Council Action 5 STAFF REPORT Agenda Item: 7.a Council Meeting: July 7, 2026 Prepared By: Seth Gellman. Community Development Administrative Assistant, Natalie Davis McKeown, Community Development Director Topic: Lost Loon Site Plan & Variance Action Required: Summary The applicant, Dan Sjobolm, requests approval of a Site Plan, Interim Use Permit (IUP), and Variance on behalf of Lost Loon LLC, a proposed cannabis cultivator, at 20120 Auger Ave. Council Action Attachments 1. 2026-07-02 Lost Loon SP, IUP, VAR.pdf 6 Page 1 of 19 STAFF REPORT Planning Commission Meeting: July 7, 2026 Prepared By: Natalie Davis McKeown Topic: Lost Loon Site Plan, Interim Use Permit, and Variance (PID 26-119-23-12-0013) (City File No. 26-012) Action Required: Recommendation Review Deadline: August 8, 2026 1. Application Request The applicant, Dan Sjobolm, requests approval of a Site Plan, Interim Use Permit (IUP), and Variance on behalf of Lost Loon LLC, a proposed cannabis cultivator, at 20120 Auger Ave. 2. Prior Review A concept plan for this application was reviewed by City Coun on March 26, 2026. Feedback was provided to the applicant as they considered their options to move forward with a formal application. 3. Context Zoning and Land Use The site consists of a 2.12-acre parcel. The property is zoned Light Industrial (I-1), guided Light Industrial, and is located within the Southeast District of the Metropolitan Urban Service Area (MUSA). The site is currently vacant. Surrounding Properties The guiding, zoning, and existing use of the surrounding properties are detailed in the table below. All surrounding properties are within the Metropolitan Urban Service Area (MUSA). Direction Guided Zoning District Use Figure 1 Site Location 7 Page 2 of 19 North Light Industrial I-1 Medical Device Company East Light Industrial I-1 Clothes Manufacturer South Light Industrial I-1 Contractor West Light Industrial I-1 Vacant; Agriculture Natural Characteristics of the Site The 2040 Comprehensive Plan Natural Resources Inventory Areas Map identifies an unnamed creek that is a tributary stream of South Fork Rush Creek. This stream runs near the western boundary of the site and is to the east of an Old Field upland community. Due to the creek, a majority of this site falls within the Shoreland Overlay District. A wetland delineation application was reviewed and certified by the City on May 28, 2026. It was confirmed there are two wetlands that are partially present on the site but extend outside the study area. Figure 2 Natural Resources Inventory Areas Map Figure 3 Wetland Delineation Exhibit 8 Page 3 of 19 4. Analysis Planning staff coordinated review of the application for consistency with the Comprehensive Plan, Zoning Ordinance, and other City Code requirements and City policies. The City Engineer provided comments in the attached Engineering Memo. Approval conditions require compliance with the Memo. A. Level of City Discretion in Decision-Making The City’s discretion in approving or denying a site plan and IUP is limited to whether the proposal meets the standards outlined in the City Code. If it meets these standards, the City must approve the application. The City has a higher level of discretion with a variance because the burden of proof is on the applicant to show that the variance standards have been met. Conditions can be applied to mitigate the impact of granting the variance. B. Consistency with Ordinance Standards Use Lost Loon LLC intends to develop the site by constructing a 16,016 sq. ft. building to operate an indoor cannabis cultivation facility. The site will have access from the cul-de-sac of Auger Ave. A retail component is not proposed at this site. State licensed cannabis businesses that do not include retail or outdoor cultivation are a permitted use within the I-1 District. This use must be compliant with the performance standards in Section 1060.120 in the Zoning Ordinance for cannabis businesses, these standards are discussed later in this report. Figure 4 Site Plan 9 Page 4 of 19 Lot Standards The proposed lot is an existing, vacant lot of record created as part of the plat for Jack and Cheryl Addition recorded in 1995. The I-1 district standards are shown in the table below: Dimensional Standard I-1 Existing/Proposed Minimum lot area 1 acre 2.12 Acres Minimum lot width 100 feet ~153 feet Minimum lot depth 200 feet ~340 feet Minimum Principal Structure Setbacks: Front, from Major Roadways* 100 feet N/A Front, from all other streets 50 feet 64 feet Side (East, West, and South) 20 feet 100 feet (east) 91 feet (west) 29.5 feet (south) Rear (North) 20 feet 112 feet Adjacent to Residential 50 feet N/A Maximum Principal Building Height 45 feet 22.5 feet Maximum Impervious Surface Coverage 70% 28.9% *Major Roadways are state highways and county roads All minimum and maximum dimensional standards of the I-1 District are satisfied with the proposed site plan. However, the property is also located within the Shoreland Overlay District, which includes additional setback requirements. The Shoreland Overlay District requires sewered structures to be setback a minimum of 50 feet from the Ordinary High Water Level (OHWL) of a tributary river or stream. The creek is located immediately west of the property, and the proposed building is shown to be at least 91 feet from the west property line. Based on the submitted plans, the proposed building appears capable of satisfying the required 50-foot setback from the OHWL. However, the OHWL has not been identified on the site plan. As a condition of approval, the applicant shall identify the OHWL on the site plan and demonstrate compliance with the required 50-foot setback. While the maximum impervious surface coverage limit in the I-1 district is 70%, the Shoreland Overlay District limit is 25%. Based on the proposed site improvements, staff estimates the impervious surface coverage limit within the portion of the property located in the Shoreland Overlay is approximately 27.8%. The applicant’s narrative states the impervious surface coverage was reduced from approximately 36% as identified in the concept plan down to the current proposal by redesigning the site and minimizing the parking lot to the extent practicable. The applicant requests a variance to 10 Page 5 of 19 allow the proposed impervious surface coverage. Additionally, site modifications necessary to comply with zoning, engineering, and public safety requirements may affect the final amount of impervious surface required for the development. This issue is discussed further in the variance analysis section of this report. Refuse The applicant’s plans indicate that an exterior trash enclosure will be provided on the northeast corner of the building, but no details have been provided. Details on the trash enclosure must be provided as a condition of approval. The site must comply with the following performance standards in Section 1060.020 of the Zoning Ordinance: - No exterior incineration of trash or garbage. - No exterior storage of trash or garbage except in an accessory building enclosed by walls and a roof or in closed containers within a totally screened area. Screening The architectural elevations depict rooftop equipment that appear, based on the scale of the submitted elevations, to project more than three feet above the roof surface. Section 1060.030 exempts rooftop mechanical equipment less than three feet in height form screening requirements. For equipment exceeding three feet in height, the ordinance requires that the equipment be designed, located, and where necessary, screened so that it is aesthetically harmonious with the building as observed to a six-foot-tall individual standing at ground level on adjacent property or a public right-of-way. The applicant provided a perspective rendering from the cul-de-sac looking at the southeast corner of Figure 5 Refuse Area Figure 6 View of Rooftop Equipment from ROW 11 Page 6 of 19 the building which indicates no rooftop mechanical equipment will be visible from that viewpoint. However, the submitted rendering does not demonstrate visibility from all potentially affected viewpoints (adjacent property or public right-of-way (ROW)). As a condition of approval, the applicant shall demonstrate compliance with Section 1060.030 and/or provide additional screening, as necessary, prior to issuance of a building permit. Lighting The application includes a photometric plan reflecting two freestanding luminaires on the north and west side of the parking lot, and five wall mount fixtures on the exterior of the building (three on the east façade, one on the northeast façade, and one on the west façade). The photometric plan confirms that the combination of lights does not exceed one foot-candle at the property line or centerline of a public street. The wall light fixture and freestanding luminaire specifications confirm compliance with the City’s 0- degree cutoff requirements. The freestanding luminaire is specified to have a height of 20’ which is