The City Council special meeting was held in person and the public was present in person. The meeting was also available to view online through electronic means using live streaming service through Granicus. Mayor McKee, Councilors Friedrich, Lanterman, Nichols, and Vehrenkamp were present. Also present: City Administrator Tobin, Assistant City Administrator Williams, City Clerk Johnson, Human Resource Generalist Ganner, Public Safety Director Gottschalk, and City Attorney Thames. 1. Call to Order / Roll Call Mayor McKee called the meeting to order at 7:00 pm. 2. Scheduled Items a. Longevity Pay Assistant City Administrator Williams gave report to Council Council discussed Council has directed staff to come back with revised longevity pay options b. Section 2 Handbook Amendments Assistant City Administrator Williams gave report to Council Council discussed MOTION: made by Lanterman, seconded by Friedrich to approve updating Section 2 Handbook Amendments. Voting Aye: McKee, Friedrich, Lanterman, Nichols, and Vehrenkamp. (Motion carries 5:0) c. Benefits – Non-Union Police Officers Assistant City Administrator Williams gave report to Council Council has directed staff to come back with and updated red-line at next council for approval d. Memorandum of Agreement - Corcoran - Funeral Leave Update.pdf 36 MEMORANDUM OF AGREEMENT Between The City of Corcoran And Law Enforcement Labor Services, Local NO. 615 This Memorandum of Agreement is made and entered into by and between the City of Corcoran, hereinafter referred to as the “Employer” and Law Enforcement Labor Services, Local NO. 615, representing Police Officers hereinafter referred to as the “Union.” WHEREAS, the Employer and the Union are parties to a collective bargaining agreement effective January 1, 2026, through December 31, 2028; and WHEREAS, the Employer was granted council approval to change the funeral leave policy for non-union employees to broaden the criteria for leave and align with MN Employee Sick and Safe Time (ESST) Laws and WHEREAS, the Union desires to modify the funeral leave article, Article 22, in the collective bargaining agreement to match the approved funeral leave criteria for non-union employees. NOW, THEREFORE, the Employer and Union agree as follows: 1. Effective June 25th, 2026, the following Funeral Leave language shall be adopted. a. 22.1 Employees shall be granted three (3) days funeral leave to make funeral arrangements, attend a funeral service or memorial, or address financial or legal matters that arise after a death. 2. Effective June 25th, 2026, 22.2 can be removed. That definition of “immediate family” does not align with ESST law. a. According to MN ESST Law the following are considered family members: i. Children, including foster child, adult child, legal ward, child for whom the employee is legal guardian or child to whom the employee stands or stood in loco parentis (in place of a parent) ii. Spouse or registered domestic partner iii. Sibling, stepsibling or foster sibling iv. Since 2003, the Community Safety Grant program has awarded approximately $3.6 million in funding for nearly 1,800 safety-related projects across CenterPoint Energy’s service area. The carbon monoxide detectors will provide additional safety to police personnel while working in their assigned patrol vehicles. The devices will also be attached to the portable medical supply bags and will be used to help detect toxic levels of carbon monoxide when police personnel enter structures to render aid to others. The acquisition of the additional carbon monoxide detectors will enhance the safety of the City’s first responders and support the police department in it's mission to provide high-quality service to the public. Financial/Budget The Community Safety Grant awarded to the Corcoran Police Department is in the amount of $2,500. Options 1. The Minnesota Security Consortium does not operate or have access to their ALPR systems, therefore allowing it to audit the system as an independent auditor. The Corcoran Police Department had their new Flock ALPR system operational between 7/1/24 to 4/30/26. They had 9 active stationary Flock ALPR units They had no squad mounted mobile units, at the time of this audit. Department Policy & Procedures: The Corcoran Police Department has an ALPR Policy in place entitled, “Policy 427: Automated License Plate Readers (ALPR).” They have been keeping their policy updated and have recently reviewed it in 2025. A review of this policy found that the Corcoran Police Department was compliant with this part of the statute. Record Retention: The Corcoran Police Department’s ALPR Flock administrative control panel was audited to ensure that each setting was set for a retention period of no more than 60 days. The entire Flock system has a default 30-day retention period, which is set by the manufacturer. This was confirmed by the Flock Vehicle Reads Report. Corcoran Police Department was found to be compliant with this part of the statute. Data Security and Access Control: The Corcoran Police Department’s ALPR system is protected by an Access Control system built into the Flock backend server application. Users and groups were found to be current and appropriate for the intended use by the agency, allowing users only the minimum access that they need to perform their functions. User accounts and role-based accounts are reviewed on a regular basis by ALPR Administrators. The ALPR Administrators are appointed by the Corcoran Police Department’s Police Chief. A review of all users and their assigned roles was conducted as part of this audit. Roles and access were consistent for each user’s job description. Sharing Among Law Enforcement Agencies: Appropriate sharing of ALPR data is conducted through inter-agency requests. The requests are documented in the Flock system by agency and justification. A sample for the whole month of April 2026 was reviewed as part of the audit, and all samples had a justifiable reason for the ALPR data share by the requesting agency. As a result of these findings, the Corcoran Police Department was found to be compliant with this part of the statute. Public Log of Use: The Flock ALPR system also contains a robust audit trail which was sampled to determine if it is logging access by users properly. The Corcoran Police Department compiles monthly reports that contain the requirements of 13.824 Subd. 5. Sample reports were reviewed during the audit process. These public logs of use are readily available via a proper records request through the Corcoran Police Department. Command and Evidence staff were very cooperative throughout the entire audit process and understood the intent of the public accountability and provided easy access to policies and procedures, staff interviews, and audit of their ALPR Reports. Background The City Council previously reviewed a concept plan prepared by United Properties for this site on February 22, 2024 and May 21, 2024. The landowners now have an agreement with Hempel Development, LLC to present a new concept. The detailed development narrative describes the current proposal and contrasts it to the prior development proposal. 