Corcoran Public Works Building "Roehlke Addition" Preliminary Plat and Rezoning from RR (Rural Residential) to PI (Public Institutional) zoning district (PID 18- 119 -23 -11 -0001) (city file no. 12 -010) i. Staff Report — City Planner Kendra Lindahl went over her staff report showing the overlay. • There was discussion amongst the chair and commissioners if this order was approved by council and if it would be brought back to the Planning Commission for a site plan. • Another topic brought up would future parks have to be re- zoned. • Hank concern to render options without knowing what materials building would be built of and type of building that would be built on site before making recommendations on the preliminary and if there were room for expansion. Topic was further discussed amongst commission. • Council member Milbrandt shared what council was discussing and stated they would get the opportunity to see the design of the building. Stated there could be the possibility of more parks and an option for a community park, • Ravnholdt shared he was chair on a previous commission in the past years reviewing other buildings and had made a presentation and had never heard back from anyone. He stated was not worried about what building looked like, the goal for this meeting was the Preliminary Plat. ii. Open Public Hearing - • Cindy Manns 9205 CO RD 19 - Concerns about the noise when staff was working at night and the drainage as to which way it will flow • Dorothy Theis — Stated currently living across the street from the public works building noise was not a problem. Consider a City- Initiated amendment to Zoning Ordinance Section 1070.020 regarding Conditional Use Permit Amendments (City file 12 -017) Application Request Consider this City- initiated amendment to Section 1070.020 of the Zoning Ordinance to allow a simplified process for approval of an amendment to an existing conditional use permit. 2. Background This item was originally scheduled for the December 6, 2012 Planning Commission. There was no quorum at that meeting; therefore, no action could be taken. The City Council directed staff to amend the zoning ordinance in response to a code enforcement issue. Since 2011, the city code enforcement officer has been working with a landowner, Linda Kohnen, to resolve a code violation at her property at 23240 County Road 30. The landowner is in violation of an existing conditional use permit and in violation of the City Zoning Ordinance. The landowner is leasing an accessory building on this residential property to a commercial business, Kothrade Sewer & Water for commercial storage. Commercial equipment is stored in this residential accessory building and employees of Kothrade Sewer and Water drive to the site each morning to pick up equipment for the day's work. It is staff's understanding that employee vehicles are then parked in the accessory building. a. This is in violation of the existing conditional use permit because the conditional use permit specifically states that the building was only for use by the homeowner and 6 specific pieces of his equipment. In 1996, the City issued a conditional use permit to operate a home occupation on this property for Steve Kohnen's truck operation (the city has since adopted a different process to address home occupations). The CUP specifically limits the use of the property to that home occupation in finding #3, which states: "That the applicants, their heirs and assigns, acknowledge and agree that the use of the accessory structure, within an R -1 Rural Residential District, is limited to residential and /or agricultural storage of equipment and restricts the use of said building from commercial storage with the exception of his business equipment which consists of a truck, low -boy, dozer, bobcat, traxcavator, backhoe." This is in violation of the existing zoning ordinance because the use of the building as commercial storage for a contractor is not allowed in this (TCR- Transitional Rural Commercial) zoning district. • Staff recommended several options to the landowner to allow her to continue to lease out this space. The landowner asked for an amendment to the existing conditional use permit. Staff agreed that this was a viable option. At the October 11, 2012 City Council meeting, staff recommended that the City Council consider amending Resolution 1996 -39. After reviewing the issue with the City Attorney, the City Planner and City Administrator, staff recommended the amendment by undertaking the following steps, which would preserve the spirit and intent of the CUP and the Zoning Ordinance and would allow the City to continue to consistently administer the City Code. Staff recommended that the City Council: a. Order staff to hold a public hearing to amend the Resolution and CUP. The Planning Commission will hold a public hearing and make a recommendation. The City Council will act on the amendment. b. Consider a change to the council adopted fee schedule. Currently there is a fee requirement of $550 and an escrow of $2,000 for a CUP. This does not fit our current situation. In this case, we are considering a slight language change in an existing CUP. Since there is no change in the use of the property or in the ownership of the property, the council should adopt a new fee that better fits a minor change to an existing CUP. I recommend perhaps $100 fee with a small escrow After discussion, the City Council felt that a better alternative would be to make a larger change that would allow a simplified process for all landowners to benefit from a new conditional use amendment process. Therefore, staff has drafted this proposed ordinance amendment. If approved, the landowner could apply for the Conditional Use Permit amendment through this simplified process. As a separate action item, the City Administrator will be preparing a new fee schedule for adoption in January, which will include a revised application fee for these types of conditional use permit amendments. 