quality wetland areas in the southern portion the property. ANALYSIS: • Staff has reviewed the application for consistency with Comprehensive Plan, Zoning Ordinance, Subdivision Ordinance and City Code requirements, as well as City policies. The City Engineer's comments are incorporated into this staff report and the detailed comments are included in the attached engineering memo. A. Level of City Discretion in Decision - Making The City's discretion in approving or denying a preliminary plat is limited to whether or not the proposed plat meets the standards outlined in the City Code. If it meets these standards, the City must approve the preliminary plat. B. Consistency with Ordinance Standards The 75.56 -acre parcel is currently owned by Howard and Leona Schmid. The two parcels proposed as Lot 1 and Lot 2, Block 2 are the existing homes for Ronald Schmid and his brother, Richard Schmid. The applicant is planning to request preliminary plat approval to replat the two existing homes within this parcel to clean up some property line issues, retain Outlot A and B for future development and to subdivide Outlot A, Schmids Hidden Valley into two parcels. Lot Size The following table identifies the minimum lot size requirements in the Rural Residential district. The proposed lots exceed minimum ordinance standards: Rural Residential District Minimum Lot Size = 2 acres Minimum Lot Width = 200 feet Lot 1, Block 1 3.84 acres 306 Lot 2, Block 1 3.89 acres 349 Lot 1, Block 2 4.84 acres 200 Lot 2, Block 2 2.00 acres 285 Outlot A 28.48 acres 622 Outlot B 43.24 acres 1436 Section 945.020, Subd. 1 of the Subdivision Ordinance requires that "... all lots shall abut and have direct access to an improved street.... ". I have conferred with the City Attorney who agrees that the Schmids Hidden Valley Plat was approved with a shared private drive to provide access to the existing homes and the proposed homes in Schmids Hidden Valley Second Addition. So while the current ordinance does not allow subdivision with access via a private drive, this is an existing condition that contemplated this access. Therefore, lot frontage for Block 2 is measured from this private drive. The existing buildings on this lot meet all setback requirements. Schmids Hidden Valley Second Addition (12 -016) April 4, 2013 I Septic and Well • 0 The 2 existing lots have septic systems. The applicant has provided information that the septic system on Lot 1, Block 2 is compliant, but the septic on Lot 2, Block 2 is not. Lot 2 is required to be brought into compliance as part of this plat. The plans show the location of the new septic system. The two new lots in Block 1 will also have septic systems. Staff is concerned about the location of Septic Site A as currently shown on Lot 1, Block 1. This location could block the drainage form the low area in the southeast corner of that lot which flows northwest through this area. The applicant should work with their septic designer and engineer to ensure that drainage is maintained. Septic systems must be approved by Hennepin County. Well and septic locations are shown on the plans and will be reviewed with building permit application. Streets The City Engineer has reviewed the plans for compliance with city policies and ordinances and recommends an 80 -foot wide right -of -way for Oakdale Drive based on the approved City Engineering Design Standards. These standards note that for collector roads, such as this, an 80- foot right -of -way should be provided and has been included as a condition of approval. The two existing homes have a shared driveway off Oakdale Drive. No new access to Oakdale shall be permitted. This driveway shall remain in place, but a shared driveway exists for these two parcels and a driveway easement is shown on the preliminary plat. The applicant shall provide a shared driveway easement agreement and maintenance agreement for review and approval by the City Attorney. This document shall be filed with the final plat. The proposed new lots in Block 1 will have access from the existing shared driveway. This shared driveway agreement from 2000 shall be updated to include these 2 new lots as originally anticipated. This document shall be prepared by the applicant and submitted for review and approval by the City Attorney to ensure the driveway easement provides access to all affected homes and addresses maintenance. This document shall be filed with the final plat. A concept for the future extension of High Bluff Road though the outlots has been shown as required. This concept plan identifies a general alignment, but final alignment shall be determined in the future when the outlots are platted. Drainage and Utility Easements Section 945.060, Subd. 2 of the Subdivision Ordinance requires 10 -foot drainage and utility easements around the perimeter of the lot (10 -foot adjacent to right -of -way and 5 -foot adjacent to shared lot lines). The plans comply with these requirements. All wetlands must be blanketed by a drainage and utility easement. The plans comply. Schmids Hidden Valley Second Addition (12 -016) April 4, 2013 • r • Wetlands • The wetland delineation was approved by Elm Creek Watershed Management Commission on January 4, 2013. All wetlands are blanketed by a drainage and utility easement. Because Lots 1 and 2, Block 2 are existing lots and were exempted from the wetland delineation requirements, they are not showing wetland buffers or setbacks. However, when the outlots are platted in the future, they will be required to comply with these standards. Shoreland Outlot A, Outlot B and Lots 1 and 2, Block 2 are located in the shoreland overlay district for Rush Creek. The shoreland overlay district is shown on the plans. Section 1050.020 of the zoning ordinance notes that the property within 300 feet of the creek is located in the Shoreland Overlay District as required by State Law. The ordinance requires a 25 -foot shoreland buffer and monument signs. The city allows the wetland buffer monument signs to be used to delineate this buffer. Similar to the wetland requirements, because Lots 1 and 2, Block 2 are existing lots, they are not showing shoreland buffers or setbacks. However, when the outlots are platted in the future, they will be required to comply with these standards. Park Dedication The adopted 2030 Parks & Trails Plan shows a Proposed County Bike Trail on Oakdale Drive. The Comprehensive Plan states "County Bike Trail — A proposed 3.6 -mile County Bike Trail would run along Oakdale Drive and be managed by Hennepin County." It appears that the proposed 80 -foot right -of -way on Oakdale would be adequate to accommodate this trail and no additional ROW or easement is required. A search area for a future OSP /Nature is shown on the property north of the Schmid property. The Parks Commission will review this project and make a recommendation at their April 23rd meeting. Staff recommends park dedication shall be required for the two new lots (Lot 1 and 2, Block 1). Park dedication shall be subject to the park dedication fees in place at the time the final plat is released for recording. Final Plat The applicant has also requested approval of a final plat. The final plat requires action by the City Council only and will be reviewed at the April 25`h Council meeting. C. Conclusions Staff has reviewed the plan for consistency with the applicable standards outlined in the Comprehensive Plan, Zoning Ordinance and Subdivision Ordinance. Staff noted in the staff report the outstanding that must be addressed and we have included conditions in the attached draft resolutions to address these issues. Schmids Hidden Valley Second Addition (12 -016) April 4, 2013 • 4. RECOMMENDATION: • Staff recommends that the Planning Commission recommend approval of the preliminary plat, subject to the findings and conditions in the attached resolution. Attachments a. Application Request Brent and Melissa Heinz are requesting approval of a preliminary plat to allow the creation of 1 new lot for the existing farmstead, 1 new lot for a new home and an outlot for future addition to the new home lot. 2. Context Background On January 27, 2012, the City Council approved a topography and wetland delineation waiver for the portion of the property that would remain with the existing farmstead. Section 930.020, Subd. 6(B)2 of the City Code allows the City Council to waive the topography requirements for lots greater than 3 acres and the City Council has granted waivers from the wetland delineation. In July 2012, David Heinz received a certificate of compliance for an agricultural building with metal siding and in excess of the allowed size. In 2006, a topography and wetland waiver, preliminary plat and final plat was approved for Brandon Heinz to subdivide a 2.5 acre lot in the northwest corner of the farm. In 2001, a Lot Division was approved to allow a 2 -acre site to be subdivided in the northeast corner of the farm. Zoning and Land Use The property is zoned Rural Residential and is guided Rural / Ag Residential. Surrounding Properties The surrounding properties are all zoned Rural Residential and guided Rural / Ag Residential. The property to the north (across County Road 117) is located in the City of Rogers. Landfori SensiblyGeen and Site to Finish are registered service marks of Landform Professional Services, LLC. • • • Natural Characteristics of the Site The southwest corner of the farm (where the proposed new lot would be located) is located within the Shoreland Overlay District from the creek that