3. Context Zoning and Land Use The 76.89-acre site is guided Business Park in the Comprehensive Plan and zoned Business Park (BP). This is the only parcel of land guided Business Park in the 2040 Comprehensive Plan. The land is currently farmed. The site is located within the Metropolitan Urban Service Area (MUSA) in phase I of the Sewer Staging Plan. The site is also subject to the Northeast District Design Guidelines. Figure 1 - Site Location 86 Page 2 of 12 Surrounding Properties All surrounding properties are located within the MUSA and Northeast District. The properties to the north are guided Existing Residential and Low Density Residential and zoned Urban Reserve (UR) and Planned Unit Development (PUD). Properties to the east are guided Mixed Use and zoned General Mixed Use (GMU). Properties to the south, across County Road 30, are guided Mixed Use and zoned UR. Properties to the west are guided Mixed Use and zoned GMU. All surrounding properties are located within the MUSA and Northeast District. Natural Characteristics of the Site The Natural Resources Inventory (NRI) map identifies a disturbed woodland in the northeast portion of the site. The Parks and Trails map shows that same area as part of the Greenway Corridor. No wetlands are known to be on the property, but a notice of determination will be required. An EAW will be required for the proposed development. 4. Analysis Staff has reviewed the application for consistency with the Comprehensive Plan, Zoning Ordinance, Subdivision Ordinance, City Code requirements, and City policies. Concept Plan The applicant is proposing to purchase the western 2/3 of the site for development and leave the eastern 1/3 for future development with the land to be retained by the Oswalds. The development proposal is only for the western portion of the site to create five buildings (five lots and 2 outlots). The lots range in size from 4.99 acres to 8.46 acres. Each building will be on its own lot with the related parking and loading areas but will share a drive shared lot lines (between buildings 1 and 2 and buildings 3 and 4). Buildings range in size from 90,000 square feet to 117,000 square feet. For comparison, the buildings in Brockton Business Park are approximately 252,000 sq. ft. and 286,000 sq. ft. In addition to the 8.55-acre outlot for the pond, the applicant is showing dedication of 4.04 acres as City right-of-way and 7.07 acres as County right-of-way. Stormwater ponding, a public plaza, and a trail are located on the north side of the site. Zoning and Proposed Use The applicant intends to apply for approval of a business park development under standard zoning. Section 1040.120 of the Zoning Code states: “The intent of this district is to provide for the establishment of campus developments with a variety of office, low-impact manufacturing or assembly of a variety of products that create no exterior noise, glare or fumes. Uses allowed in this district are limited to those that are compatible with lower intensity residential and business uses and which have limited amounts of outside storage. Developments in this district will provide a number of amenities, including architectural controls, landscaping, preservation of natural features, etc. New development within this district will be allowed only when a full range of municipal services and facilities are available to serve the area.” The Business Park district allows manufacturing which does not produce exterior byproducts or objectional environmental impacts, laboratories/research facilities, office, office/warehouse, wholesale showrooms and warehousing and indoor storage used in conjunction with offices or manufacturing facilities. Warehousing/distribution and indoor storage is not permitted as a principal use in the Business Park district. Warehousing/distribution is not defined in the City Code, but the NAICS (North American Industry Classification System) code for general warehousing and storage is 493110 and describes it as “This industry comprises establishments primarily engaged in operating merchandise warehousing and storage facilities. These establishments generally handle goods in containers, such as boxes, barrels, and/or drums, using 88 Page 4 of 12 equipment, such as forklifts, pallets, and racks. They are not specialized in handling bulk products of any particular type, size, or quantity of goods or products.” A concern brought forth by the City Council during the previous concept plan reviews and workshop was that the concept plan as previously proposed would not align with the character of the business park zoning district as a low-impact business park. The Council identified the proposed building heights, number of loading dock doors, building depth, and building architecture as concerns. To address this concern, the applicant’s narrative describes the changes that have been made to the site’s design to cater to the intended low-impact business park character of the zoning district and produce buildings would not typically be compatible with the needs of warehousing and bulk distribution users. These changes include a reduction in loading docks, reduced building footprint, height and depth. The applicant’s narrative also proposes to record commitments to prohibit bulk-distribution and logistics uses from locating within the business park. The applicant’s narrative states: The Development Agreement standards Hempel proposes to commit to include the following. Specific thresholds will be finalized in coordination with City staff during the formal application process; the ranges below reflect the project as currently designed. • Maximum building clear height: 28 feet across the campus • Maximum total dock door count: approximately 60 doors across all five buildings • Minimum parking ratio: 1.40 stalls per 1,000 square feet of building area, to enforce employment density • Maximum building depth: 180 feet, with a single exception for Building 5 at 260 feet; providing flexibility for a tenant(s) who may need deeper space • Prohibited uses: bulk distribution and high-cube logistics, defined objectively by dock-to-square-foot ratio and clear height demand • Architectural standards: minimum glazing percentage on primary façades, maximum continuous panel run length, required articulation elements, and entry feature requirements • Landscape and screening standards: continuous landscape berming along County Road 30 and County Road 116 frontages, complete screening of all loading and service areas from public right-of-way • Community amenities: public plaza, integrated Three Rivers Regional Trail connection, and easements supporting future east-side trail alignment The City would need to continue to work with the developer to ensure that the end users conform to the BP District standards as part of the preliminary approval process. 