less than the heigh of the building (22.5’). The freestanding luminaire cannot exceed the height of the building or 30’; whichever is less, per Section 1060.040. Overall, the lighting plan is in compliance with the performance standards in the Zoning Ordinance. Building/Architecture The applicant’s narrative states the building will be a pre-cast concrete structure. This is consistent with allowed exterior finishes in Section 1060.050, Subd. 1(C) for non- residential zoning districts. The architectural plans show that the building will be primarily made of vertical textured light grey stained/painted pre-cast concrete, with two other accent colors along the top of the building – a dark grey stained/pained pre-cast concrete and a dark green stained/painted precast concrete. There are a few windows on the eastern façade of the building with a row of clerestory windows on the south façade. Figure 7 Eastern Building Facade 12 Page 7 of 19 Parking and Drive Aisles Section 1060.060 requires parking lots and internal drive aisles to be setback a minimum of 50’ from the front property line and 10’ from the side and rear property lines. The Shoreland Overlay District also requires parking to maintain the same 50’ setback required for the principal building. While the driveway providing vehicular access from the public street may encroach into the required front setback, the proposed parking lot and internal drive aisles may not. Revisions made to the site layout since the concept plan resulted in the proposed parking lot encroaching into the required 50’ front setback. The site plan shall be revised to demonstrate compliance with the required front setback for the parking lot and internal drive aisles. The proposal satisfies the side and rear setback requirements. Compliance with the Shoreland setback will be confirmed upon identification of the OHWL. The site plan reflects 90-degree parking stalls which must be at least 9’ wide, 18’6” long, and the drive aisle must be at least 26’ wide. The parking stalls meet these requirements. The site plan shows 19 parking spaces, including one accessible parking space. It is anticipated the full staff of the facility would be 10-15 people. The additional spaces leave room for additional personnel even in the event all staff must be on site at once. The applicable parking formula in the Zoning Ordinance is for Manufacturing, Processing, or Fabricating Facility, which reads as follows: 8 spaces plus one space for each 2 employees on the largest shift. A minimum of 8 spaces plus one space per 500 square feet of floor area is required. This results in a minimum requirement of 40 spaces per the Zoning Ordinance. This far exceeds the anticipated parking demand of the site even if all employees are at the facility at once. Further, requiring compliance with this standard would result in more impervious surface within the Shoreland Overlay District. The applicant requests an IUP Figure 8 Parking Lot 13 Page 8 of 19 to reduce the required off-street parking spaces. The IUP analysis is discussed later in this report. Landscaping The site is subject to the landscape standards outlined in Section 1060.070, which require the following: • One overstory tree per 1,000 sq. ft. of gross building floor area or one tree per 50 lineal ft. of site perimeter, whichever is greater. • One understory shrub for each 300 sq. ft. of building or one tree per 30 lineal ft. of site perimeter, whichever is greater. The formula based on the site perimeter of 1,206 linear feet results in the greater number of overstory trees at 24.12. The landscaping plan shows 24 overstory trees are required, but the City rounds up to the next whole unit of landscaping. In this case, 25 overstory trees are required. The landscaping plan proposes 23 overstory trees and 3 understory trees. The Zoning Ordinance allows up to 50% of the required overstory trees to be substituted with three understory trees. An equivalent of 24 overstory trees is Figure 9 Landscape Plan 14 Page 9 of 19 currently shown, and there is a condition of approval that one more overstory tree or equivalent be provided. No more than 33% of the required trees can be of a single species. With 25 overstory trees, no more than 8 trees can be from the same species. The landscaping plan does show 9 Balsam Fir trees in the planting schedule. The plan must be revised so that there are no more than 8 Balsam Fir trees and any other single species. The formula based on the building size of 16,016 sq. ft. results in the greater number of shrubs at 53.39. Again, the City requires landscaping to be rounded up to the next whole unit, so 54 shrubs are required. The landscaping plan currently shows 53. A condition of approval is for the landscaping plan to be revised to reflect 54 shrubs. Section 1060.060 requires parking areas with four or more stalls to be screened from properties guided or zoned residential and from public streets. This screening requirement comes in the form of shrubbery, which must be at least three feet in height, to screen vehicle headlights. It does not appear this would be required with the current proposed site layout. Additionally, a buffer yard is not be required for this project as the site is not adjacent to a residential property or a zoning district of less intensity. The seed mix for the proposed ground cover is a native grass. It will be a taller grass of roughly 2 feet tall and requires minimal maintenance. Staff does not recommend native grass to be planted within the ROW as this area does need to be regularly maintained. Staff recommends the following conditions of approval related to the native landscaping: - The site plan must be revised to reflect sod within the ROW. - Small signs explaining intentional native landscaping on the site near property boundaries, locations to be approved by staff, in an attempt to educate neighbors and the public to minimize code enforcement calls believing the grass is overgrown. - The applicant must provide a long-term maintenance plan for the native planting areas. This must particularly address how they will maintain the area east of the parking lot with trees. Solar Energy System The architectural plans show a solar array on the roof of the building. The use of solar panels is intentional to offset electricity demand from their operations. Roof mounted solar energy systems can be approved administratively through a Certificate of Compliance in all zoning districts. Non-residential rooftop systems may be pitched at an angle greater than 5% and shall be screened from adjacent public ROW and residential structures. Solar energy systems require a separate building permit. Minimal information was provided on the solar energy system with this application. A condition of approval is that information to confirm compliance with Section 1060.110 of the Zoning Ordinance must be submitted and a Certificate of Compliance issued prior to issuance of a building permit for the solar energy system. 15 Page 10 of 19 Cannabis Business Performance Standards The City's review is limited to confirming compliance with applicable local zoning standards. State licensing requirements will be administered separately by the Office of Cannabis Management. The business will be expected to comply with Section 1060.120 of the Zoning Ordinance as written. Specifically, establishments must implement comprehensive security measures, odor control, and a cannabis waste disposal plan. Some of these requirements are ultimately satisfied by complying with the State’s licensing requirements. Details on these measures are discussed in the applicant’s narrative enclosed with this report. Further detail will be provided to the City as they work through the licensing process with the state. A condition of approval is for the applicant to confirm that the security cameras will cover all areas of the building, both interior and exterior. Cannabis businesses are prohibited within 1,000 feet of a school or 500 feet of a day care, residential treatment facility, or an attraction within a public park that is regularly used by minors (e.g., playground or athletic field). Based on publicly available information as it relates to licensed daycares and schools, the proposed location satisfies these buffers. Utilities The site is located within the MUSA boundary and municipal sewer and water are available. Properties within this industrial area of the City were part of a street and utility project in 2014. Properties were assessed for the project cost, and staff confirmed this property was assessed through property taxes for this project. Water and sewer trunk line area charges (TLAC) and water and sewer connections with Corcoran, Maple Grove, and the Metropolitan Council will be due based on the current fee schedule. Since this lot was previously platted, it will only be charged 1 TLAC unit. The City Sewer and Water connection units are based on the SAC determination units Figure 10 Rooftop Solar Energy System 16 Page 11 of 19 