3. Analysis of Request A. Level of City Discretion in Decision - Making The City has a relatively high level of discretion in approving or denying an ordinance amendment. The proposed zoning amendment must be consistent with the City's Comprehensive Plan. The Zoning Ordinance is one of the enforcement tools used to implement the goals and standards set in the Comprehensive Plan. B. Consistency with Ordinance Standards It is our understanding that the intent of the Council is to allow the ability to allow minor amendments to Conditional Use Permits in circumstances where the impact of these changes on surrounding landowners will be minimal. Staff recommends the following changes to Section 1070.020 by deleting the StFiGken material and adding the underlined material as follows: Zoning Ordinance Amendment for CUPs February 7, 2013 ! • Subd.6. Amendments. A. Holders of a conditional use permit may propose amendments to the permit at any time, following the procedures for a new permit as set forth in this Section. B. No significant changes in the circumstances or scope of the permitted use shall be undertaken without approval of those changes by the City. The Zoning Administrator shall determine what constitutes significant change. Significant changes include, but are not limited to: 1. Hours of operation. 2. Number of employees. 3. Expansion of structures and /or premises. 4. Operational modifications resulting in increased external activities and traffic. C. Following the procedures for hearing and review set forth in this Section the Planning Commission may recommend and the City Council may approve significant changes and modifications to conditional use permits, including the application of additional or revised conditions. D. Minor changes to the conditional use permit, which do not include significant changes, shall require City Council action only. 4. Next Steps If the ordinance amendment is approved at the December City Council, the new process would be available for landowners immediately. 5. Recommendation If the Planning Commission finds that ordinance standards have been met, they should recommend approval of the following: a. Draft Ordinance approving ordinance amendment b. Site Plan approval for new public works facility on Lot 1, Block 1, Roehlke Addition. City File No. 12 -010 1. Application Request The City requesting site plan approval for a new 27,395- square foot public works facility on County Road 19. 2. Context Background On September 6, 2012, the Planning Commission held a public hearing to consider the requested rezoning and preliminary plat and recommended approval. On September 27, 2012, the City Council approved the preliminary plat, final plat and rezoning. The plat has been recorded at Hennepin County. Zoning and Land Use The subject property is guided Rural /Ag Residential on the 2030 Future Land Use Plan and zoned Rural Residential. The properties to the south, east and west are guided Rural /Ag and zoned Rural Residential. The property to the north is guided Rural Service /Commercial and is zoned Transitional Rural Commission. Natural Characteristics of the Site The 2030 Comprehensive Plan shows wetland areas scattered throughout the property and Rush Creek runs through the property and portions of the property are located in the Shoreland Overlay District. No impact to those areas is proposed. 3. Analysis of Request Staff has reviewed the application for consistency with Comprehensive Plan, Zoning Ordinance, Subdivision Ordinance and City Code requirements, as well as City policies. Level of City Discretion in Decision - Making The City's discretion in approving or denying a site plan is limited to whether or not the proposed request meets the standards outlined in the City Code. If it meets these standards, the City must approve the site plan. B. Consistency with Ordinance Standards Site Plan The applicant is proposing to construct a 27,395- square foot public works facility with associate outside storage on Lot 1, Block 1, Roehlke Addition. The property is located east of County Road 19, but an address has not yet been assigned. Access Access will be provided via a new curb cut on County Road 19. The new driveway is approximately 30 feet north of an existing field access. Permits will be required from Hennepin County prior to construction of the new driveway. There has been some preliminary discussion of extending this road to the east should the remainder of the Roehlke property east of this lot be acquired for a city park. This driveway could be upgraded for access to the park. The site plan has been designed to eliminate potential conflicts between the public works traffic and any future park traffic on the surrounding property. Staff recommends that the entrance drive be extended around the first island to provide access at the 2nd internal access if funds allow. This would allow trucks to leave the site directly from the vehicle storage facility. Screening /Landscaping Section 1060.070 of the Zoning Ordinance provides standards for landscaping. The ordinance requires 28 overstory trees and 92 shrubs based on the building square footage. The plans show 42 overstory trees and 69 shrubs. While the total number of shrubs is less than typically required by ordinance, the landscape