89 Page 5 of 12 Lot Standards and Building Setbacks Section 1040.120 of the City Code establishes the following standards within the BP District: Required Minimum lot area 1 acre Minimum lot width 100 ft. Minimum lot depth 200 ft. Setbacks Front, from major roadways 100 ft. Front, from all other streets 50 ft. Side 20 ft. Rear 20 ft. Adjacent to residential 50 ft. Maximum Principal Building Height 45 ft. Maximum impervious surface coverage 70% The concept plan complies with the minimum lot area and appears to comply with the minimum lot width and lot depth, though the plan does not include dimensions. Lot dimensions should be included on future submittals. The applicant’s narrative indicates that the development complies with standards for principal building height. The concept plan does not indicate the impervious surface coverage for each lot, but it appears that several of the lots may not comply with this standard. The applicant should verify that future submittals comply with the impervious surface coverage requirements. The buildings appear to comply with the minimum setback requirements from lot lines, though this should be clearly dimensioned on future submittals. It appears that the buildings comply with the 100-foot setback from County Road 30 and County Road 116, but that the parking does not and parking flexibility as allowed by Section 1060.70, Subd 2 (L) is proposed. Buildings/Architecture The applicant has not provided any architectural details for the proposed buildings. Building design must comply with Section 1060.050, Subd. 1(C) which provides standards for buildings in non-residential zoning districts. Additionally, the applicant must comply with the Northeast District standards for materials and be designed to break up long elevations. At least 60% of each building face visible from off the site must be of class I materials which are described in the Northeast District Plan. No exterior wall may have an uninterrupted length exceeding 80 feet without including at least two of the following: changes in plane; changes in color, texture, materials or masonry pattern; windows; or an equivalent element that breaks up the elevation. 90 Page 6 of 12 The applicant’s narrative indicates their commitment to compliance with those standards. Additionally, the applicant notes that the building depth of 180 feet and building height of 24-28 feet will ensure that the buildings will draw business park users as they will not be suitable for bulk distribution users. Parking and Drive Aisles Section 1060.060 of the City Code establishes the following standards for parking area setbacks: Setbacks Required Front, from major roadways 100 ft. Front, from all other streets 50 ft. Side 10 ft. Rear 10 ft. Parking and loading area setbacks are not shown on the concept plan. However, it appears that the applicant is proposing a 50 ft. front setback for parking and drive aisles along the County roads. A parking setback reduction from 100 feet to 50 feet along County roads is permitted by right by Section 1060.070, Subd. 2.L. if additional landscaping is provided. It appears that the concept plan does not meet the parking and loading area setback standards for setbacks from front lot lines along local streets. • The plans must be updated to show compliance or request a variance. Parking facilities on separate lots in a development with a common lot line separating two or more parking lot areas are not required to comply with the parking/drive aisle setback from the common lot line. However, sites utilizing the zero-foot setback shall be limited to 60% impervious surface for the site. The applicant shall provide additional information with the preliminary plat to ensure compliance. Section 1060 of the Zoning Ordinance establishes the minimum number of parking spaces required based on the gross square footage of floor area for each land use. End users have not yet been identified but the applicant will need to make some assumptions about users with the preliminary plat application to ensure adequate parking is provided. The Northeast District standards include additional parking requirements: • Bike racks are required to be provided. o Bike racks are not shown on the plans. Future submittals shall include bike racks. 91 Page 7 of 12 • Parking bays shall have landscape islands at each end of the parking bay and bays in excess of 15 spaces in length shall be divided by intermediate islands. Trees are required in these islands. End island must be at least 360 square feet of area and Intermediate landscape islands shall provide at least 180 square feet of planting area. o It appears that the standard is met but island dimensions should also be included on future submittals. • A landscape buffer shall be provided between all parking areas and the public sidewalk. The buffer shall consist of shade trees, low shrubs or perennial flowers and a decorative fence or masonry wall. Plantings and parking lot screen walls or fences shall be no less than three feet and no more than four feet in height to allow views into and out of parking areas. o A public sidewalk is shown on the north side of east-west street and the west side of the north-south street. It appears that the landscaping complies on the north-south street but not the east-west. Plans must be revised. Section 1060.060 requires that parking areas with four or more stalls shall be screened from properties guided or zoned residential and from public streets. Screening to a height of at least three ft. shall be provided to screen vehicle headlights. The plan appears to comply with this standard, but additional detail should be provided in future submittals. Section 1060.060, Subd. 3(B.9) of the Zoning Ordinance prohibits off-street loading areas within 300 ft. of residentially zoned or guided property unless they are screened by an intervening building. The loading areas on Lot 3 and Lot 4 appear to be within 300 ft. of the residential property to the north and are not fully screened by the building. However, landscaping is shown on the concept plan to provide screening. • The applicant should revise the plan to provide a wing wall for screening or apply for a variance from this standard. Loading areas not requiring screening by an intervening building shall be screened from adjacent residentially zoned or guided property by the use of berms, fences, or walls to provide 100% opacity to a height of at least 10 ft. The Northeast District Guidelines establish additional requirements. Loading docks or overhead doors shall be oriented away from County Roads or residential property wherever reasonable, as determined by the City. If not reasonable and the loading docks or overhead doors are visible from County Roads or residential property, they shall be screened to 80% opacity year-round consistent with Section 1060.070, Subd. 2(J) of the City Code. The concept plan shows that the buildings do not screen the loading areas on Lot 3 and Lot 4 from the residential properties to the north as required. The loading areas on Lots 1 and 2 are screened from County Road 116 with landscaping. Additional details should be provided regarding the ability of the landscaping to provide year-round screening. 