Planning Commission Meeting Minutes

Present: Chair Hank, Jacobs, Ravnholdt, Kadlec, and Alternate Wu who was asked by Hank to
join the Commission due to absences of two members.
Absent: Laddusaw, Krueger
Others present for the meeting: Council Liaison Gmach, Councilor Asleson, City Administrator
Donahue, and Planner Kendra Lindahl.
1. Call to Order. Chair Hank called the meeting to order at 7:00 pm
2. Pledge of Allegiance
3. Open Forum. None
4. Approval of:
a. Agenda. Hank said he would move items 5 a & b and renumber them items 6 a & b.
MOTION by Ravnholdt/Kadlec to approve the agenda with proposed change. All voted aye.
(Motion carried 5:0)
b. June 2, 2011 Planning Commission Minutes. MOTION by Ravnholdt/Jacobs to approve
the June 2, 2011 minutes as presented. All voted aye. (Motion carried 5:0)
5. Unfinished Business. None
6. New Business
a. PC 11 -005. Custom Filtration Conditional Use Permit Amendment and Site Plan
Amendment at 7219 CR 116 (PID: 26- 119- 23 -41- 0004).
i. Staff Report. Planner Lindahl presented a report on her findings
and recommendation
ii. Chair Hank opened the public hearing.
iii. Public Comment. Blake Johnson, 19916 Abilene Lane asked to be
recognized. He is a neighbor to the Custom Filtration site. Stated
they are good neighbors and requested if possible to include a
privacy fence on the south side of the property. No other persons
spoke.
iv. Motion by Kadlec / Ravnholdt to close the public hearing. All voted
aye. (Motion carried 5:0)
v. Discussion. Commissioners asked planner about:
1. How a setback is measured -from property line
2. Hennepin county plans for widening Co. Rd 116 or acquiring
new Right of Way -not known at this time but probably a
minimum width for future county roads is 50 feet for half
Right of Way
3. Planner explained ponding issues and ponding easement as laid
out in her memo
vi. Motion by Ravnholdt/Jacobs to approve as recommended and presented
by planner (with some spelling corrections) Ordinance 2011 -260
Amending Zoning Ordinance, Resolution 2011 -33 Finding of Facts, and
Resolution 2011 -34 Approving Site Plan Amendment and CUP. All voted
aye. (Motion carried (5:0)

b. Update on Zoning Ordinance /Map amendment process. Planner discussed the
council meeting of June 23, 2011 and the discussion by the city council on the
zoning code recommendations passed by the Planning Commission on June2,
2011. The council had a lot of questions and asked that the PC be approached
about holding a joint City Council /Planning Commission meeting on August 4,
2011 to work through concerns and issues. A major issue that came up with the
council was building height of accessory structures.
C. Update of Subdivision ordinance. Planner Lindahl explained the necessity of
updating the subdivision ordinance caused by the passing of the 2030
Comprehensive Plan. Council Liaison Gmach talked about the council's concern
that the zoning ordinance and subdivision ordinance will have substantial impact
on the existing property owners in thee city and there was a need expressed by
the council to better understand those impacts before proceeding. Gmach
expressed his concern about the creation of non - conforming uses if the
ordinance updates go through to present property owners.
7. Reports:
a. Councilor Gmach updated the commissioners on the council activities over the
past month. He re- emphasized a desire by the council to have a joint meeting of
the Council and PC perhaps as soon as August 4, 2011.
b. Planner informed the commission of efforts by the League of Cities on the
changes to the Variance process, and that this would be presented soon.
c. Planning Project Update. Planner discussed briefly upcoming PC matters
d. Other Business. None