plan exceeds ordinance requirements both in terms of total number and planting size of the overstory trees. The landscaping is well placed around the perimeter of the site to screen the parking and storage areas from surrounding uses. Staff finds that the proposed landscaping plan meets the ordinance requirements. Utilities The property is currently serviced by well and septic. The drainfield and well locations is shown on the plans. The well is proposed off the northwest corner of the building and the septic is located off the southwest corner of the parking lot. The well must be permitted by the State of Minnesota and the septic must be approved by Hennepin County Environmental Services. Staff has included both of these items as conditions of approval. City of Corcoran Public Works Facility Site Plan (City File 12 -010) February 7, 2013 • r Wetlands • • The wetland delineation was approved by Elm Creek Watershed Management Commission. No impact to the wetlands are proposed. This is a medium quality wetland and Section 1050.010 of the zoning ordinance requires an average wetland buffer of 25 feet (10 -foot min /20 -foot max.) and a structure setback of 15 feet from the buffer or a parking setback of 5 feet from the buffer. These buffers are required to be installed when the property is platted. Wetland buffer monuments must be installed prior to issuance of building permit. This has been included as a condition of approval. Sheet A0.1 of the plans notes "Seeding of Wetland Buffer Area should be provided as prescribed in the City of Corcoran Zoning Code, Section 1050.010.8.0 Parts 1 -11 ", but this work is not specifically noted on the plan drawings. Staff has included a condition that additional information be provided prior to completion to ensure compliance. Shoreland Overlay District The site plan is in compliance with all ordinance requirements. Section 1050.020 of the zoning ordinance notes that the property within 300 feet of the creek is located in the Shoreland Overlay District as required by State Law. The ordinance requires a 25 -foot shoreland buffer and monument signs. The city allows the wetland buffer monument signs to be used to delineate this buffer. The shoreland buffer and signs are shown on the plans. The buffer monuments must be installed prior to issuance of building permit. Grading The site uses both overland sheet drainage and a catch basin and pipe system to convey stormwater to a new treatment pond south of the new building before discharging into the wetland. Curb is proposed as ribbon curb around most of the parking lot area and islands but some areas appear to have bituminous edge with no ribbon curb. We have included a condition requiring the City Engineer to approve the parking lot edge prior to building permit issuance. We have also included a condition requiring that the comments in the January 31, 2013 memo from the City Engineer be addressed to his satisfaction. Elm Creek Watershed Management Commission ( ECWMC) must review the plans for compliance with the rules. The application has not yet been submitted to ECWMC and this has been included as a condition of approval. Architecture The building will be a mix of precast concrete wall panel, EIFS and prefinished metal. The trash enclosure is attached to the south wall and is finished with rock face block. The mix of building materials complies with ordinance requirements. City of Corcoran Public Works Facility Site Plan (City File 12 -010) February 7, 2013 • f • The plans also show relocation of the salt and sand building from the existing facility to this site on the western edge of the storage yard south of the new building. The facility must be designed to prohibit runoff into the nearby wetland and creek. Site Lighting Both building and parking lot lighting are proposed. They comply with the City's cutoff and foot candle requirements. The ordinance states "The height of a freestanding luminaire shall not exceed 30 feet or extend above the roof line of the principal building, whichever is less." The light standards are 28 feet tall, which complies with these requirements. Signage Wall signage is the only signage proposed. The proposed sign is located on the north elevation and consists of prefinished 16" tall aluminum letters with linear light fixtures with down lighting to illuminate the signage. The ordinance allows one wall sign with a maximum wall sign area of 32 square feet. 4. Conclusions Staff finds that the standards for site plan approval have been met or can be addressed with the changes discussed in the staff report. We have included conditions in the draft resolution to address these issues. 5. Recommendation Staff recommends that the Planning Commission recommend approval of the draft resolution approving the site plan amendment. Attachments 1. Resolution approving Site Plan 2. Plans dated January 18, 2013 City of Corcoran Public Works Facility Site Plan (City File 12 -010) February 7, 2013 City of Corcoran County of Hennepin State of Minnesota RESOLUTION NO. 2013- Motion By: Seconded By: February xx, 2013 APPROVAL OF A SITE PLAN FOR THE CITY OF CORCORAN PUBLIC WORKS FACILITY ON COUNTY ROAD 19 WHEREAS, the landowner has requested approval of a site plan to allow construction of a 27,395- square foot public works facility and associated site improvements on property legally described as follows: Lot I, Block 1, Roehlke Addition, Hennepin County, Minnesota WHEREAS, the Planning Commission has reviewed the site plan at a duly called public meeting and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request for a site plan, subject to the following conditions: 1. Site plan approval is granted to allow a 27,395- square foot building and associated site improvements including a storage yard and salt /sand shed, in accordance with the plans received by the City on January 18, 2013, except as amended by this resolution. 