92 Page 8 of 12 Landscaping The concept plan includes conceptual landscape plan, though information about the number and species of trees and scrubs is not provided. The site is subject to the landscaping standards in Section 1060.070 which requires the following: • One overstory tree per 1,000 sq. ft. of gross building floor area or one tree per 50 lineal ft. of site perimeter, whichever is greater. o The plan does not provide enough information to determine whether the requirement for trees is greatest based on building sq. ft. or site perimeter. • One understory shrub for each 300 sq. ft. of building or one tree per 30 lineal ft. of site perimeter, whichever is greater. o The plan does not provide enough information to determine whether the requirement for shrubs is greatest based on building sq. ft. or site perimeter. Each lot will need to individually meet the standards for landscaping depending on its building size or lot perimeter. On some lots, the placement of required landscaping may be difficult, especially on lots with little open space to accommodate plant material. Future plans should show compliance with this standard. The plan shall comply with requirements for ground cover and tree and shrub species permitted within the Northeast District Design Standards and the City Code. Buffer Yards In addition to the landscaping requirements noted above, Section 1060.070, Subd. 2.J.1 requires buffer yards to be provided in perpetuity. The code requires the developer to provide a Buffer Yard D on the north and south property lines because the adjacent properties to the north are zoned Urban Reserve and PUD and the properties to the south are zoned Urban Reserve. However, the code allows the Council to waive the buffer requirement when the properties are separated by a major roadway. Council has the discretion to waive the buffer requirement on the south property line because the adjacent properties are separated by County Road 30. Staff believes this waiver is appropriate. Furthermore, the amount of landscaping required on site will already necessitate significant landscaping in this area. The amount of required landscaping is significant because the applicant must provide: o Base landscaping o Buffer landscaping (on the north and on the south if not waived by Council) o Additional landscaping to allow a 50-foot parking setback on the south where 100 feet is required. Much of the buffer area to the north is provided as ponding. Stormwater ponds and bio- retention ponds are allowed in perimeter setbacks and are allowed to encroach a 93 Page 9 of 12 maximum of 10 feet into required buffer yards. Easements shall be required over the buffer yard to protect it in perpetuity. It appears that the pond as shown encroaches more than 10 feet into the required buffer yard from residential along the north property line. • The applicant should revise the plan to comply with the buffer yard standards or apply for a variance. • Council should provide direction on waiving the buffer yard requirements on the south as the property is separate by County Road 30. Access/Streets The Northeast District Plan was funded by and developed in conjunction with Hennepin County. The location of the accesses onto County roads were conceptually approved by Hennepin County as part of that plan. Hennepin County reviewed the concept plan and provided preliminary comments related to access points. City staff will continue to work with the County to ensure compliance with adopted NE District plan and current County standards. The street plan developed shows four public street access points to this site. The concept plan generally complies with these connections, but the connection to the east should be adjusted to align with the connection in the Springs of Corcoran plan. A right-in/right-out connection is shown at the public street access to County Road 116. The Northeast District plans also show this as a right-in/right-out access, but Hennepin County would have permitting authority over this access. A full intersection, as conceptually approved in the Northeast District Plan, is shown at the public street access to County Road 30. It appears that the applicant has provided the required 65- foot ½ right-of-way, but this must be dimensioned and confirmed. The applicant did not provide right-of-way dimensions, but it appears the new streets are 60 feet of right-of-way. Section 975.010 establishes that the right-of-way width for local streets shall be determined by the City Engineer and shall be adequate to accommodate pavement width and other improvements within the right-of-way. The Northeast District Guidelines establish a standard of a 30-foot wide street and a 60-foot wide right-of-way for new public streets. The 60-foot wide north-south public street connection between County Road 30 and Bellwether is shown on the plans. Bellwether residents spoke at the February 8, 2024 Council meeting requesting additional accesses in and out of the development. Should this project proceed, it would complete one of these planned connections. Figure 4 - NE District Street Plan 94 Page 10 of 12 The attached engineer’s memo provides additional comments on this plan. A feasibility study would be completed in conjunction with the environmental review for the site. This would include a full traffic study. Utilities The site is located within the MUSA boundary and will be served by sewer and water. The applicant will be responsible for extending utilities to serve the site. During the feasibility study, the existing infrastructure’s ability to service the development will be reviewed. The City Engineer recommends dedication of a lot within the project as future municipal water supply well. This will be further evaluated as part of the feasibility study. Stormwater The applicant has proposed one large stormwater pond located in the north side of the site. As part of the development review plan, the applicant would be required to comply with state, watershed and local stormwater standards. The Northeast District guidelines describe that a mix of ponds, fountains and other water elements providing focal amenities should be employed within a framework of an environmentally responsible and visually pleasing strategy to manage stormwater. A stormwater management plan shall be provided by the applicant to confirm the proposed stormwater facilities are in accordance with the City of Corcoran and watershed standards. The Northeast District guidelines also require that this development provide a Chloride Management Plan. Parks and Trails Under Section 955 of the City Code, park dedication of land is required at 4% of the net pre-development area for Commercial and Industrial land or market equivalent in cash. Net acreage is not available at this time. Any wetlands on site would impact the final park dedication area calculations (net and gross) which must be provided with final plat application. The park dedication may be a combination of land for the trail and cash to satisfy the park dedication requirements. The Parks and Trails Plan map from the Comprehensive Plan identifies a proposed off- road trail along the length of the east property line. The trail would be part of the Three Rivers Park District’s (TRPD) Diamond Lake Regional Trail. The trail shown on the plan is generally consistent with conceptual trail realignment discussed as part of the Hope PUD on the west side of County Road 116. In August of 2024 TRPD completed a feasibility study regarding the construction of an underpass under County Road 116 for the trail. 