runs through this portion of the farm. The southwest corner of the property is located in the floodplain. The 2030 Comprehensive Plan shows wetland areas in the center of the property and a medium quality wetland in the southwest corner of the site. 3. Analysis of Request Staff has reviewed the application for consistency with Comprehensive Plan, Zoning Ordinance, Subdivision Ordinance and City Code requirements, as well as City policies. The City Engineer's comments are incorporated into this staff report and the detailed comments are included in the attached engineering memos. A. Level of City Discretion in Decision - Making The City's discretion in approving or denying a preliminary plat is limited to whether or not the proposed plat meets the standards outlined in the City Code. If it meets these standards, the City must approve the preliminary plat. B. Consistency with Ordinance Standards Staff has reviewed the application for consistency with Comprehensive Plan, Zoning Ordinance, Subdivision Ordinance and City Code requirements, as well as City policies. Lot Size Lot 1 = 2.5 acres Lot 2 = 68.21 acres Outlot A = 3.43 acres Staff notes that the lots exceed the 2 acre minimum lot size for the Rural Residential zoning district. However, Lot 1 does not meet the 200 -foot minimum lot width requirement. As part of the concept plan review on January 27th, the City Council advised the applicant that a variance would be required if these minimum lot width requirements were not met along Cain Road. The applicant indicated at the meeting that it is his intention to buy the remaining property between the proposed home site and Cain Road, but he could not afford to do so at this time. The City Attorney suggested that if the city received a commitment to buy that land at a future date, the Council could approve the plat as a phased -type development. The applicant has submitted a letter stating that Brent and Melissa Heinz intent to purchase Outlot A in the future and combine it with Lot 1 to meet the minimum frontage requirements. We have included a condition in the approvals to address this issue. The existing farm on Lot 2 has two legal, non - conforming structures. There is no change to that status with this plat. There are 5 building rights remaining on Lot 2, Block 1, Heinz Second Addition. Heinz Second Addition Plat (13 -003) 2 April 4, 2013 • • • • Septic and Well The plat has well and septic locations shown on Lot 1, Block 1. The locations meet shoreland and wetland setback requirements. Hennepin County must approve the septic plans and a copy of these approvals must be submitted to the city prior to issuance of a building permit. Streets No additional right -of -way is required for County Road 117 or Cain Road. The private driveway appears to meet the City private driveway standards. City standards require 8- inches of class 5 for the minimum 15 -foot wide drive. Drainage and Utility Easements Section 945.060, Subd. 2 of the Subdivision Ordinance requires 10 -foot drainage and utility easements around the perimeter of the lot (10 -foot adjacent to right -of -way and 5 -foot adjacent to shared lot lines). The plans comply with these requirements. All wetlands must be blanketed by a drainage and utility easement. The plans comply. Wetlands The wetland delineation was approved by Elm Creek Watershed Management Commission in 2006. While there are some outstanding issues related to Lot 2, there are no concerns about Lot 1 wetlands. All wetlands are blanketed by a drainage and utility easement. The Corcoran Natural Resources Communities Quality Ranking Map shows this as a medium quality wetland. Section 1050.010 of the zoning ordinance requires an average wetland buffer of 25 feet (20 -foot min /40 -foot max.) and a structure setback of 15 feet from the buffer. A permanent wetland buffer monument shall be installed at each lot line where it crosses a wetland buffer, and where needed to indicate the contour of the buffer, with a maximum spacing of 200 feet of wetland edge. Details must be provided to show compliance with wetland buffer planting requirements of Section 1050.010, Subd. 8 of the zoning ordinance. This planting plan must be submitted for review and approval by the City. The plans show a 50 foot buffer rather than the 25 feet required. This larger wetland buffer is encouraged but is not required. However, the plans must be revised to show the wetland monument locations. The buffer could be reduced to the minimum requirement at that time. Staff has included a condition that the wetland buffer monuments be shown on the plans and the wetland buffer monuments be installed. Section 1050.010, Subd. 4 requires a 75 -foot setback from the wetland for septic and soil absorbsion systems. These standards