from the Metropolitan Council. The Maple Grove connection fee is per acre. The Engineering Memo includes a few more comments as it relates to sewer and water. Stormwater The site plan depicts a stormwater treatment area. The Engineering Memo provides feedback as it relates to remaining stormwater requirements that must be addressed as conditions of approval. The stormwater pond and related facilities will require a recordable drainage and utility easement and stormwater maintenance agreement. Wetlands The wetland delineation completed for this site confirmed the presence of small portions of wetlands that are primarily located on neighboring properties. However, the site plan does not currently depict the wetland boundaries applicable to this site. A condition of approval is for the site plan to be updated to show these boundaries. Because the property was created prior to March 23, 2004 (as part of a plat approved in 1995), wetland buffers and buffer monuments are not required. Building setback requirements from the buffer are also not applicable to lots created prior to March 23, 2004. Sound The applicant submitted a Sound Source Control Plan addressing equipment identification, manufacturer sound data, operational characteristics, equipment setbacks, screening, vibration isolation, and a narrative regarding anticipated compliance with Minnesota Pollution Control Agency noise standards. While the submittal does not include a formal acoustical study or property-line noise modeling, staff finds the information sufficient to evaluate the application at this stage, subject to the applicant's continued obligation to comply with Minnesota Rule 7030 during construction and operation. Signage The applicant has not provided detailed information regarding signage for the site. The site must comply with Chapter 84 of the City Code, including (but not limited to) lighting and brightness standards. A separate sign permit for temporary and permanent signs will be required. Since the property is zoned I-1, it is allowed to have the following signage: Figure 11 Wall Sign - Eastern Facade 17 Page 12 of 19 • One freestanding sign, not to exceed 16 feet in height and 64 sq. ft. in copy area. • One wall sign on at the primary entrance not to exceed 10% of the primary building face. The building elevation does show a wall sign of the Lost Loon logo. While dimensions and other details will need to be confirmed as part of the sign permit process, it appears the wall sign will be able to comply with Chapter 84. The plans do not indicate the use of a freestanding sign. As part of the cannabis performance standards, signage must not depict cannabis leaves, use slang terms for cannabis, or appeal to minors. The proposed business name and logo do not include cannabis leaves, slang terms, nor are they designed to appeal to minors. Public Safety Public Safety completed an initial review of the proposed site plan on June 3, 2026. However, the final review comments are not yet available due to staff availability. Community Development staff understands that the extent of requirements for fire apparatus access may depend on whether the proposed building is equipped throughout with an approved automatic sprinkler system, as determined by the applicable Fire Chief. A fully sprinklered building may reduce the extent of fire apparatus access improvements required, thereby minimizing additional impervious surface not currently shown on the site plan. Conversely, if the building is not sprinklered, additional fire apparatus access improvements may be necessary (e.g., additional fire lane(s) and a City-standard turnaround), which could increase the amount of impervious surface on the site required for emergency services. Prior to issuance of grading or building permits, the site plan shall be revised, if necessary, to comply with the fire apparatus access requirements established by the applicable Fire Chief based on the final approved building design and fire protection systems. The final site design shall minimize additional impervious surface to the maximum extent practicable while meeting applicable fire and life safety requirements. Parks and Trails The 2040 Comprehensive Plan shows a proposed off-road trail near the western boundary of this property. However, this is expected to be dedicated with the development of the property to the west, and the trail would run along the western boundary of the creek. Park Dedication will not be required for this proposal, as no subdivision is proposed. IUP Section 1060.060, Subd. 10 allows for parking space reductions to be approved as an IUP when it can be demonstrated there is a demand which is less than the required parking formula. Staff believes the documented operations and staffing plan provide the 18 Page 13 of 19 necessary data to reduce the formal parking requirements for this facility to 19 spaces. The applicant’s narrative notes the 19 parking spaces will exceed the anticipated peak demand of 8-12 spaces. They expect to employ approximately 15 staff members in total, with approximately 5-8 employees present on-site at any given time. The estimated traffic of the site includes staggered employee trips and a small number of monthly deliveries (a few trucks per month). The proposed IUP includes a sunset clause that allows the parking demand to be re-evaluated if operational conditions change. Further, reducing the amount of required parking minimizes impervious surface coverage, advancing the purpose of the Shoreland Overlay District by preserving additional pervious area. The applicant further states the site design will limit stormwater runoff while allowing for increased incorporation of green infrastructure. The IUP is drafted so that it would include a sunset clause for when parking demand for the site exceeds 19 spaces for regular operational needs of the site. The property owner at such time would be required to submit a site plan amendment (and variance if also approved as part of this application) to discuss the site and expand the parking or reduce operations as necessary. Additionally, the parking requirements will automatically be revisited should the applicants expand their operations in the future or a new property owner changes to a new use. The IUP to reduce formal parking spaces to 19 must satisfy the following IUP criteria outlined in Section 1070.030, Subd. 3: A. Meet the requirements of a conditional use permit set forth in Section 1070.020, Subd. 3. a. Compliance with and effect upon the Comprehensive Plan, including public facilities and capital improvement plans. Granting an IUP to reduce the parking space requirement for the proposed cannabis facility is not in conflict with the Comprehensive Plan. This property is guided Light Industrial in the 2040 Comprehensive Plan. Required parking in excess of the documented operational demand would increase impervious surface without a corresponding public benefit and would be inconsistent with the Shoreland Overlay District’s objective of limiting impervious coverage. The site plan reflects 19 spaces which is more than the anticipated number of total employees, so reliance on public streets is not expected even if all employees are at the site at one time. b. The establishment, maintenance or operation of the conditional use will promote and enhance the general public welfare and will not be detrimental to or endanger the public health, safety, morals, or comfort. 19 Page 14 of 19 An IUP to reduce parking requirements based on the proposed business model will promote and enhance the general public welfare as it will retain natural green space on the property while minimizing impervious surface within the Shoreland Overlay. The applicant states that the site design will limit stormwater runoff volume and rate while allowing for increased incorporation of green infrastructure. There is enough parking for the users of the site, without creating a detriment or endangering the public health, safety, morals, or comfort of the surrounding area. c. The conditional use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the neighborhood. Granting an IUP for reduced parking spots based on the documented business model will not be injurious to the use and enjoyment of other property in the immediate vicinity nor substantially diminish and impair property values within the neighborhood. There is more than enough parking stalls to accommodate anticipated parking demand on site, and the proposed plan keeps the site in line with what is expected in an industrial context while honoring the goals of the Shoreland Overlay District. d. The establishment of the conditional use will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district. Granting an IUP to reduce parking space requirements will not prevent nor discourage the normal and orderly development and improvement of the surrounding industrial property. The proposed 19 parking spaces exceed the applicant’s documented operational demand and provide sufficient