95 Page 11 of 12 The Three Rivers Park District has provided comments regarding the proposed trail on the concept plan. These comments include concerns regarding the turning radius of the trail, grading around the trail, and drainage as it is impacted by the location of the pond along the west and north sides of the property. The applicant must work with the City and Three Rivers Park District to ensure adequate space is provided for this underpass and that the trail design standards are met. This alignment on the concept plan generally keeps the trail separate from the business park but would be accessible for employees in the park via the sidewalks that are required to be constructed on the public streets. The trail would ultimately extend north through Bellwether/Amberly developments by connecting to the trail spur west of 102nd Place. This trail would be 10 feet wide in a 30-foot wide easement. Park dedication credit would be given for the net acreage of the easement. Sidewalk connections from the buildings to the bike racks, trails, plazas and amenity spaces must be provided. Public Safety Public Safety Committee did not provide formal comments on the concept plan. However, they noted that the development will need to comply with all fire code standards for hydrants and fire lanes. Turning radius exhibits must be provided with the formal development application. Other Northeast District Standards In addition to the items previously discussed, the Northeast District requires all new developments to include at least three of the following resiliency options: xeriscaping, rain gardens/bio retention systems, landscaping with native species, green rooftops, aesthetic design, urban gardens, solar/wind energy or electric vehicle infrastructure. At this time, it is unclear which of these may be incorporated. The applicant shall provide information regarding these requirements during future submittals. The Northeast District Plan requires that all non-residential properties with principal buildings in excess of 100,000 square feet of floor area shall be required to have a public plaza space. Three of the proposed buildings exceed this floor area threshold. The design of the public plaza spaces shall include benches, bike racks, trash receptacles, lighting fixtures and other amenities to create a welcoming space for tenants of the building and members of the public. These plaza spaces should be visible from the public street and maintained by the landowner. The applicant’s plan currently shows one public plaza in the northeast corner adjacent to the proposed trail three “employee amenity spaces” but does not provide details on the design of the plaza or amenity spaces. • Council should discuss whether this is adequate to meet the intent of the standards. 96 Page 12 of 12 Environmental Assessment Worksheet (EAW) An EAW (Environmental Assessment Worksheet) is required for the warehousing or light industrial facilities that exceed 300,000 square feet. An EAW is not meant to approve or deny a project but instead act as a source of information to guide approval and permitting decisions. If the Council supports the concept as shown by the applicant, the applicant has stated that they intend to begin the EAW process immediately. City staff would prepare a scope of work, schedule and cost estimate for the EAW. No formal development application (preliminary plat, site plan, variance, etc.) may be approved until the EAW process is complete. Summary The concept plan appears to be generally consistent with the standards in the Business Park district. However, as with any concept plan, additional information is needed to show compliance with ordinance and Northeast District standards. Variances will be required if the applicant cannot show compliance with the City Code. The next steps would be: 1. Completion of the EAW (including the feasibility study) 2. Application for Preliminary Plat and Site Plan Approval (and variance of required) 3. Application for Final Plat (and Development Contract) Approval. 5. Recommendation Staff recommends that the City Council review and discuss the sketch plan and provide the applicant with informal comments. The 583,000-square-foot development is composed of five buildings sized and oriented to attract a diverse mix of office users, manufacturers, suppliers, and specialty businesses, with a parking ratio, architectural finish, and site design that distinguish this project from typical larger-scale industrial product. This project responds directly to the priorities the City has articulated: a diversified tax base that relieves pressure on residential property owners; quality, employment-rich businesses consistent with the City's business park zoning; thoughtful integra tion with adjacent developments; and a design that respects Corcoran's rural character and protects the experience of neighboring residents. NATURE OF THE REQUEST Hempel Real Estate is requesting concept plan review by the City Council and authorization to commence the environmental review (EAW) required to advance the project. Approval at this stage allows the project team to undertake the formal environmental analysis and refine the plan in coordination with the City, Hennepin County, Elm Creek Watershed, and other agencies. The proposed Phase 1 concept includes: • 583,000 square feet of total building area across five buildings ranging from 90,000 to 169,000 square feet • 54.25 gross acres, including 8.55 acres of stormwater ponding, 7.07 acres of County right - of-way dedication, and 4.04 acres of on-site right-of-way dedication • 833 parking stalls at a ratio of 1.43 per 1,000 square feet — substantially higher than the 1.0 per 1,000 typical of bulk industrial product, reflecting the higher employment density this campus is designed to support • Building clear heights of 24 to 28 feet, deliberately below the 32- to 36-foot heights that define bulk warehouse and distribution product • Integrated community amenities, including a public plaza, a Three Rivers Regional Trail connection along the north edge of the site, and a future trail alignment on the east side Subject to City Council authorization, the project team would commence the EAW immediately following sketch plan approval, target formal development approvals in Fall 2026, and commence construction of the first building in Spring 2027. RESPONDING TO THE COUNCIL'S 2024 CONCERNS In its September 26, 2024 work session on the prior sketch plan, the Council identified four specific concerns. The plan submitted today addresses each of them directly. Fit with Business Park Zoning — Designed for Low-Impact Office and Manufacturing Tenants The Council's central concern in 2024 was that a 670,000-square-foot campus with approximately 85 dock doors did not function as a low-impact business park — regardless of how it was labeled. We agree with that assessment. Oswald Office Park is designed at a substantially different intensity: • Total building area reduced from 670,000 to 583,000 square feet • Total dock door count reduced from approximately 85 to approximately 60 — a reduction of more than 30% percent • Building clear heights reduced from 32 – 36 feet to 24 – 28 feet, structurally eliminating bulk distribution users from the tenant pool • Predominant building depth reduced from 260 – 320 feet to 180 feet (four of five buildings), supporting multi-tenant, small-bay configurations, which will attract smaller, growing businesses needing a minimum of 15,000 SF • Parking ratio increased from approximately 1.0 to 1.43 stalls per 1,000 square feet — direct evidence of the higher employment density this campus is designed to support Each of these design decisions is intentional. Taken together, they make Oswald Business Park genuinely incompatible with bulk distribution use and align the campus with the office , light-manufacturing and limited warehouse tenant profile the City's business park zoning is designed to attract. 