HomeMy WebLinkAboutResolution 2009-36 Approving Accessory Structure and Dwelling - HallCITY OF CORC�RAN RESOLUTION 2009-36 Motion By: Gmach Seconded By: Thomas A RESOLUTION APPROVING AN INTERIM USE PERMIT AND VARIANCES FOR ACCESSORY STRUCTURE WITH ACCESSORY DWELLING UNfT AT � 9510 HACKAMORE ROAD (36-1 � 9-23-24-0017} WHEREAS, Sharon Hall has requested approval of an interim use permit and variances to allow construction of ar� accessory building with acc�ssary dwelling unit on property legally described as follaws: Lot 5, Block 2, Hedtkes Hackamore Homesites WHEREAS, the Planning Commission has reviewed the in#erim use permit and variances at a dufy called Public Hearing and recommends appro�al, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY C�UNCIL OF THE GITY OF CORCORAN, MINNE54TA, that it should and her�by does appra�e the request by interim use permit and variances, subject to the fol�owing conditions: A interim use permit to alfow an accessory dwelling unit is appro�ed, in accordance with the plans received by the City on May 19, 2009, �xcept as amended by this resolution. 2. The Interim Use Perrrtit and Variances are apprn�ed based on the finding that approva� is necessary to provide reasonable accommodation under t�e Fair Housing Aci. 3. The following variances are approved: a, Variance from Section 1030.02p, Subd. 2(F), to allow a new building and existing buildings as shown on the plans, wF�ich exceeds ihe maximum square footage allowed by ordinance. b. Variance from the requiremen� that the accessory buifding be constructed identical roof and siding as the principal structure c. Variance to allow construction of a building with a total heigni of approximatefy 25 feet where 13'9" high sidewa(Is ar� permitted. d. To allow a non-owner (Scott Reimann) to reside in ihe principal structure. 4. The plans must be revised to show how well and septic service will be provided ta the acc�ssory dwelli�g unit. 5. Priar to issuance of a building permit, the applicant must obtain approval from Hennepin County Pt�blic Health for fihe praposed well and septic ta ser�ice th� accessory dwelling unit. Resolution 20d9-36 Page 2 a. Appra�al is contingent upon compliance with any and all canditions from Hennepin County. b. A copy of the Hennepin Caunty approva! must be provided to the city. 6. Na tree removal is proposed fior construction of tf�e accessory dweEling unit. 7. The plans must be re�ised ta show how dri�eway acc�ss wil! be provided to the new accessory building in compfiance with the Zoning Ordinance standards. 8. The new home will be constructed to match the materials of the accessary building. 9. The attached garage praposed for the future new home shall not exceed a maximum square footage of �,000. 10. The applicant shall comply with all canditions in the City Engineer's letier dated June 30, 2009. 11. The accessory dwelling unit shall be assigned a separate address from the principal structure ancf the property address must be disp�ayed on th� building. 12. The req�irement that fh� owner of th� proper�y shall reside in the principal dwelling unit or in the accessory dwefling unit is waived for this req�est to allow Scott Reimann and his family ta iive in the principal structure as part of the �air Housing Act accommodafion. 9 3. The interim use permi� shall expire if the principal use of the property changes or the ownership of either the property changes, except that the current property owners, Sharon and Steven Hall, may sell the pr4perty to Scott Reimann without triggering this clause. Any other change i� ownership or use shall cause the interim use permit to expire. 14. The interim use permit shal� be issued far 3 years ir� accordar�ce with the procedures outlfned in Section 1070.03Q of the Zoning Ordinance. The permit shall be administratively re�iewed every 3 years to ensure compfiance with conditions of approval and ordinance requirements for accessory dwelling units.
