HomeMy WebLinkAboutResolution 2013-19 - Maple Hill Community Center Site Plan and VarianceCity of Corcoran County of Hennepin State of Minnesota RESOLUTION NO. 2013 -19 Motion By: Asleson Seconded By: Thomas April 25, 2013 APPROVAL OF A SITE PLAN AND VARIANCE FOR THE CITY OF CORCORAN FOR A COMMUNITY CENTER AT MAPLE HILL ESTATES ON LOT 1, BLOCK 1, MAPLE HILL ESTATES 2ND ADDITION (PID 24- 119 -23 -43 -0014) WHEREAS, the City of Corcoran is requesting approval of a site plan and setback variance to allow construction of a 3,500- square foot community center and associated site improvements on property legally described as follows: Lot I, Block 1, Maple Hill Estates 2nd Addition, Hennepin County, Minnesota WHEREAS, the Planning Commission has reviewed the site plan variance at a duly called public meeting and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request for a site plan, subject to the following conditions: Site plan approval is granted to allow an approximately 3,500- square foot building and associated site improvements, in accordance with the plans received by the City on March 21, 2013, except as amended by this resolution. 2. A variance to allow a 1 -foot side yard setback (south) where 25 feet is required is approved, subject to the following findings: a. There are practical difficulties to meeting the standard setback due to the City's previous action to retain vacated right -of -way as an outlot rather a more typical easement. This creates an arbitrary lot line that separates the manufactured home park from the land upon which the structure is proposed to be built. b. The conditions upon which the variance request are based are unique to this parcel due to the City's previous action to retain vacated right -of -way as an outlot rather a more typical easement. Granting the variance will not alter the essential character of the locality. In fact, the adjacent basketball court straddles the lot and it appears that the storm shelter to the west may also straddle the lot line. d. The proposed variance would be in harmony with the general purpose and intent of the ordinance and would allow for an easily accessible community center in a location near other community facilities including the playground, basketball court and storm shelter. e. The City may impose conditions on the variance to address the impact of the variance. However, in this case, the conditions related to the site development standards are adequate to address concerns. 3. Prior to issuance of building permits, the applicant /landowner must: a. Record the approving resolution at Hennepin County and provide proof of recording to the City. b. The applicant shall comply with all comments from the March 26, 2013 memo from the City Engineer. c. If the site lighting (either on the building or freestanding) is proposed, it must comply with Section 1060.040 of the Zoning Ordinance. d. The building must be designed to comply with the residential building standards in 1060.050, Subd. 1(B). e. The applicant shall obtain septic approval from the State and provide a copy of the approval to the City. f. The applicant shall obtain appropriate well permits and provide a copy of the approval to the City. 4. Approval shall expire within commences the authorized use.