parking for anticipated employees and site visitors. Reliance on the surrounding public streets for parking is not expected. e. Adequate public facilities and services are available or can be reasonably provided to accommodate the proposed use. Existing public facilities and services are adequate to serve the proposed use. The parking reduction does not increase demand on public infrastructure because all parking associated with the use is required to be accommodated on-site. A condition of the IUP is that 20 Page 15 of 19 parking associated with the cannabis cultivation facility cannot occur on public streets. f. The conditional use shall, in all other respects, conform to the applicable regulations of the district in which it is located. Except for the requested Shoreland Overlay impervious surface variance, the proposed development complies with the applicable district regulations. The requested parking reduction assists in minimizing impervious surface to the extent practicable. g. The conditional use and site conforms to performance standards as specified by this Chapter. The proposed parking reduction is specifically authorized through the IUP process established by Section 1060.060, Subd. 10. The site otherwise complies with all applicable performance standards with the proposed conditions of approval as outlined in this staff report. B. The use is allowed as an interim use in the respective zoning district. The ability to use an IUP to reduce parking requirements is not restricted to a specific zoning district. Therefore, the IUP is allowed within the I-1. C. The date or event that will terminate the use can be identified with certainty. The event that will terminate this use is identifiable with certainty. Staff proposes the following sunset clause: 1. The property is sold, transferred, or the cannabis cultivation business changes ownership or operational control. 2. Documented parking demand for the cannabis cultivation business exceeds 19 parking spaces for regular operations. 3. The cannabis cultivation business ceases. 4. The cannabis cultivation business expands, and the City determines the parking demand will increase. 5. The cannabis cultivation business fails to meet City and State requirements. 6. The City Council revokes the IUP pursuant to applicable ordinance provisions. The Planning Commission is asked to consider whether there are any other potential events that should be included in the sunset clause. 21 Page 16 of 19 D. The use will not impose additional unreasonable costs on the public. Granting an IUP to reduce the required number of parking spaces on the property will not create an additional and unreasonable cost to the public. E. The user agrees to any conditions that the City Council deems appropriate for permission of the use. Conditions of approval include the following: o No parking on adjacent public streets is allowed. All parking must be accommodated on site. o If documented parking demand for the cannabis cultivation business exceeds 19 parking spaces for regular operations, the applicant shall submit a site plan amendment (and variance, if applicable) for City approval. o The City may inspect the property every three years, or upon receipt of a parking-related complaint, to verify continued compliance with the conditions of this IUP. The Planning Commission may want to consider if there are other measures that should be recommended to mitigate the impact of granting permission to reduce the required parking for the proposed use. Variance The application requires a variance because the Shoreland Overlay District limits impervious surface coverage to 25%, while the proposed development is estimated by staff to result in approximately 27.8% impervious surface coverage. Due to outstanding zoning, engineering, and Public Safety review comments, staff recommends approving a maximum impervious surface coverage of 30% to provide flexibility for City-required site modifications while minimizing the need for additional variance proceedings. Section 1070.040 provides the following standards to review variance requests. 1. That there are practical difficulties in complying with the Zoning Ordinance. The League of Minnesota Cities defines a three-factor test for the term "practical difficulties": • The property owner proposes to use the property in a reasonable manner not otherwise allowed by the Zoning Ordinance. • The plight of the landowner is due to circumstances unique to the property and not created by the landowner; and • The variance will not alter the essential character of the locality. 22 Page 17 of 19 Section 1070.040, Subd. 2(B) of the Zoning Ordinance specifically identifies the last two factors as separate standards and they will be discussed individually. Therefore, the City typically uses this first standard to focus on evaluating the reasonableness of the request. 2. That the conditions upon which a petition for a variation is based are unique to the parcel of land for which the variance is sought and were not created by the landowner. 3. That the granting of the variation will not alter the essential character of the locality. 4. The proposed variance would be in harmony with the general purposes and intent of the ordinance. 5. The variance is consistent with the Comprehensive Plan. 6. The City may impose conditions on the variance to address the impact of granting the variance. The applicant's narrative documents efforts to reduce impervious surface coverage from approximately 36% to the current proposal through redesigning the site and reduction of parking to the extent practicable. Staff also recommends approval of an IUP to reduce the required number of parking spaces based on the applicant's documented operational demand, further reducing impervious surface while maintaining industrial site functionality. Staff believes the requested variance represents a reasonable use of the property by allowing industrial development of the site while minimizing impervious surface to the extent practicable. The need for the variance is driven by the unique combination of the Shoreland Overlay District requirements and the dimensional constraints associated with developing an industrial site while accommodating required parking, stormwater management, landscaping, and emergency access. These site constraints are unique to the property and were not created by the applicant. Granting a variance to allow a maximum impervious surface coverage of 30% will not alter the essential character of the locality. The property is guided and zoned for industrial development, and the proposed use is consistent with the surrounding area. Although the variance permits a modest increase in impervious surface beyond the 25% Shoreland Overlay limit, the site continues to preserve significant open space and incorporates native prairie vegetation throughout the site. The variance facilitates a development pattern that remains consistent with the industrial character of the area while recognizing the environmental objectives of the Shoreland Overlay District and mitigating impacts associated with the requested increase in impervious surface. Granting the variance is generally consistent with the Comprehensive Plan, which guides the property for Light Industrial development while also recognizing the 23 Page 18 of 19 importance of protecting natural resources. Staff does not anticipate the final site design will require the full 30% impervious surface coverage; however, the additional flexibility is recommended solely to accommodate potential City-required revisions resulting from outstanding zoning, engineering, and Public Safety review. Staff recommends conditions requiring the final site design to minimize impervious surface to the maximum extent practicable while satisfying applicable zoning, engineering, and fire and life safety requirements. Additionally, staff recommends requiring a minimum 15’ setback between all impervious surface and delineated wetland boundaries. These conditions are intended to mitigate the impacts of the additional impervious surface while allowing reasonable development of the property. The Planning Commission is asked to discuss whether there are any additional conditions that should be added to mitigate the impact of granting the variance. Summary The following list is a summary of potential staff-identified topics for the Planning Commission to discuss: A. Site Plan Are there additional conditions that could be added for rooftop equipment screening, if needed after final review. B. IUP Does 19 parking spaces adequately reflect documented parking demand? Are the proposed sunset events appropriate? Should additional sunset events be included? Are there additional operational conditions that should be imposed to ensure parking demand remains within the approved limit? C. Variance Is approving 30% impervious surface (instead of the current estimated 27.8%) appropriate to accommodate potential City- required modifications? Do the recommended conditions adequately mitigate the impact of granting the variance? Are there additional mitigation measures that should be required? 