2. Building Aesthetics — Beyond Tilt-Up Warehouse Character The Council's 2024 critique of the proposed tilt-up warehouse aesthetic was direct, and we agree it is not the right character for this site or for Corcoran. All buildings in Oswald 101 800 LaSalle Avenue, Suite 1250 Minneapolis, MN 55402 T 612 355 2600 4 Business Park will be designed to the Northeast Area Design Standards, with specific commitments that go beyond those standards where appropriate: • Substantially greater glazing than typical industrial product, particularly at building entries and along primary façades • Articulated wall planes with material variation — no long, uninterrupted runs of single-material panel • Varied parapet heights and rooflines to break down the perceived scale of each building • Distinctive, high-quality entry features at each building tenant entrance, sized to a human scale • Coordinated landscape and hardscape design at building approaches These design commitments will be specified in the Development Agreement so that they are enforceable through site plan review at each phase of construction. 3. Traffic and Access — Trip Generation Appropriate for County Road Infrastructure In 2024 the Council questioned whether County Road 30 and County Road 116 could support the truck volumes that a 670,000-square-foot distribution-style campus would generate. That concern was well founded — a high-dock-count distribution facility can generate hundreds of truck trips per day, and the County Road network is not designed for that level of heavy-vehicle use without significant capacity investment. Oswald Office Park is designed for a fundamentally different trip pattern. The combination of lower dock count, smaller-bay tenancy, office and light-manufacturing tenant profile, and higher employment density produces trip generation more consistent with an office or business park than a distribution facility — significantly more employee passenger-vehicle trips, but far fewer truck trips and far less heavy-vehicle stress on the County Road system. A full Traffic Impact Study will be completed as part of the formal application, and Hempel commits to funding traffic-related improvements warranted by that study, consistent with the project's actual impact. Site access is configured to further reduce traffic impacts on residential properties. The primary full access is located on the east edge of the site, deliberately pulling employee and service traffic away from the County Road 30 / County Road 116 interse ction. The secondary access on County Road 116 is right-in / right-out only, eliminating the disruptive left-turn movements typical of larger commercial access points. 4. Office/Manufacturing-to-Warehouse Ratio — Enforceable Through Design and Agreement The Council in 2024 identified, correctly, that without an objective enforcement mechanism the City had no way to prevent a project from operating in practice as a distribution facility even if it was approved as a business park. The current zoning code does not yet provide that mechanism, and the Council acknowledged that the development of objective standards was needed. 102 800 LaSalle Avenue, Suite 1250 Minneapolis, MN 55402 T 612 355 2600 5 Hempel does not propose to wait for that code work to be completed. We propose instead to commit voluntarily to specific, objective, enforceable standards memorialized in the Development Agreement for Oswald Business Park. These standards — described in the next section — directly address the Council's 2024 concern and provide the certainty that the campus will be, and will remain, what this narrative describes. VOLUNTARY COMMITMENTS AND DEVELOPMENT AGREEMENT STANDARDS In its 2024 work session, the Council expressed a clear preference for objective standards — maximum dock door counts, defined office/manufacturing-to-warehouse ratios, architectural requirements, and similar measurable parameters — and noted that the existing code does not yet provide them. Rather than ask the Council to take the character of Oswald Business Park on faith, Hempel proposes to record specific, objective, enforceable commitments in the Development Agreement for this project. These voluntary standards are intended to give the City a binding mechanism for ensuring that the project delivers on the commitments described in this narrative. The Development Agreement standards Hempel proposes to commit to include the following. Specific thresholds will be finalized in coordination with City staff during the formal application process; the ranges below reflect the project as currently designed. • Maximum building clear height: 28 feet across the campus • Maximum total dock door count: approximately 60 doors across all five buildings • Minimum parking ratio: 1.40 stalls per 1,000 square feet of building area, to enforce employment density • Maximum building depth: 180 feet, with a single exception for Building 5 at 260 feet; providing flexibility for a tenant(s) who may need deeper space • Prohibited uses: bulk distribution and high-cube logistics, defined objectively by dock-to- square-foot ratio and clear height demand • Architectural standards: minimum glazing percentage on primary façades, maximum continuous panel run length, required articulation elements, and entry feature requirements • Landscape and screening standards: continuous landscape berming along County Road 30 and County Road 116 frontages, complete screening of all loading and service areas from public right-of-way • Community amenities: public plaza, integrated Three Rivers Regional Trail connection, and easements supporting future east-side trail alignment These commitments are designed to address every concern the Council raised in 2024, and to give the City the certainty it has rightly indicated it wants. We welcome the opportunity to work with staff and Council to refine these standards in advance of the formal application. SITE DESIGN NARRATIVE The site plan reflects three guiding principles developed in close coordination with City staff and informed by the constraints and opportunities of the surrounding context. 1. Coordination with adjacent developments 103 800 LaSalle Avenue, Suite 1250 Minneapolis, MN 55402 T 612 355 2600 6 The Oswald site is bordered by the Hope Development to the west and the Bellwether Development to the north. The plan is designed to coordinate stormwater management with Hope Development, share sanitary sewer infrastructure where efficient, accommodate the planned Three Rivers Regional Trail alignment, and architecturally complement adjacent commercial uses. 2. Screening, buffering, and the public realm The plan provides continuous landscape berming along the County Road 30 and County Road 116 frontages, a layered buffer combining berm, evergreens, and deciduous trees, and complete screening of all loading and service areas from the public right-of-way. The 8.55-acre stormwater pond on the north side functions as both required infrastructure and a visual amenity. The public plaza, the trail connections, and the employee amenity areas distributed across the site together establish a publicly accessible character that does not exist in conventional industrial development. 