HomeMy WebLinkAbout2006-226 Amending Chapter IX - Subdivision Ordinance Adopted 01/26/06 CITY OF CORCORAN ORDINANCE NO. 2006-226 AN ORDINANCE AMENDING THE TEXT OF CHAPTER IX OF THE CORCORAN CITY CODE ENTITLED THE CORCORAN SUBDIVISION ORDINANCE (CITY FILE NO. 05-032) THE CITY COUNCIL OF CORCORAN ORDAINS: SECTION 1. Amendments. The text of Chapter IX of the Corcoran City Code is hereby amended as follows: A. SECTION 920.015 (DEFINITIONS) IS HEREBY AMENDED BY ADDING, DELETING OR CHANGING AS FOLLOWS: Buildable Area: That portion of the lot on which buildings or structures are functionally possible and permitted to be located by regulation. Buildable areas do not include protected wetlands, floodplain area, building setback areas, public waters, easements or other similarly restricted areas. B. SECTION 920.020 (SUBDIVISION APPROVAL REQUIRED) IS HEREBY AMENDED BY ADDING, DELETING OR CHANGING AS FOLLOWS: 920.020 - Conveyance by Metes and Bounds. All property conveyances must be made by plat, except property divisions by metes and bounds may be allowed for those separations where all the resulting parcels, tracts, lots, or interests will be 20 acres or larger in size and 500 feet in width for residential uses and 5 acres or larger in size for commercial and industrial uses. These subdivisions are exempted by State Statute.without platting in cases where the legal description creating the division consists of one straight line, simply described and the resulting parcels are not less than 10 acres in size with a minimum of 3 contiguous buildable acres. City staff, including the City Attorney, City Engineer and City Planner, shall determine what constitutes a simply described line. Such land divisions must be approved in accordance with the platting process established in this Ordinance. Any further subdivision of such properties shall be platted. Building permits will be withheld for buildings or tracts which have been subdivided and conveyed by this method and the City may refuse to take over tracts as streets or roads or to improve, repair or maintain any such tracts. C. SECTION 920.030 (SUBDIVISION APPROVAL REQUIRED) IS HEREBY AMENDED BY ADDING, DELETING OR CHANGING AS FOLLOWS: 920.030 - Registered Land Surveys. All registered land surveys shall be filed subject to the same procedures as required for the filing of a preliminary plat for platting purposes. The standards and requirements set forth in this Chapter shall apply to all registered land surveys. A registered land survey shall not be used to divide a parcel of land into lots for Ordinance 2006-226 Page 2 the purpose of transfer of ownership or building development if any of the tracts would not have the required frontage on a dedicated and improved public street. D. SECTION 925.010 (PREMATURE SUBDIVISION PROHIBITED), SUBD. 4 IS HEREBY AMENDED BY ADDING, DELETING OR CHANGING AS FOLLOWS: Subd. 4. Lack of Adequate Waste Disposal Systems. A proposed subdivision shall be deemed to lack adequate waste disposal if there is inadequate on- site sewer capacity to potential to support the subdivision if developed to its maximum permissible density. SECTION 2. Effective Date. This Ordinance shall be in full force and effect upon its passage. ADOPTED by the City Council on January 26, 2006.