5. Recommendation Staff recommends approval of the draft Resolution approving the Site Plan, IUP, and Variance for the cannabis cultivation facility subject to the conditions of approval outlined in this report. 24 Page 19 of 19 Attachments: 1. WHEREAS, the applicant requests approval of an Interim Use Permit to reduce the required parking to 19 spaces. WHEREAS, the applicant requests approval of a Variance to allow up to 30% impervious surface coverage within the Shoreland Overlay District where 25% is permitted. WHEREAS, the Planning Commission reviewed the requests at a duly called Public Hearing and recommended approval, and; NOW, THEREFORE, BE IT RESOLVED that the Corcoran City Council approves the request for a Site Plan, Interim Use Permit, and Variance subject to the following findings and conditions: 1. A Site Plan, Interim Use Permit, and Variance are approved, in accordance with the plans received by the City on May 20, 2026, with additional material received on June 9, 2026, except as amended by this resolution. 2. The applicant shall comply with all requirements in the City Engineer Site Plan Review Memo dated June 8, 2026. 3. The development shall comply with the City’s requirements regarding fire access, fire protection and fire flow calculations, the location of fire hydrants, fire department connections, and fire lane signage. a. Prior to issuance of grading or building permits, the site plan shall be revised, if necessary, to comply with the fire apparatus access requirements established by the applicable Fire Chief. b. The final site design shall minimize additional impervious surface to the maximum extent practicable while meeting applicable fire and life safety requirements. 4. An indoor cannabis cultivation business is approved based on compliance with all applicable performance standards in Section 1060.120 of the Zoning Ordinance. 26 City of Corcoran July 23, 2026 County of Hennepin State of Minnesota RESOLUTION NO. 2026- Page 2 of 9 Ongoing compliance with these standards is required throughout the operation of the facility. 5. An interim use permit is granted to reduce the require parking spaces for the business to 19, subject to the following conditions and findings: a. The applicant provided the following data points to justify the reduction in parking requirements: i. Approximately 10-15 staff members are expected in total. ii. Approximately 5-8 employees are expected to be present on-site at any given time. iii. Visitors to the site, including monthly deliveries, are expected to be limited within any given month. iv. Anticipated peak demand is 8-12 spaces. b. Applicable criteria are satisfied as outlined in Section 1070.030 (Interim use Permits) of the Corcoran Zoning Ordinance: i. The application meets requirements of a conditional use permit set forth in Section 1070.020, Subd. 3: 1. The reduced parking space requirement is compliant with and effect upon the Comprehensive Plan, including public facilities and capital improvement plans. The property is guided Light Industrial in the 2040 Comprehensive Plan, and the reduced parking spaces will reduce the necessary impervious surface for consistency with the Shoreland Overlay District’s natural resource objectives. The site plan reflects 19 spaces which is more than the anticipated number of total employees, so reliance on public streets is not expected even if all employees are at the site at one time. 2. The establishment, maintenance or operation of the conditional use will promote and enhance the general public welfare and will not be detrimental to or endanger the public health, safety, morals, or comfort. The reduced parking requirement will retain natural green space while minimizing impervious surface within the Shoreland Overlay District while providing ample parking for site functionality. 3. The conditional use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the neighborhood. There is more than enough parking stalls to accommodate anticipated parking demand on site, and the proposed plan keeps the site in line with what is expected in an industrial context while honoring the goals of the Shoreland Overlay District. 27 City of Corcoran July 23, 2026 County of Hennepin State of Minnesota RESOLUTION NO. 2026- Page 3 of 9 4. The establishment of the conditional use will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district. The proposed 19 parking spaces exceed the applicant’s documented operational demand and provide sufficient parking for anticipated employees and site visitors. Reliance on the surrounding public streets for parking is not expected. 5. Adequate public facilities and services are available or can be reasonably provided to accommodate the proposed use. The parking reduction does not increase demand on public infrastructure because all parking associated with the use is required to be accommodated on-site. 6. 7. The conditional use and site conforms to performance standards as specified by this Chapter. The proposed parking reduction is specifically authorized through the IUP process established by Section 1060.060, Subd. 10. The site otherwise complies with all applicable performance standards with the conditions of approval as outlined in this resolution. c. The use is allowed as an interim use in the respective zoning district. The ability to use an Interim Use Permit to reduce parking requirements is not restricted to a specific zoning district. Therefore, this use is allowed within the I-1 Zoning District. d. The date or event that will terminate the use can be identified with certainty. The following events will terminate the use: i. The property is sold, transferred, or the cannabis cultivation business changes ownership or operational control. ii. Documented parking demand for the cannabis cultivation business exceeds 19 parking spaces for regular operations. iii. The cannabis cultivation business ceases. iv. The cannabis cultivation business expands, and the City determines the parking demand will increase. v. The cannabis cultivation business fails to meet City and State requirements. vi. The City Council revokes the interim use permit pursuant to applicable ordinance provisions. e. The use will not impose additional unreasonable costs on the public. 28 City of Corcoran July 23, 2026 County of Hennepin State of Minnesota RESOLUTION NO. 2026- Page 4 of 9 f. The user agrees to the following conditions that the City Council deems appropriate for permission of the use. i. No parking on adjacent public streets is allowed. All parking must be accommodated on site. ii. If documented parking demand for the cannabis cultivation business exceeds 19 parking spaces for regular operations, the applicant shall submit a site plan amendment and variance (if applicable) for City approval. iii. The City may inspect the property every three years, or upon receipt of a parking-related complaint, to verify continued compliance with the conditions of this Interim Use Permit. 6. The requested variance to allow a 30% impervious surface limit within the Shoreland Overlay District is approved based on the following findings: a. That there are practical difficulties in complying with the Zoning Ordinance. The property is guided and zoned for Light Industrial and falls within the shoreland of a creek that runs just west of the property. Efforts have been made by the applicant to design the site for functionality while meeting all zoning performance standards, engineering standards, and public safety requirements. The requested variance represents a reasonable use of the property by allowing industrial development as envisioned for the site while minimizing impervious surface to the extent practicable. b. That the conditions upon which a petition for a variation is based are unique to the parcel of land for which the variance is sought and were not created by the landowner. The need for the variance is driven by the unique combination of the Shoreland Overlay District requirements and the dimensional constraints associated with developing an industrial site while accommodating required parking, stormwater management, landscaping, and emergency access. c. That the granting of the variation will not alter the essential character of the locality. d. The proposed variance would be in harmony with the general purposes and intent of the ordinance. The variance facilitates a development pattern that remains consistent with the industrial character of the area while recognizing the environmental objectives of the Shoreland Overlay District and mitigating impacts associated with the requested increase in impervious surface. e. The variance is consistent with the Comprehensive Plan. Granting the variance is generally consistent with the Comprehensive Plan, which guides the property for 29 City of Corcoran July 23, 2026 County of Hennepin State of Minnesota RESOLUTION NO. 2026- Page 5 of 9 Light Industrial development while also recognizing the importance of protecting natural resources. f. The City may impose conditions on the variance to address the impact of granting the variance. The following are conditions of approval for the variance to mitigate the impact of granting the variance: i. The final site design must minimize impervious surface to the maximum extent practicable while satisfying applicable zoning, engineering, and fire and life safety requirements. Total impervious surface coverage within the Shoreland Overlay District shall not exceed 30% without further City approval. ii. A minimum 15-foot setback from the delineated wetland boundaries is required for impervious surfaces. 