HomeMy WebLinkAboutResolution 2009-58 Final Plat ExtensionCITY OF CORCORAN RESOLUTION 2009 -58 Motion By:%Y]1/ Seconded By: i45 A RESOLUTION APPROVING FINAL PLAT EXTENSION AND AMENDMENT OF FINAL PLAT CONDITIONS FOR "SAVOIE FIELDS" FOR THE PROPERTY LOCATED AT 21801 HOMESTEAD TRAIL (PID 28- 119 -23 -43 -0007) WHEREAS, Terry and Karen Savoie have requested and received approval of a final plat to create 2 Tots on property legally described as follows: The West '/2 of the Northeast 1/4 of the Southwest '/ of the Southeast 1/ of Section 28, Township 119 North, Range 23 West of the 5th Principal Meridian, Hennepin County, Minnesota; and The South 1/2 of the North '/2 of the East'/ of the Southwest'/ of the Southeast % of the Southeast'/ of Section 28, Township 119 North, Range 23 West of the 5th Principal Meridian, Hennepin County, Minnesota; and The East 1/2 of the West I/2 of the Southwest'/ of the Southeast'/ of Section 28, Township 119 North, Range 23 West of the 5`h Principal Meridian, Hennepin County, Minnesota WHEREAS, the final plat was approved by the City Council on January 28, 2008 with 8 conditions of approval in Resolution 2008 -07; WHEREAS, the final plat approvals shall expire on January 28, 2010, WHEREAS, the applicant has requested a 1 year extension to the final plat approvals as allowed by Section 935.010, Subd. 7 of the City; WHEREAS, the approvals included a condition requiring a letter of credit for a transportation area charge, but the City never formally adopted a transportation area charge and, therefore, the applicant is requesting that this condition be removed; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request for an extension to the final plat approvals and hereby amends the conditions of approval in Resolution 2008 -07 as follows: Resolution 2009 -58 Page 2 1. A final plat is approved to allow the creation of Lots 1 and 2, Block 1 in accordance with the plans and application received by the City on December 11, 2007 , except as amended by this resolution. 2. There are zero (0) building entitlements remaining for future development on Lots 1 and 2, Block 1, Savoie Fields. 3. All conditions of the preliminary plat must be met. 4. The applicant shall comply with all comments received from Bonestroo, the Elm Creek Water Management Commission, and the Hennepin County Human Services Department. 5. Prior to release of the final plat, the Developers shall pay Park Dedication fees for the one (1) lot, subject to the park dedication requirements at the time of the release of the final plat for filing. Currently the "cash" donation would total $6,000. 6. The applicant must file the final plat at Hennepin County. 7. The existing garage along the south line of Lot 1, which encroaches upon the dedicated drainage and utility easement, is a non - conforming structure and subject to partial or complete demolition without compensation if necessary to effectuate the use of the aforesaid easement. NOW, THEREFORE, BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, the final plat approvals granted on January 28, 2008 by Resolution 2008 -07 shall be extended by 1 additional year and shall now expire on January 28, 2011 unless the applicant has complied with the conditions of approval, recorded the final plat at Hennepin County and provided the City of Corcoran with proof of recording.