3. Trail and public access The plan incorporates the Three Rivers Regional Trail alignment along the north edge of the site, but south of the pond—to address neighborhood concerns—and reserves a future trail connection on the east. These connections benefit both the campus's employees, who will be able to walk or bike to work, and the broader community, which gains a continuous trail experience across the property. ALIGNMENT WITH CITY GOALS 1. Tax base diversification and relief for residential property owners Corcoran's residential growth, while a sign of the City's success, has placed an increasing share of the local tax burden on homeowners. Non-residential development — and the kind of higher-value, employment-rich, durable non-residential development this project represents — is one of the most effective tools available to the Council to relieve that pressure. The Oswald property currently generates minimal property tax revenue as agricultural land — approximately $9,000 per year. At stabilization, Oswald Business Park is projected to contribute approximately $1.5 - $2 million in annual property tax revenue — a substantial, durable, non-residential addition to the City's tax base that will recur every year for decades. 2. Job creation and quality employment The Oswald Business Park is designed for office users, light manufacturers, limited warehousing, medical and device companies, specialty industrial businesses, and other employment-rich tenants. Based on the 1.43-per-1,000 parking ratio and the campus tenant profile, the park could support an estimated stabilized employee population in the range of 400 – 500 employees — a meaningful daytime workforce that will, in turn, generate demand for restaurants, retail, services, and housing in Corcoran. Construction of the park 104 800 LaSalle Avenue, Suite 1250 Minneapolis, MN 55402 T 612 355 2600 7 will generate several hundred additional construction person-years of employment for local and regional trades. 3. Infrastructure efficiency and connectivity Hempel is committed to advancing infrastructure improvements that benefit the broader corridor. The plan dedicates 7.07 acres of County right-of-way and 4.04 acres of on-site right-of-way to support roadway improvements consistent with the Northeast Distri ct Plan. Stormwater management will be coordinated with the adjacent Hope Development to reduce redundancy and maximize efficiency. The project's trail connections support multi- modal circulation through the corridor, and the project team will fund traffic -related improvements warranted by the Traffic Impact Study. 4. Sustainable design and stormwater management The 8.55-acre stormwater facility on the north side of the site is sized and located to manage runoff from the campus and integrate with adjacent stormwater systems. Best management practices, including native vegetation, will be employed throughout the site. Landscape design will favor native and adapted species to reduce long -term maintenance and water demand and to provide visual and acoustic buffering for adjacent properties. 5. Promoting Corcoran's character Through architectural quality, generous landscape buffers, the integration of a public plaza and trail connections, and the deliberate selection of a building program that supports employment and small-business tenancy rather than bulk logistics, Oswald Business Park is designed to advance the kind of growth Corcoran has said it wants: thoughtful, employment-rich, attractive, and respectful of the City's rural character. HEMPEL'S INVESTMENT IN CORCORAN Hempel Real Estate and its joint venture partner TPG Angelo Gordon have invested approximately $70 million in the development of Brockton Business Park, located approximately one mile from the Oswald site. Phase I of Brockton has leased exceptionally well, and Phase II is scheduled to commence construction in early June 2026 — a clear signal of the strength of the Corcoran submarket and of the demand for the kind of quality industrial and employment product that Hempel delivers. Our experience at Brockton has shaped our approach here in two important ways. First, it has reinforced for us how productive a partnership with the City of Corcoran can be when both parties are aligned on community-focused outcomes. Second, it has given us direct visibility into the tenant demand we are seeing in this corridor — visibility that informed the deliberate decision to design Oswald Business Park for a different, more diverse, and more employment-rich tenant profile than Brockton. CONCLUSION Oswald Business Park is the right kind of development at the right time for Corcoran. It delivers the tax base diversification residents are asking the Council to pursue. It integrates community amenities — a public plaza, trail connections, generous landscape buffers — that go well beyond typical industrial development. It is designed and capitalized by a team with a demonstrated track record in Corcoran and the institutional backing to execute. It has been shaped, at every step, by the feedback the City has already provided. And it offers binding, voluntary commitments that address each of the concerns the Council raised in 2024 and give the City the certainty it has rightly indicated it wants. In addition to engineering related comments, the proposed plans are subject to additional planning, zoning, land-use, and other applicable codes of the City of Corcoran. 2. A Feasibility Study on the infrastructure needs and impacts of the development will be conducted and utilized in the Environmental Assessment Worksheet. Plat: 1. With the proposed development, the applicant shall be responsible for providing all necessary easements as required by City Code and as necessary to access and maintain the infrastructure associated with the development. This could include having to obtain offsite easements if necessary to support the infrastructure requirements of the development. 2. Any existing easements which conflict with the proposed plan will need to be vacated. 3. A dedicated lot shall be provided for a municipal water supply well. 4. A 65-foot half ROW dedication appears to be shown along the County Roadways which is consistent with the NE District Plan and recent Hennepin County requests. 5. A 60-foot ROW is shown for the collector roadway through the site. This is consistent with the NE District Plan. The final ROW and easements necessary for the development would be determined with the site plan development to ensure adequate room exists to install maintain public infrastructure. 6. Additional ROW may be necessary at the access locations to the development to support access improvements as determined by the feasibility study and/or required by Hennepin County. Erosion Control/SWPPP 1. Preparation of and compliance with a SWPPP shall be required for construction. Transportation 1. A full Traffic Impact Study of the surrounding roadway system will be required as part of the Feasibility Study. 