7. Trees, ponds, curb, retaining walls and other private improvements shall be located outside of the public street right-of-way and drainage and utility easement. a. If the City determines that encroachments are necessary, the applicant will be required to enter into an encroachment agreement with the City. b. Native plantings must not be located within the City right-of-way; permitted ground cover within the right-of-way is sod. 8. A building permit is required prior to beginning construction. 9. Torrens Property 34 Lost Loon LLC is applying for approval from the City of Corcoran to develop, build, and operate an indoor cannabis cultivation facility at 20120 Auger Ave, Hamel, MN 55340. This lot is zoned properly for cannabis cultivation per the City of Corcoran zoning code (BP). Lost Loon LLC has already received preliminary approval from the State of Minnesota’s Office of Cannabis Management (OCM) for a micro-business cannabis license with a cultivation endorsement. Lost Loon intends to build an approximately 16,016 sq. ft. pre-cast concrete structure in which to grow, dry, cure, package, and distribute wholesale cannabis. The interior of the building will be separated using Insulated Metal Panels (IMP) into different secure areas for sowing seedlings, tending vegetative and flowering cannabis plants, processing harvested cannabis, drying and curing harvested cannabis, and processing and packaging the dried and cured cannabis into wholesale products for secure transportation to a licensed cannabis testing labs, manufacturers, and distributors. Shipping of packaged cannabis will occur onsite through a loading dock at the rear of the facility, with shipments anticipated at regular intervals dependent on harvest cycles and with minimal disruption to surrounding traffic patterns. Other onsite activities will include administrative and operational office duties, tracking and inventorying all cannabis from seed-to-sale in accordance with state standards using the METRC system, and general maintenance activities. All aspects of the facility will comply with applicable Minnesota State Building Codes and City requirements. Lost Loon is also pursuing LEED certification for the project and intends to incorporate sustainable building strategies throughout the design and construction process where feasible. A preliminary security plan has been submitted to the State of Minnesota with Lost Loon’s cannabis cultivation license application, for which Lost Loon has received preliminary approval. 35 The security plan includes 24/7 video surveillance of the facility, controlled facility access, secure storage areas, and other measures required to comply with State of Minnesota security requirements for cannabis facilities. Lost Loon plans to implement advanced odor mitigation technology in its operations to reduce the potential for community impact. While the State of Minnesota currently has no formal odor mitigation standards for cannabis cultivation facilities, Lost Loon intends to comply with or exceed any future standards when implemented. Proposed odor mitigation measures include carbon filtration systems, negative pressure ventilation, sealed processing and storage areas, and operational monitoring and maintenance procedures designed to minimize offsite odor impacts. Lost Loon plans to incorporate sustainability and resiliency features into the project where practical and economically feasible. The project team is currently evaluating and pursuing rooftop solar installation to help offset operational electrical demand. The site design also includes native landscaping and pollinator-friendly plantings intended to improve biodiversity, reduce irrigation needs, and support stormwater management goals. The project team is evaluating additional sustainable site strategies as part of the LEED certification process, including stormwater quality improvements, energy efficiency measures, reduced parking footprint, and electric vehicle charging infrastructure. Lost Loon is working with its civil engineering team to implement a stormwater management plan that complies with all applicable city, watershed, and state regulations. Proposed stormwater management strategies include a stormwater filtering pond and native planting areas where feasible. Lost Loon intends to utilize Wright-Hennepin Electric (WHE) cooperative electrical service, as WHE infrastructure is located adjacent to the site. Lost Loon also plans to utilize the municipal sewer and water connections managed by the City of Corcoran. 36 20120 Auger Avenue is zoned by the City of Corcoran as Business Park (BP), under which indoor cannabis cultivation is an approved use per the City’s zoning code. The site is located within an industrial/business park area where surrounding uses are similarly non-public-facing commercial and industrial operations. The site has access to proper sewer, water, and electrical infrastructure necessary for compliant cannabis cultivation operations. The parcel is currently undeveloped and suitable for the proposed use and building configuration. Lost Loon’s current site plan includes a paved parking area for employees and limited operational traffic. Since the original sketch plan review, the site design has been refined to reduce impervious surface coverage where feasible while maintaining safe and functional operations for employees, deliveries, and emergency access. The facility is anticipated to employ approximately 10-15 total employees, with significantly fewer employees onsite during normal operations due to staggered shifts and operational scheduling. Lost Loon is therefore requesting a reduction in the required parking count based on the actual anticipated parking demand for the facility. Lost Loon has completed the required survey, wetland delineation, geotechnical investigation, and related site due diligence activities necessary to support the land use and site plan review process. The project team will continue coordinating with City staff, consultants, and reviewing agencies throughout the final design and permitting process. 37 Interim Use Permit Narrative Lost Loon LLC Request to Reduce Required Parking a) Nature of Request Lost Loon is requesting an Interim Use Permit (IUP) to allow a reduction in the number of off- street parking spaces from the minimum required 38 spaces to 19 spaces for a proposed cannabis cultivation facility located within the Business Park zoning district. This request is made to: • Align the site design with the operational needs of the facility, and • Reduce impervious surface coverage on the site in support of environmental protection goals within the Shoreland Overlay District. The proposed 19 parking spaces exceed the anticipated peak demand and represent a right-sized approach to site design. b) Impact on Adjoining Properties and Mitigation Measures The subject property is located within an established Business Park district and is surrounded by industrial uses. The nearest residential properties are located approximately one-half mile from the site. Due to: • The industrial character of the surrounding area, • The absence of retail or high-traffic uses, and • The low intensity of employee and delivery traffic, the proposed reduction in parking will not negatively impact adjoining properties. Additionally, the reduced parking area will: • Decrease impervious surface coverage, • Reduce stormwater runoff, and • Support enhanced landscaping and buffering opportunities through native plantings and stormwater management features. 