Present were, Mayor Guenthner, Councilor Asleson, Councilor Cassette, Councilor Gmach, and Councilor Milbrandt. Also present were City Administrator Donahue, City Attorney Carson, City Engineer Torve, City Planner Lindahl, Public Works Superintendent Meister, Public Safety Director Gormley, and City Clerk Heinecke. Mayor Guenthner called the regular meeting to order at 7:00 pm. 1. Call to Order/ Roll Call 2. Pledge of Allegiance 3. Open Forum Chad Robran 19805 Olde Sturbridge Dr., Reported on the success of the 2012 Corcoran Country Daze Festival. Thanked Public Works department and Public Safety department for their hard work and support. (Motion carried 5:0) e. Shared Driveway Issues, 229XX County Rd 50 — City Attorney Carson advised council of the shared driveway situation. Attorney Carson does not recommend city involvement in the resolution of this situation. Dale Haglund 22966 Co Rd 50, spoke to the council about the history of the driveway. Mr. Haglund asked the city to review the original agreement for viability by today's standards with hopes of ratifying the original agreement. Tim Kreps 22956 Co Rd 50, purchased the property in February 2012. A goat path is being used as the driveway. Mr. Kreps suggested the city is not treating landowners fairly because things slipped through the cracks. Mayor Guenthner directed the city engineer to review the driveway agreement against today's standards. David Foy 8115 Cc Rd 116, Mr. Foy was involved in the sale of property. The title company he dealt with is washing their hands of the issue and suggests all should accept the used driveway and file that in court. No permits should have been issued until the road was approved. Would the city for the benefit of safety and access fix this? Staff was directed to research the city's position and come back to the council. Mayor Guenthner recessed the meeting at 7:48 to reconvene in closed session Mayor Guenthner reconvened the open meeting at 8:08 7. Closed Meeting a. To consider Sewer and Water easement offers Council authorized the city attorney to continue the negotiation's with property owners. 8. Engineering 1 Wenck a. Trail Haven Street Improvement Analysis presented by City Engineer Torve. Council discussed and listened to several property owners. Staff was directed to prepare an information letter of preliminary findings for property owners and obtain a professional opinion related to assessment of the potential project. 9. PW Facility L Discussion on Preliminary Design and Construction Options of Public Works Facility — no action taken. c. 2012 -13 Equipment CIP MOTION: made by Milbrandt, seconded by Asleson to approve 2012 -2013 Equipment CIP at $350,205 with the intent to reimburse the General Fund upon sale of a certificate of indebtedness.
