SCHMID FOR °SCHMIDYS MOTOR CITY, INC." AT 6334 ROLLING HILLS ROAD (33- 119 -23 -33 -0001) WHEREAS, Steven J. Schmid has requested approval of a Conditional Home Occupation License to operate his auto repair business in a detached accessory building at 6334 Rolling Hills Road; WHEREAS, the Planning Commission has reviewed the Conditional Home Occupation License at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request by Conditional Home Occupation License, subject to the following conditions: 1. A Conditional Home Occupation License is approved to allow an auto repair business, "Schmidys Motor City, Inc. ", to operate in a detached accessory building, in accordance with the application and plans received by the City on April 13, 2012, except as amended by this resolution. 2. The Conditional Home Occupation. License is issued to Steven J. Schmid at 6334 Rolling Hills Road for the operation of an auto repair business d.b.a. "Schmidys Motor City, Inc. ". This permit is non - transferable. If the business ceases, if ownership of the business changes, or if the individual to whom a license has been issued ceases to own the subject premises, the CHOL is automatically revoked 3. The Conditional Home Occupation License is approved based on the finding that the standards in Section 1030.100, Subd. 7 have been met. Specifically: a. The applicant is requesting the conditional home occupation license to operate his auto repair business in a detached accessory structure. The proposed use will be screened from the public street and the auto repair will be conducted inside the building. There will be minimal impact on neighboring property owners because the business will be operated in compliance with the ordinance requirements, there will be no outside storage of materials. b. The detached accessory building is a non - conforming building. Approval of the CHOL would have no impact on the non- conforming building status related to setbacks. There is nothing to indicate that the proposed use would devalue adjacent and surrounding properties. C. The auto repair equipment would be located inside the building and would not generate noise beyond state standards. There are no environmental concerns, including but not limited to drainage, wastewater, wells and wetland issues related to this project. e. The detached accessory building where the business will be located appears to be a non - conforming structure due to setbacks. The building extends over the north property line. Staff reviewed this issue with the city attorney and he opines that the location of the non - conforming structure should have no impact on the CHOL review. f. The home occupation appears to have minimal impact on neighboring properties. 4. No business signage is allowed. No outside storage of materials related to the home occupation is allowed. All vehicles awaiting repair shall be kept within the accessory structure or parked on an improved parking surface and screened from public view. 6. No employees, other than those who reside in the home, shall be permitted. 7. The applicant shall abide by and remain in compliance with all applicable Federal, State and City rules and regulations. 8. Vehicles must be picked up and delivered by the operator. No customer visits are allowed on site. 9. A building inspection must be completed by the City prior to beginning operation of the Home Occupation in the detached accessory building to ensure compliance with all City building code requirements, except, no restroom is required because there are no customers visiting the site. 10. The Conditional Home Occupation License shall be issued for 3 years in accordance with the procedures outlined in Section 1030.100 of the Zoning Ordinance. The permit shall be administratively reviewed every 3 years to ensure compliance with conditions of approval and ordinance requirements. 11. The City may revoke or modify the CHOL upon a finding that conditions have changed to warrant revocation or modifications of the license.