38 c) Buildings to be Constructed or Utilized The project consists of a single approximately 17,000 square foot indoor cannabis cultivation facility. All operations will occur within the enclosed structure, with designated areas for cultivation, processing, and administrative functions. d) Intended Use of Buildings and Property The property will be used exclusively for licensed cannabis cultivation operations, which is a permitted use within the Business Park zoning district. No retail sales or public-facing commercial activities will occur on-site. e) Hours and Days of Operation Hours of operation will vary depending on cultivation cycles and operational needs but will generally occur within standard business hours. Operations are not expected to generate significant off-hour activity beyond limited security presence and periodic monitoring. f) Number of Employees The facility will employ approximately 15 total staff members. At any given time, due to staggered shifts, approximately 5–8 employees will be present on-site. g) Size of Operation The operation consists of one 17,000 sq. ft. indoor cultivation within a controlled environment facility, with 5,000 sq. ft. of canopy space per the Office of Cannabis Management microbusiness license specifications. No outdoor cultivation or animal-related operations are proposed. h) Impact on TraƯic, Access, and Parking Traffic generated by the facility will be minimal due to: • A small number of on-site employees, • The absence of retail customers, and 39 • Limited delivery activity. Estimated traffic includes: • Employee trips associated with staggered shifts, and • A small number of monthly deliveries (a few trucks per month). The site has a single access point, which is adequate to accommodate the low volume of traffic. Parking JustiƱcation The proposed 19 parking spaces are sufficient based on: • Peak on-site staffing levels of 5–8 employees, • Limited visitor frequency (anticipated to be a few per month), and • Minimal delivery overlap. The reduced parking supply avoids overbuilding unnecessary impervious surface while still providing ample capacity for peak conditions, including occasional full staff meetings or inspections. Based on the anticipated number of employees and visitors, expected peak demand is 8-12 spaces. The 19 spaces proposed are 150%-200% of the actual parking need. i) Impact on Septic System and Well The project will connect to municipal utilities where available. No adverse impacts to septic systems or wells are anticipated. j) Environmental Impacts and Mitigation Measures The subject property is located within a Shoreland Overlay District, where minimizing impervious surface is a key environmental objective. The proposed reduction in parking spaces directly supports this goal by: • Reducing total impervious surface area on the site, • Limiting stormwater runoff volume and rate, and • Allowing for increased incorporation of green infrastructure. Planned environmental measures include: • Native landscaping, • Bioswales and stormwater management features, and • Preservation of existing wetland areas outside the development footprint. 40 Although permeable pavement is under consideration, the primary environmental benefit of this request is the reduction in overall paved area. k) BuƯering from Adjacent Properties Given the industrial context of the surrounding area and the distance to residential uses, impacts are inherently minimized. Additional buffering will be provided through: • Landscaping and native plantings, and • Site design that limits visual and operational impacts. l) Future Expansion Plans No immediate expansion is proposed beyond the current facility plan. Future expansion, if any, would be subject to separate review and approval by the City. m) Nature of Other Uses in the Neighborhood The surrounding area consists primarily of industrial and business park uses. The proposed use and site design are consistent with the character and intensity of development in the area. 41 Variance Narrative Lost Loon LLC Request to Exceed Impervious Surface Limit Request Summary The applicant is requesting a variance to allow an increase in impervious surface coverage from the maximum permitted 25% to approximately 29% within the Shoreland Overlay District for the proposed Lost Loon cannabis cultivation facility. Typical Industrial-Zoned properties allow up to 70% impervious coverage. The proposed site plan reflects a reduction from approximately 36% impervious surface in the initial concept design to 28.9%, achieved through significant design modifications, including a reduction in parking and reconfiguration of site circulation. The requested variance represents the minimum necessary deviation to accommodate a functional, code-compliant industrial facility while incorporating environmental protections and minimizing site impacts to the greatest extent practicable. Variance Criteria a) Practical Difficulties Practical difficulties exist in complying with the 25% impervious surface limitation due to the physical and regulatory constraints affecting the property. These include: ● Typical Industrial-Zoned properties are developed with up to 70% impervious coverage to provide functional and economically viable operations. The proposed layout is under 30% impervious and per city code would require additional parking stalls (See Interim Use Application for parking reduction request). This is most restrictive practical difficulty. It should be noted the amount of open space being preserved with the proposed layout and the similar size of the building in relation to adjacent properties. ● Clay soil conditions, which constrain stormwater infiltration options and influence site design and grading requirements. Pervious Pavement, for example would not be feasible to infiltrate into the soils. ● Operational requirements of a secure indoor cannabis cultivation facility, including: 42 o a controlled building footprint necessary for environmental systems and compliance, and o required access, loading, and circulation areas for safe and functional operation These factors collectively create a situation where development proves challenging to meet all stated requirements. The applicant is going above and beyond in other environmentally related areas than the simple impervious percentage calculation and requests consideration on the whole of these efforts. The requested variance is driven by the physical limitations of the site and the functional requirements of the use. b) Unique Conditions of the Parcel The conditions supporting this variance are unique to the subject property and were not created by the applicant. These include: ● The property is the last remaining undeveloped parcel within an otherwise fully developed Business Park district and has been vacant for decades, potentially due to the unique conditions of this Overlay District. ● The site is subject to overlapping regulatory constraints, including: o Shoreland Overlay District requirements o Wetland presence and associated protections o Minimum parking requirements as per the City code ● The combination of these factors results in a limited, irregular, and paradoxical buildable area compared to other parcels in the district ● Surrounding properties were developed under different conditions and are not subject to the same combination of constraints, and all far exceed 30% impervious surface coverage These characteristics are inherent to the parcel and create conditions that are not typical of other properties in the vicinity. c) Essential Character of the Locality Granting the variance will not alter the essential character of the locality. The surrounding area is characterized by: ● Industrial and business park uses ● Similar building scales and site layouts ● Developments with impervious surface coverage that regularly exceed the proposed 30% 43 The proposed project is consistent with these patterns and represents a lower-intensity use in terms of traffic and activity, as it: ● does not include retail or customer-facing components ● has a small number of employees on-site at any given time ● generates minimal daily traffic Accordingly, the proposed development will remain fully compatible with the surrounding area and will not introduce impacts inconsistent with the established character of the district. d) Harmony with the General Purpose and Intent of the Ordinance The purpose of the Shoreland Overlay District includes the protection of water resources through the limitation of impervious surfaces and the management of stormwater runoff. Although the proposed impervious surface coverage slightly exceeds the numerical standard, the project is designed to advance the underlying intent of the ordinance through multiple measures. These include: ● Significant reduction of impervious surface from the initial concept (from approximately 36% to 30%) ● Reduction in parking supply from that required by City code by 50% through an Interim Use Permit, avoiding unnecessary paved area ● Efficient site layout, including relocation of loading and circulation areas to minimize excess paving ● Preservation of wetland areas on the site and dedication of wetland buffers in accordance with City of Corcoran and Elm Creek Watershed rules. ● The proposed improvements are designed responsibly (in size and location) as to provide larger than required buffer and setbacks to further protect the natural resources as the intent of this ordinance. ● Planned incorporation of: o native landscaping o bioswales and stormwater management features o water-conscious design strategies Additionally, the applicant is pursuing LEED certification and integrating sustainability- focused design principles into the project. Taken together, these measures demonstrate that the project is consistent with and actively supports the environmental goals of the Shoreland Overlay District, even with a modest deviation from the strict impervious surface limit. 