have been met. Heinz Second Addition Plat (13 -003) 3 April 4, 2013 S Shoreland E3 A portion of Lot 1, Block 1 is located in the shoreland overlay district for Rush Creek. The shoreland overlay district is shown on the plans. Section 1050.020 requires a 25 -foot shoreland buffer and monument signs. Because the shoreland buffer is located within the wetland buffer area, no buffer planting or signs shall be required for the shoreland area. The require wetland vegetative plantings and buffers shall address these requirements. The Shoreland Overlay District also limits land within this overlay district to a maximum impervious surface coverage of 25 %. No impervious surface is shown in this area. Floodplain The southwest portion of this property is located within the floodplain. These plans were submitted by the City to ECWMC for review as required. ECWMC and City staff both provided written notice to the applicant that an application must be submitted to ECWMC for review of the wetland delineation (to ensure that the 2006 delineation would be accepted) and to confirm the floodplain boundary. The ECWMC indicates that they have not yet received an application. ECWMC has noted that the floodplain boundary must be determined and shown on the plans. The plat application has been deemed incomplete until this issue is addressed. Staff believes that based on the information available today, the proposed home will be located outside of the floodplain boundary and that the proposed 932 walkout elevation will provide sufficient freeboard protection. However, the plans must be revised to accurately identify the floodplain boundary on the plans. Therefore, staff recommends the plans be revised to locate the floodplain elevation at the 916.5 elevation. Park Dedication The adopted 2030 Parks & Trails Plan shows an on -road trail on Cain Road and an off -road trail adjacent to Rush Creek. The existing Cain Road right -of -way would be adequate to accommodate this trail and no additional ROW or easement is required. The trail adjacent to the creek appears to run on the south side of the creek and it appears that no easement would be required. The Parks Commission will review this project and make a recommendation at their April 23rd meeting. Staff recommends park dedication shall be required for the new lots (Lot 1, Block 1). Park dedication shall be subject to the park dedication fees in place at the time the final plat is released for recording. Final Plat The applicant has also requested approval of a final plat. Context Background The City of Corcoran applied for a received approval of at Community Development Block Grant (CDGB) in partnership with the landowner and a non - profit community organization to build an approximately 3,500 square foot community center. The City will issue a design build RFP for construction of the building based on an approved site plan. Zoning and Land Use The property is currently located within the Metropolitan Urban Service Boundary (MUSA), guided Low Density Residential and zoned Urban Reserve (UR). The City -owned property to the south is guided Low Density Residential and zoned Urban Reserve. Maple Hill Estates is guided Medium Density Residential and zoned Manufactured Home Park. The property to the north and east is Rush Creek Golf Course, guided Golf Course and zoned PI (public institutional). The property to the west is guided High Density Residential and zoned High Density Residential (RMF -3). Natural Characteristics of the Site There are no trees or significant natural resources in the area of the proposed building. Analysis of Request i • Staff has reviewed the application for consistency with Comprehensive Plan, Zoning Ordinance and City Code requirements, as well as City policies. The City Engineer's comments are incorporated into this staff report. A. Level of City Discretion in Decision - Making The City's discretion in approving or denying a site plan is limited to whether or not the proposed request meets the standards outlined in the City Code. If it meets these standards, the City must approve the site plan. The City's discretion in approving or denying a variance is limited to whether or not the proposed project meets the standards in the Zoning Ordinance for a variance. The City has a higher level of discretion with a variance because the burden of proof is on the applicant to show that the variance standards have been met. B. Consistency with Ordinance Standards Site Plan The site plan would allow construction of an approximately 3,500 square foot community building. Under the terms of the CDGB grant, the building would be owned by the City for a minimum of 15 years. The owner of this parcel also owns the manufactured home park and has agreed to lease the land