APPROVING FINAL PLAT FOR "MTP WEST ACRES" ON PROPERTY LOCATED AT 23240
COUNTY ROAD 50 (PID 19-119-23-41-0001)
WHEREAS, Brian and Christina Patnode have requested approval of a preliminary plat to allow
subdivision of the 79.84 -acre parcel legally described as:
East half of the southeast quarter of Section 19, Township 119, Range 23, Hennepin
County, Minnesota
WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public
Hearing and recommends approval, and;
WHEREAS, the City Council reviewed and approved the submitted preliminary and final plat at
the May 24, 2012 meeting;
WHEREAS, the applicant is now requesting a modification of the approved plat
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORCORAN, MINNESOTA, that it should and hereby does approve the request for a final plat
for MTP West Acres and,
1. This resolution replaces Resolution 2012 -26.
2. A final plat is approved to create 2 lots for MTP West Acres, in accordance with the
plans received by the City on September 11, 2012, except as amended by this
resolution.
3 There are 7 development rights remaining on Lot 2, Block 1 and zero building rights
remaining on Lot 1, Block 1. Dedication of the required County Road 50 right -of -way
shall be addressed should Lot 2 be further subdivided.
4. Approval is contingent upon City Council approval of the preliminary plat.
FURTHER, that the following conditions be met prior to release of the final plat and associated
documents for recording:
5. Park dedication is due for the new Lot 1, Block 1 parcel, Park dedication for Lot 2,
Blockl has been previously satisfied, however, further subdivision of this parcel will be
subject to park dedication requirements.
a. The City will require cash in lieu of land for this parcel, subject to the park dedication
requirements in place at the time the plat is released for filing.
b. Park dedication for Lot 1, Block 1 shall be paid prior to release of the final plat for
filing.

6. The applicant shall prepare a driveway easement agreement.
a. The document shall be submitted for review and approval by the City Attorney.
b. The document shall be recorded with the final plat.
FURTHER, that the following conditions be met prior to release of any remaining escrow
balance:
7. The applicant shall provide the approved preliminary and final plat drawings to the City in
an electronic {AutoCAD} format,
8. The applicant must file the final plat at Hennepin County within 2 years of the date of
approval or the approval shall expire.
9. The applicant shall provide proof of recording the final plat, resolutions and driveway
easement agreement at Hennepin County.