2. Prior to issuance of building permits, the applicant/landowner must: a. Record the approving resolution at Hennepin County and provide proof of recording to the City. b. The applicant must comply with all conditions of plat approval in Resolution 2012 -55 and 2012 -56. c. The applicant shall comply with all comment from the January 30, 2013 memo from the Fire Chief. d. The applicant shall receive approval from Elm Creek Watershed Management Commission for the stormwater management plan as noted in the January 30, 2013 memo. e. The applicant shall address all conditions in the January 31, 2013 memo from the City Engineer. f. The City Engineer must approve the parking lot curbing or other method of edging. g. Wetland and Shoreland buffer monument signs must be installed according to plan. h. Electronic files of the plans shall be submitted to the City in AutoCAD format. 3. Three Rivers small satellite bathroom and parking has been discussed in concept to the north, but will be reviewed when plans are finalized. CR 19 Access and Site Entrance The site plan has been provided to the County to determine if turn lanes are necessary. A decision is expected soon. A turn lane would require modification along CR 19 but not affect the site itself. Traffic to the site will turn south into the site and therefore islands are shown on the north edge and will be constructed should the road be extended west. City Engineer recommends considering extending the access road to the east to the 2" entrance if construction funds are available. This will allow heavy truck traffic to leave the facility directly north from the vehicle storage facility. Stormwater Elm Creek Watershed will review the stormwater for compliance with rules. The site utilizes both overland sheet flow and catch basin and pipe to convey stormwater to the south pond before discharging to the site's wetlands. Curb is proposed as ribbon curb which creates a flat concrete edge to the bituminous. Some areas appear to have a bituminous edge without the ribbon curb. The sheet flow of stormwater off the pavement is a benefit for treatment over a pipe, however will require additional attention during construction and vegetation establishment for small point locations of erosion and gullying. The volume of flow to the north should be carefully documented as similar to current conditions to prevent impacting farmland to the north. Well and Septic The well is shown near the office facility in greenspace, and the location could be modified slightly during installation. The septic area is currently fenced off and will protected from compaction by construction vehicles. Material Storage The south portion of the site will be used for material storage and the stormwater sheet flow will be managed to prevent flow through any stockpiles or salt /sand areas. From: James. Armbruster Topography and Wetland Waiver (city file no. 09 -011). An application has been received for a waiver from the topography and wetland requirements and was reviewed by the City Council on November 23, 2009. The City Council expressed concerns about the concept and directed the applicant to revise the concept plan. The applicant submitted a letter extending the review period until January 1, 2014. Staff recommends that no further extensions be provided. 2. Schmid's Hidden Valley 2 "d Addition Topography /Wetland Waiver, Preliminary Plat and Final Plat at 21820 Oakdale Drive (PID 04- 119 -23 -34 -0007, 04- 119 -23 -42 -0002 and 04- 119 -23 -42 -0003) (City File No. 12 -016). The application for topography and wetland delineation waiver was approved at the September 27th Council meeting. The plat applications are incomplete. 3. Corcoran Public Works Site Plan Approvals (City File 12 -010). The City application for a preliminary and final plat to create a new lot for the public works facility and an outlot for the remaining land that will be retained by the Roehlke's and a rezoning to Public /Institutional (P -1) to accommodate this use was approved by the City Council on September 27th. The city closed on the property on October 15th and work is continuing on the site plan design. Site Plan review is scheduled for the Planning Commission on February 71H and City Council approval on February 14tH 4. Zoning Ordinance Amendment to Section 1070.020 regarding Conditional Use Permit Amendments (City file no. 12 -017). On October 11th, the City Council directed staff to prepare a zoning ordinance amendment to allow conditional use permit amendments to be processed administratively rather than through the public hearing process as currently required. This item was scheduled for a public hearing at the Planning Commission on December 6th. No action was taken because there was no quorum. We rescheduled this item for the February 7th Planning Commission meeting and February 28th City Council meeting. 