HomeMy WebLinkAboutResolution 2009-35 Approving Corcoran Lions Final PUDCITY OF CORCORAN RESOLUTION NO. 2009-35 Motion By: Milbrar�dt Seconded By: Hudok A RESOLUTION APPROVING A�INAL PUD {PLANNED UNIT DEVELOPMENT) PLAN �OR CORCORAN LIONS AND CORCORAN LIONS FOUNDATION FQR PROPERTY LOCATED WEST OF COUNTY ROAD 101 AND S�UTH OF COUNTY ROAD 10 (PID 25-119-23-41-0001 AND 25-119-23-44-0005) WHEREAS, the Carcoran Lions and the Corcoran Lions Foundation ha�� requested approval of a final PUD development plan for property f�gally described as follows: All thaf part of the easf half of the northeast quarter of the southeast quarfer of Section 25, Township 119 Norfh, Range 23 West of the Frfth Principal Meridian, Iying south of the Minneapolis and Monticello Raad And That part of the east half of fhe sautheast quar�er af the southeast quarter of Section ,25, Township 9?9 North, Range 23 Wesf of fhe Fifth Principal Meridian, Iying north of the south 20Q feef fhereof Hennepin County, Minnesota Absfract Property WHEREAS, the Planning Commissian has re�iewed the request at a duiy callecf Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT H�REBY RES�LVE� BY THE CITY CQUNC��. OF THE ClTY OF CORCORAN, MINNESOTA, that it should and hereby does apprave the requ�st by Carcoran Lions and Corcoran Lions Foundation for a final PUD development plan, s�bject to the foflawing conditions: 1. A final PUD de�elopment plan is approved to allow de�elopment, in accardance with the plans and application received by the City on April 21, 2009 and the re�isions received on August 4, 2009, except as am�nded by Yhis resolution. 2. Dev�loprnent standarcls for t�e PUD shall be as indicated on the plans ar�d application received on April 21, 2009 and th� supplemental information pravided by the applicant, including and the revisions received on August 4, 2009, except as amended by this resolution. 3. PUD flexibility is granted to allow: a. Reduced front yard setbacks for fencing and vehicle storage as shown on t�e plans, b. Seasonal motor vehicf� on the existing gravel and landscaped areas rather than an an improved surface Resoiution 20b9-35 Page 2 4. The allowed uses shall include: a. Sporting �vents b. Festivals, carnivals and fairs c. Motor cross, derr�o derby and car shows d. Animal and livestack exhibits e. Haunted House fi, Open air cancerts g. Dances h. Similar events far locai organizatians such as 4-H or other pri�ate organizations i. Other uses similar to the above listed enfiertainmentlrecreationa! uses j. Associatec� accessory uses, such as event parking and food sales k. Temporary outside vehicl� storage (November 9-March 31 each year) accessary to the principal recreationlentertainment uses of Lions Park by th� Corcoran Lions and Carcoran Lions Foundation. 5. Any change to the listed uses shall require a PUD Amendment. 6. Approval is contingent upon City Council approval of the requested rezoning to PUD and preliminary PUD development plan. 7. The applicant shall comply with al� condi#ior�s in resolution approving the preliminary PUD develapment plan. 8. Prior fo th� issuance af builcling permits or the City amending the zoning map to reflect the PUD, the applican# shall past a perforrrEance bond ar irrevacabie I�t�er of credit with the City Clerk to insure that the de�elopment will be executed ir� performance with the approved final PUD development plan. 9. Construction of all improvements must b� commenced within one year of approval of the PUD rezaning unless the applicant requests and is gra�ted an extension by tl�e City Council.