for the building to the City. The City Council is working through the terms of this agreement. The building itself has not been completely designed, therefore, architectural details have not been provided. Staff has included a condition requiring that the residential building standards in 1060.050, Subd. 1(B) be met for the new building. Sewer and Water The manufactured home park currently provides a community well and septic system. The contractor will be required to connect to this system. These systems are both permitted by the State and the contractor will be responsible for obtaining any required permits. Access The primary users of the new building are intended to be homeowners in Maple Hill Estates. Access to this building is through the park's internal streets. Setbacks The proposed building meets setbacks, except that a setback variance is requested on the south lot line adjacent to the city -owned property. This is discussed later in the staff report. Maple Hill Community Center (12 -022) April 4, 2013 Parking • • No new parking is proposed. However, restriping of the parking lot is required to provide a new handicapped stall near the entrance to the community center. The 23 existing parking stalls exceed ordinance requirements. Screening /Landscaping Section 1060.070 of the Zoning Ordinance provides standards for landscaping. Section 1060.070, Subd. 2(G) of the Zoning Ordinance specifies the landscaping requirements for all new construction and additions. The proposed landscape plan meets all ordinance requirements. The project grant dollars allow use of volunteer labor and supplies. Therefore, staff anticipates that there may be minor change to this plan as the project progresses. Any modification to plant species could be administratively approved during the construction process. Stormwater Management The City Engineer has reviewed the plans and recommends that the Contractor coordinate with Maple Hills Estates on final grading and drainage to provide proper drainage away from adjacent residences. Site Lighting If the applicant chooses to provide additional site lighting (either on the building or freestanding), they must submit a lighting plan to the city for review and approval, subject to Section 1060.040 of the Zoning Ordinance. Signage No additional signage is proposed. Variance A variance is required to reduce the required side (south) lot line setback from 25 feet to 1 feet. The reduced setback is requested to allow convenient access from the parking lot and manufactured home park. The setback is from a city owned parcel. This parcel is former right -of -way. Normally, when right -of -way is eliminated, the city vacates the right -of -way. In this case, the City retained the former right -of -way as an outlot rather that right -of -way or easement. The reasons for this area not clear to staff, but its effect is to create an arbitrary lot line. We have reviewed the request against the variance standards in Section 1070.040. Economic considerations alone do not constitute practical difficulties. Practical difficulties include, but are not limited to, inadequate access to direct sunlight for solar energy systems. The burden of proof is on the applicant to show that all of the following criteria have been met: a. That there are practical difficulties in complying with the Zoning Ordinance. That the conditions upon which a petition for a variation is based are unique to the parcel of land for which the variance is sought and were not created by the landowner. The conditions upon which the variance request are based are unique to this parcel due to the City's previous action to retain vacated right -of -way as an outlot rather a more typical easement. This creates an arbitrary lot line that separates the manufactured home park from the land upon which the structure is proposed to be built. c. That the granting of the variation will not alter the essential character of the locality. Granting the variance will not alter the essential character of the locality. In fact, the adjacent basketball court straddles the lot and it appears that the storm shelter to the west may also straddle the lot line. d. The proposed variance would be in harmony with the general purposes and intent of the Ordinance. Application Request Shane Funfar is requesting approval to demolish the existing home at 22730 Wagon Wheel Lane and relocate an existing home from 5825 Vicksburg Lane, Plymouth, MN. Zoning and Land Use The property is zoned Urban Reserve and is guided Low Density Residential. Surrounding Properties The surrounding properties are zoned Urban Reserve and Planned Unit Development. Natural Characteristics of the Site The northwest corner of the lot, where the home is to be located is high ground and surrounded by trees. The 2030 Comprehensive Plan shows wetlands encompassing much of the eastern half of the property. 