5. Site Plan and Variance for Maple Hill Estates Community Center) (City File 12 -022). The landowner and the City received a CDBG grant to construct a new community center on land north of the manufactured home park that is also owned by the park owner. This new building is in the process of being designed. The building is likely to straddle a lot line or at minimum require a setback variance. No survey had been completed. The Council should review the City Administrator's memo at the January 24th meeting. This item could be scheduled for April or May Planning Commission and City Council review. The applicant requested that the City conduct an infrastructure feasibility study regarding property west of CR 101 and north of Hackamore. This is part of the property that was previously proposed as the "Hedgestone" development. The applicant has provided an escrow and the City Engineer has begun work on feasibility study. The study is expected to be completed at the end of February. Next steps would be completion of an EAW and PUD sketch plan, then a preliminary plat and PUD preliminary development plan and finally a final plat, PUD final development plan and rezoning to PUD. 7. Administrative Permit for Special Home Occupation for Jacob Shoulak at 20475 CR 10 (23 -119- 23 -23 -0007) (City File 12 -026). This application is to allow an in -home recording studio. The application is currently incomplete but when a complete application is received, it will be processed administratively. 8. Topography and Wetland Waiver for Brent Heinz at 20801 CR 117 (03- 119 -23 -14 -0002) (City File 12 -027). This application is scheduled for City Council review on January 24th. 9. Site Plan Amendment for setback flexibility for Tech Ung at 6970 Oak Ridge Road (26- 119 -23- 44 -0005) (City File 12 -028). The ordinance allows the City Council to approve a setback of less than the required 100 feet adjacent to major roads when significant landscaping is provided. This item is scheduled for City Council review on January 24tH 10. Agriculture Preserve Initiation and Expiration for Beverly J. Patnode Trust at 22650 County Road 50 (19- 119 -23 -41 -0002) (City File 13 -001). The landowner was briefly out of the Agricultural Preserve program while a parcel was subdivided for Brian and Christina Patnode as MTP West Acres. The landowner is now reenrolling the farmstead in the Agricultural Preserve Program and initiating expiration (in 8 years). Also, there are a number of projects that have been approved, but are still not filed and closed out: 1. Ess Addition (city files 05 -017, 08 -003 and 12 -024). The City Council granted an after - the -fact extension for this final plat at their November 29, 2012 meeting. The applicant is now working to file the required documents to close out this file. 2. Corcoran Business Park (city file 06 -005). The City Council granted a one year extension to the final plat approval, which expired on April 12, 2011. Staff has spoken to the applicant and is still working to close out this project. 3. Northern Natural Gas Administrative Permit (city file 09 -009). An administrative permit for a meter station was approved and is under construction. The city will retain the escrow account until the project is completed to ensure that the project is completed according to the plans. The majority of the improvements and conditions of approval have been met. However, the landscaping has not yet been installed. Northern Natural Gas indicates that there are still connections that need to be made on site and landscaping cannot be installed until completed. City staff was notified that the landscaping was installed on site and conducted an inspection June 3, 2011. The landscaping and all other improvements were installed per City requirements. Staff will begin the project closeout process after the landscape guarantee period expires in 2013. 4. Satellite Industries Site Plan Amendment, Conditional Use Permit Amendment, Lot Consolidation and Easement Vacation (city file 10 -007). On September 23rd the City Council approved Resolutions 2010 -37, 2010 -38 and 2010 -39 approving the request with a number of conditions. The applicant has addressed those conditions and has submitted a building permit application and has begun site work. Staff inspected the site on October 12th and found that the major site improvements had been made, but there are several items that still have to be addressed. We have discussed these items with the landowner. The city has a financial guarantee in place to ensure completion. MEMORANDUM 5. Park Place Storage After- the -Fact Extension of Approvals (city file no. 10 -008). On September 23, 2010, the City Council approved a site plan and conditional use permit amendment for Park Place Storage to construct the 18th and final mini - storage building on that site. The approvals expired on September 23, 2011. The applicant contacted the City and requested a one year extension until September 23, 2012. The conditions have been met and a building permit was issued in September. The applicant has completed most of the site work with final items to be completed in the spring. 6. Rocks N Blocks Site Plan Amendment and Conditional Use Permit (city file no. 10 -012). An application was received for a Conditional Use Permit and Site Plan Amendment to continue operation of a business with outside storage at 20010 75th Avenue North. The application was approved by the City Council on June 23rd. This was approved as a way to correct a code enforcement issue. No work has been done on site to correct the code violations. The applicant has not yet complied with the conditions of approval and has asked for a 3 month extension. The approvals expired on September 23, 2012. The applicant is working to complete the site improvements. 7. Hope Ministries Conditional Use Permit for Cemetery and Vacation of Drainage & Utility Easement at 19951 Oswald Farm Road (city file 12 -002). Hope Ministries has submitted a request for a conditional use permit to allow a cemetery west of the existing church. The application was approved by the City Council on March 22nd and site work had begun. MEMORANDUM
