A RESOLUTION APPROVING AN EXTENSION OF THE FINAL PLAT APPROVAL FOR
"SAVOIE FIELDS" FOR PROPERTY LOCATED AT 21801 HOMESTEAD TRAIL {RID 28 -119-
23-43 -0007}
WHEREAS, Terry and Karen Savoie have requested and received approval of a final plat to
create 2 lots on property legally described as follows:
The West % of the Northeast'/ of the Southwest' /4 of the Southeast 1/4 of
Section 28, Township 119 North, Range 23 West of the 5th Principal Meridian,
Hennepin County, Minnesota;
And
The South %2 of the North %2 of the East'/ of the Southwest'/ of the Southeast
'/ of Section 28, Township 119 North, Range 23 West of the
5th Principal Meridian, Hennepin County, Minnesota;

The East V2 of the West' /2 of the Southwest' /4 of the Southeast'/ of Section 28,
Township 119 North, Range 23 West of the 5th Principal Meridian, Hennepin
County, Minnesota
WHEREAS, the Corcoran City Council adopted Resolution 2008 -07 on January 28, 2008
approving a final plat for Savoie Fields;
WHEREAS, Section 935.010, Subd. 7 of the Corcoran City Code states that the final plat shall
expire 2 years from the date of approval unless the applicant has recorded the final plat with
Hennepin County or unless the applicant submits written request for an extension;
WHEREAS, the applicant has requested a 1 year extension to the final plat approvals as
allowed by Section 935.010, Subd. 7 of the City;
WHEREAS, the Corcoran City Council adopted Resolution 2009 -58 approving a one year
extension to the final plat approvals, which extended the expiration date to January 28, 2011;
WHEREAS, the final plat approvals expired on January 28, 2011;
WHEREAS, the final plat has not been filed and the applicant is now requesting an additional
extension;
WHEREAS, the City Council finds that the applicant has made good faith efforts to complete the
platting process, granting the time extension request does not damage the City of Corcoran and
is in the best interest of the applicant;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORCORAN, MINNESOTA, that it should and hereby does approve the request for an
extension of the final plat approvals until January 28, 2012, subject to the following:
1. The applicant must record the final plat and all associated documents at Hennepin
County prior to January 28, 2012.
2. The applicant shall provide the City with proof of recording prior to release of any
remaining escrow.
3. The applicant must comply with all conditions of final plat approval in Resolution 2009-
58, specifically:
a. A final plat is approved to allow the creation of Lots 1 and 2, Block 1 in accordance
with the plans and application received by the City on December 11, 2007 , except
as amended by this resolution.
b. One building right has been used for the existing home on Lot 1 and one will be used
for the new home on Lot 2. Upon use of the Lot 2 building right there will be zero (0)
building entitlements remaining for future development on Lots 1 and 2, Block 1,
Savoie Fields.
c. All conditions of the preliminary plat must be met.
d. The applicant shall comply with all comments received from Bonestroo, the Elm
Creek Water Management Commission, and the Hennepin County Human Services
Department.
e. Prior to release of the final plat, the Developers shall pay Park Dedication fees for
the one (1) new lot, subject to the park dedication requirements at the time of the
release of the final plat for filing. Currently the "cash" donation would total $6,000.
f. The existing garage along the south line of Lot 1, which encroaches upon the
dedicated drainage and utility easement, is a non - conforming structure and subject
to partial or complete demolition without compensation if necessary to effectuate the
use of the aforesaid easement.