3. Analysis of Request Staff finds the request to demolish the existing home and relocate the structure is reasonable. The property owner /applicant will follow all guidelines and meet all requirements and inspections for a new construction building permit, including zoning and setbacks, site -work, foundation, plumbing, mechanical, electrical and septic systems. The existing home will be demolished, razed, and removed before a building permit is issued. The home will not be moved -in until after seasonal road restrictions are removed in mid - late May. 4. Armbruster Topography and Wetland Waiver (city file no. 09 -011). An application has been received for a waiver from the topography and wetland requirements and was reviewed by the City Council on November 23, 2009. The City Council expressed concerns about the concept and directed the applicant to revise the concept plan. The applicant submitted a letter extending the review period until January 1, 2014. Staff recommends that no further extensions be provided. 2. Schmid's Hidden Valley 2 "d Addition Topography /Wetland Waiver, Preliminary Plat and Final Plat at 21820 Oakdale Drive (PID 04- 119 -23 -34 -0007, 04- 119 -23 -42 -0002 and 04- 119 -23 -42 -0003) (City File No. 12 -016). The application for topography and wetland delineation waiver was approved at the September 27th Council meetings. This item has been tentatively scheduled for Planning Commission public hearing on April 4t , Parks Commission review on April 23rd and Council action on April 25th 3. Site Plan and Variance for Maple Hill Estates Community Center) (City File 12 -022). The landowner and the City received a CDBG grant to construct a new community center on land north of the manufactured home park that is also owned by the park owner. This new building is in the process of being designed. The building is likely to straddle a lot line or at minimum require a setback variance. The survey has been completed and the site plan is currently being prepared. This item has been schedule for Planning Commission review on April 4tH and City Council action on April 25tH 4. Feasibility Study for Lennar (City File 12 -025). The applicant requested that the City conduct an infrastructure feasibility study regarding property west of CR 101 and north of Hackamore. This is part of the property that was previously proposed as the "Hedgestone" development. The applicant has provided an escrow and the City Engineer has begun work on feasibility study. The study is expected to be completed at the end of February /early March. Next steps would be completion of an EAW and PUD sketch plan, then a preliminary plat and PUD preliminary development plan and finally a final plat, PUD final development plan and rezoning to PUD. 5. Administrative Permit for Special Home Occupation for Jacob Shoulak at 20475 CR 10 (23 -119- 23 -23 -0007) (City File 12 -026). This application is to allow an in -home recording studio. The application is currently incomplete but when a complete application is received, it will be processed administratively. 6. Agriculture Preserve Initiation and Expiration for Beverly J. Patnode Trust at 22650 County Road 50 (19- 119 -23 -41 -0002) (City File 13 -001). The landowner was briefly out of the Agricultural Preserve program while a parcel was subdivided for Brian and Christina Patnode as MTP West Acres. The landowner is now reenrolling the farmstead in the Agricultural Preserve Program and initiating expiration (in 8 years). This is scheduled for the March 28th Council meeting. Heinz Second Addition Preliminary and Final Plat at 20801 CR 117 (03- 119 -23 -14 -0002) (City file 13 -003). A wetland and topographic waiver was approved on January 24th. This item has been tentatively scheduled for Planning Commission public hearing on April 4th, Parks Commission review on April 23rd and Council action on April 25th 8. Sprint Cell Tower Administrative Permit /Site Plan Modification at 23400 CR 10 (07- 119- 23 -43- 0006) (13 -004). This is an administrative approval to swap antennas on an existing tower. 9. Kohnen /Kothrade Minor CUP Amendment at 23240 CR 30 (07- 119 -23 -13 -0003) (City File 13 -005). This application has been received to resolve a code violation. Staff is reviewing the application as a minor CUP amendment as discussed at the October 11, 2012 City Council meeting and has tentatively scheduled this item for City Council action on April 25tH 10. Lano Equipment at 23580 Highway 55 Site Plan Amendment for Cold Storage. (31- 119- 23 -34- 0007) (13 -006). Staff is currently reviewing the application for completeness. Also, there are a number of projects that have been approved, but are still not filed and closed out: 1. Ess Addition (city files 05 -017, 08 -003 and 12 -024). The City Council granted an after - the -fact extension for this final plat at their November 29, 2012 meeting. The applicant is now working to file the required documents to close out this file. 2. Corcoran Business Park (city file 06 -005). The City Council granted a one year extension to the final plat approval, which expired on April 12, 2011. Staff has spoken to the applicant and is still working to close out this project. 