44 e) Consistency with the Comprehensive Plan The proposed variance and development are consistent with the goals of the City’s Comprehensive Plan, including: ● Supporting orderly and efficient development within designated business and industrial districts ● Encouraging economic development and job creation in appropriate zoning districts ● Promoting environmentally responsible land use practices, including stormwater management and resource protection The project represents an appropriate use of a fully planned business park parcel and incorporates sustainable design strategies aligned with the City’s long-term planning objectives. f) Conditions The applicant acknowledges that the City may impose reasonable conditions on the variance to address potential impacts. The applicant is willing to comply with conditions related to: ● stormwater management ● landscaping and buffering ● environmental protection measures as deemed appropriate by City staff and decision-makers. Conclusion The requested variance to allow approximately 30% impervious surface coverage is justified based on: ● the practical difficulties created by site constraints and operational requirements, ● the unique conditions of the parcel, ● the compatibility of the proposed use with the surrounding industrial context ● the project’s alignment with the intent of the Watershed Overlay District and Comprehensive Plan. The applicant has made substantial efforts to minimize impervious surface to the greatest extent practicable, including a significant reduction from the initial design and a right-sized parking approach. The requested variance represents a reasonable and limited adjustment that enables development of the site while maintaining strong environmental and planning outcomes. 45 Memo To: Kevin Mattson, City Engineer/Public Works Director From: Steve Hegland, PE Ben Otto, PE Project: Lost Loon Cannabis Site Plan Review Date: June 8, 2026 Exhibits: This Memorandum is based on a review of the Site Plan documents for the Lost Loon Cannabis site with the following documents. a. The proposed equipment will be supplied by CaptiveAire – refer to attached equipment submittals for initial selections and details, including decibel ratings on Page 7 of 14 and provided in the image below for reference. An emergency generator will be located at grade near the southeast corner of the building. A specific generator package has not yet been selected; however, it will be specified to be furnished with a sound enclosure. Vegetative screening will be installed between the generator and the public view. The generator will only operate during power outages and routine testing. Hours of Operation Hours of operation will vary depending on cultivation cycles and operational needs but will generally occur within standard business hours. Operations are not expected to generate significant off-hour activity beyond limited security presence and periodic monitoring. Acoustical Analysis The primary noise-generating equipment associated with the facility consists of packaged rooftop units and an emergency backup generator. The rooftop units are located near the center of the building roof and are separated from adjacent property lines by approximately 104 feet or greater. Given the distance to the property boundary, rooftop placement, planned parapet screening, and the relatively low sound ratings of the selected equipment, operational noise impacts are anticipated to diminish significantly before reaching adjacent properties. Routine facility operations are not expected to create objectionable noise conditions beyond the site boundaries. Rooftop Equipment Screening 48 A perimeter roof parapet is included to screen rooftop equipment. Please refer to the Architectural Plans for more details on screening. Vibration Isolation Vibration isolation for fans and compressors is integral to the RTU equipment package. Sound Barriers/Enclosures Please refer to Equipment Inventory section. Property Line Noise Projections Formal property-line noise modeling has not been completed for this preliminary equipment selection. However, the nearest rooftop unit is located approximately 104 feet from the closest property line. The combination of equipment setback, rooftop placement, parapet screening, and building massing is expected to substantially reduce sound levels at the property boundary. Final mechanical equipment selections will be specified to comply with applicable Minnesota noise standards. 49 Compliance with Local/State dBA Limits Minnesota Administrative Rules 7030.0040 Noise Standards dictate the sound level limits for specific lands uses. The Lost Loon site will be classified as Noise Area Classification (NAC) 3 for manufacturing. An image of the standard is provided below for reference. The decibel rating for the CaptiveAire RTUs is 70.1, which is less than the daytime limit of 75 for the NAC 3 land use. Based on the selected equipment sound ratings and site layout, compliance with Minnesota Rule 7030 is anticipated. Conclusion Based on the proposed mechanical equipment, building design, and operational characteristics of the facility, Lost Loon does not anticipate adverse noise impacts on adjacent properties. Noise- generating equipment will be screened and isolated where appropriate, rooftop units are located well within the site boundaries, and the emergency generator will be equipped with a sound- dampening enclosure and operated only during emergency conditions or routine testing. The facility is being designed to comply with applicable Minnesota noise regulations and City requirements. Lost Loon will continue to evaluate final equipment selections during the design process to ensure that operational noise remains compatible with surrounding land uses and consistent with applicable state and local standards. 50 Colorado HVAC REGION 124 PHONE: EMAIL: reg124@captiveaire.com FOR QUESTIONS, CALL THE EXHAUST FAN INFORMATION - JOB#8664207 3 4 FLOWER VEG 5 2 DU85HFA DU85HFA CAPTIVEAIRE CAPTIVEAIRE 1355 1550 0.500 0.500 1133 1220 TEAO-ECM TEAO-ECM 0.750 0.750 0.3100 0.3880 1 1 115 115 8.9 8.9 429 FPM 491 FPM 128 128 8.5 10 FAN UNIT NO TAG QTY FAN UNIT MODEL #MANUFACTURER CFM ESP RPM MOTOR ENCL HP BHP PHASE VOLT FLA DISCHARGE VELOCITY WEIGHT (LBS) SONES DOAS/RTU FAN SCHEDULE - JOB#8664207 1 2 FLOWER VEG 10 4 CAS-HVAC3-I.300-24-20T CAS-HVAC3-I.300-24-20T CAPTIVEAIRE CAPTIVEAIRE 24MF-3-RTU 24MF-3-RTU 5750 6000 0 0 5750 6000 2712 2712 1.000 1.000 10.00 10.00 3 3 460 460 54.3A 54.3A 60A 60A 85.8°F 85.8°F 76.0°F 76.0°F 75.0°F 80.0°F 62.4°F 69.6°F 46.2°F 56.7°F 46.2°F 56.7°F 46.2°F 56.7°F 48.8°F 59.5°F 47.4°F 57.7°F 255.8 MBH 255.6 MBH 179.7 MBH 152.4 MBH 18.2 18.2 7.9 7.9 65.4°F 70.0°F 59.4°F 67.3°F 121.3 MBH 86.2 MBH 129.6 MBH 129.6 MBH 66.4 LBS/HR 88.6 LBS/HR NATURAL NATURAL 300001 300001 243001 243001 41°F 40°F 7 IN. DESCRIPTION The LINEA series features distinctly linear design qualities and exceptional versatility. Perceptively capturing today's minimal design philosophy, the reduced form is sure to retain its validity far into the future. It is available in three mounting heights in single or twin mounting configurations. The pedestrian-scale model is 15 feet, with intermediate and larger sizes at 20 and 26 feet, respectively, giving proper scale for a variety of applications. Units for bi-level mounting are available, where the street-side luminaire is mounted high and a second fixture is mounted on the sidewalk side at a lower height for pedestrian illumination. An LED illuminating bollard for low- level pathway illumination complements the family of products. CSA Listed for Wet Locations. NLS Lighting Silicone Micro Optical System technology takes quality and performance to the highest level. Vandal resistant, superior clarity—Micro Optics have become the best and lasting solution in the industry. BENEFITS • Produces superior 96% clarity • Heat resistant to 150° C, 50% higher than acrylic • Ecologically friendly—no glare • Vandal-resistant • Does not brittle, crack, or yellow over time The type III distribution is meant for roadway lighting, general parking areas and other areas where a larger area of lighting is required. Type III lighting needs to be placed to the side of the area, allowing the light to project outward and fill the area. This produces a filling light flow. Type III light distributions have a preferred lateral width of 40 degrees. This distribution is intended for luminaires mounted at or near the side of medium width roadways or areas, where the width of the roadway or area does not exceed 2.75 times the mounting height. The type IV distribution produces a semicircular light meant for mounting on the sides of buildings and walls. It’s best for illuminating the perimeter of parking areas and businesses.