108 June 2026 Oswald Farm Concept Kevin Mattson Page 2 of 3 2. All roadways shall match City standard details. 3. County has jurisdictional authority for both CR 30 and CSAH 116 access locations. The NE district plan had identified the access point to County Road 30 at approximately 1/4 of a mile spacing from County Road 116 however the County has indicated 1/3 mile spacing may be preferred which is generally consistent with the proposed site plan. 4. The access from County Road 116 was identified in the NE district plan at this general location. This is being proposed as a private access which will need to be approved by Hennepin County. 5. The north-south roadway is proposed to be connected to a cross street which connects to the existing residential neighborhood to the north and future extension to the east. This layout is preferred as it doesn’t create a direct connection to the north which helps discourage traffic through the residential neighborhood. The connection to the east shall connect to the roadway network within the adjacent parcel. This connection location may vary slightly from what is depicted on the concept plan. 6. Temporary turnarounds meeting City standards are required at the end of dead-end streets to the east to facilitate emergency vehicle movements. 7. The access drives for lots 1,2,3 and 5 should be relocated to have better spacing from the adjacent intersections. 8. The trail through the site is planned to be a Three Rivers Regional Trail. Adjustments to the trail alignment and geometry should be expected to construct the trail to their required standards. Site Plans 1. Street lighting locations shall be provided with the development and should be incorporated into the developments design drawings. . 2. The Three Rivers Regional Trail connection is shown at the proposed underpass from the adjacent proposed Hope Development. The applicant shall dedicate the necessary easements for this underpass construction, which is anticipated to be a Three Rivers directed project at a future date. 3. The Rivers Trail will be crossing the public roadway near the NE intersection within the development. All trail and sidewalk crossings shall be in accordance with the Pedestrian Crosswalk policy. Improvements to this crossing facility should be anticipated with the development. Stormwater 1. The majority of the existing site drains to the north with a small portion that appears to drain south under County Road 30. Conceptually the ponding is all shown along the north of the site but some BMP’s may be necessary to the south. o Any offsite drainage improvements necessary to mitigate the stormwater affects from the proposed development is the developer responsibility. This will be reviewed with the Feasibility Study. o City prefers NURP ponds with filter benches as BMPs to use the land efficiently and minimize cost of future maintenance for the landowners. 2. Existing draintile locations should be shown on the existing conditions survey submitted with Preliminary Plat. o Historical information shows a draintile is routed through the site which conveys water from west of County Road 116, continues across this parcel and discharges to the north. Applicant shall ensure that downstream receiving waters (potentially wetlands) are not starved of necessary runoff. 4. A stormwater management plan shall be provided to confirm that stormwater management is in accordance with City of Corcoran and Elm Creek Watershed Management Commission Standards. 5. Reference the City of Corcoran Stormwater Guidelines for Development Review for standards for stormwater systems and modeling. 6. A wetland delineation will be required for the site to identify any existing wetlands. 7. Several wetlands along the northern property line were identified with the Bellwether development. Applicant shall be responsible for ensuring hydrology to wetlands is maintained with the proposed improvements. 8. The wetland buffer zones and wetland buffer signage shall also be clearly identified and labeled. 9. All drainage swales shall maintain a minimum of 2% slope and all slopes should be 4:1 or flatter unless approved by the City Engineer. 10. If wetlands are impacted, they shall be reviewed and approved through the appropriate WCA permitting process. 11. At the time of Preliminary Plat, the wetland buffers should be identified as either newly established wetland buffers or whether they are existing buffers as defined by City Code. Watermain/Sanitary Sewer 1. Watermain stub is available at the adjacent Bellwether development and additional watermain connections may be necessary to the adjacent proposed Hope development or development to the east, if available. The water supply requirements of the development will be reviewed with the Feasibility Study. 2. Trunk watermain will need to be extended east/west across the development and utility stubs will need to be extended to the lot lines at a minimum. 3. Sewer will be available to west (proposed Hope Development) and is currently available to the northeast (Bellwether). 4. Don’t think they need it. What if people want to go south? They’d want to make a U-turn and they don’t have anything. • Looking at Access Spacing Guidelines, we would want 1/2 mile access spacing for full access, which this design does not meet. • On CSAH 30 there may be a need to have 1/3 mile spacing, especially if we have roundabouts eventually. Based on the comparable cities data, staff developed a proposed longevity pay structure based on the approach used by the City of Rogers. While the City of Rogers model begins after 1 year of service, the proposed City of Corcoran model would begin after 10 years of service. Staff did not include a model based on the City of Orono, as it was understood that Council direction was to not modify employees' base pay rates. The budget impact is shown below. Employees will be paid $100 for each full year of full-time service completed with the City on an annual basis. Employees will receive this longevity payment each year after their 10 – year anniversary. For example, an employee with 10 years of full-time service would receive a payment of $1,000. An employee with 11 years of full-time service would receive $1,100. The process has been informed by intentional research and engagement to include: six Civic Campus Open Houses for the community; eight site visits to similar "model" facilities in other cities with the staff, consultants, and Mayor McKee; return visits to the two city facilities (Chanhassen and New Hope) that best reflected project goals with staff, consultants, and Councilor Members Vehrenkamp and Nichols; a community wide survey sent to every household with 19.6% response rate reflecting 56% of respondents support building a new City Hall and Police Department facility, 24% not in support, and 20% not sure, and the majority of respondents preferring a 20 year facility option to the 10 year option. At this point in the process, continued clarification of Council desires and direction are critical to refining details with our professional partners, BKV and Kraus Anderson, for schematic design needed for finalizing a budget. Therefore, staff requests discussion of Council desires and direction to ensure the process is moving toward the strategic objectives Council envisioned for the 2027 construction.