3. Northern Natural Gas Administrative Permit (city file 09 -009). An administrative permit for a meter station was approved and is under construction. The city will retain the escrow account until the project is completed to ensure that the project is completed according to the plans. The majority of the improvements and conditions of approval have been met. However, the landscaping has not yet been installed. Northern Natural Gas indicates that there are still connections that need to be made on site and landscaping cannot be installed until completed. City staff was notified that the landscaping was installed on site and conducted an inspection June 3, 2011. The landscaping and all other improvements were installed per City requirements. Staff will begin the project closeout process after the landscape guarantee period expires in 2013. Satellite Industries Site Plan Amendment, Conditional Use Permit Amendment, Lot Consolidation and Easement Vacation (city file 10 -007). On September 23rd the City Council approved Resolutions 2010 -37, 2010 -38 and 2010 -39 approving the request with a number of conditions. The applicant has addressed those conditions and has submitted a building permit application and has begun site work. Staff inspected the site on October 12th and found that the major site improvements had been made, but there are several items that still have to be addressed. We have discussed these items with the landowner. The city has a financial guarantee in place to ensure completion. 5. Park Place Storage After - the -Fact Extension of Approvals (city file no. 10 -008). On September 23, 2010, the City Council approved a site plan and conditional use permit amendment for Park Place Storage to construct the 18th and final mini - storage building on that site. The approvals expired on September 23, 2011. The applicant contacted the City and requested a one year extension until September 23, 2012. The conditions have been met and a building permit was issued in September. The applicant has completed most of the site work with final items to be completed in the spring. 6. Rocks N Blocks Site Plan Amendment and Conditional Use Permit (city file no. 10 -012). An application was received for a Conditional Use Permit and Site Plan Amendment to continue operation of a business with outside storage at 20010 75th Avenue North. The application was approved by the City Council on June 23rd. This was approved as a way to correct a code enforcement issue. No work has been done on site to correct the code violations. The applicant has not yet complied with the conditions of approval and has asked for a 3 month extension. The approvals expired on September 23, 2012. The applicant is working to complete the site improvements. MEMORANDUM 7. Hope Ministries Conditional Use Permit for Cemetery and Vacation of Drainage & Utility Easement at 19951 Oswald Farm Road (city file 12 -002). Hope Ministries has submitted a request for a conditional use permit to allow a cemetery west of the existing church. The application was approved by the City Council on March 22nd and site work had begun. 8. Zoning Ordinance Amendment to Section 1070.020 regarding Conditional Use Permit Amendments (City file no. 12 -017). On October 11th, the City Council directed staff to prepare a zoning ordinance amendment to allow conditional use permit amendments to be processed administratively rather than through the public hearing process as currently required. This item was scheduled for a public hearing at the Planning Commission on December 6th. No action was taken because there was no quorum. We rescheduled this item for the February 7th Planning Commission meeting. The Council approved this amendment at the February 28th City Council meeting. 9. Topography and Wetland Waiver for Brent Heinz at 20801 CR 117 (03- 119 -23 -14 -0002) (City File 12 -027). This application was approved by the City Council on January 24th. 11. Site Plan Amendment for setback flexibility for Tech Ung at 6970 Oak Ridge Road (26- 119 -23- 44 -0005) (City File 12 -028). The ordinance allows the City Council to approve a setback of less than the required 100 feet adjacent to major roads when significant landscaping is provided.
