No.'s 2&119-2�31-0003 WHEREAS, Mr. Clinton Heitke has requested approval of a preliminary plat to create two (2) lots and two (2) outlots on the property legally described as follows: "The Southwest Quarter of Section 28, Township 119 North, Range 23 West of the Fifth Principal Meridian, according to the Government Survey thereof, subject to existing public roads and highways. Except that part thereof described as follows: The South 264 feet of the West 165 feet of the East 495 feet of the Northeast Quarter of the Southwest Quarter of Section 28, Township 119 North, Range 23 West of the Fifth Principal Meridian, subject to an existing easement for road purposes over the South 33 feet thereof, as appears of record in the U.S. Government Survey thereof. Also except that part thereof described as follows: That part of the Southwest Quarter of the Southwest Quarter, Section 28, Township I 19, Range 23, Hennepin County, Minnesota, described as follows: Commencing at the Northeast corner of said Southwest Quarter of the Southwest Quarter; thence on an assumed bearing of North 89 degrees 51 minutes 20 seconds West along the North line of said Southwest Quarter of the Southwest Quarter, a distance of 766.43 feet to the point of beginning; thence South 00 degrees 54 minutes 56 seconds East, a distance of 498.76 feet; thence North 89 degrees 51 minutes 20 seconds West, parallel with the North line of said Southwest Quarter of the Southwest Quarter, a distance of 365.95 feet; to the center line of Rolling Hills Road; thence North 31 degrees OS minutes 30 seconds East along said center line, a distance of 581.44 feet to the North line of said Southwest Quarter of the Southwest Quarter; thence South 89 degrees 51 minutes 20 seconds East along said North line, a distance of 57.72 feet to the point of beginning. Subject to public road easement." NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request by Mr. Clinton Heitke for a final plat; and 1 FURTHER, that the development contract for said plat shall be completed by the City Attorney and that the Mayor and City Clerk are authorized to execute the development contract on behalf of the City; and FURTHER, that the final plat shall be subject to the following findings and conditions: 1. A final plat is approved to a11ow the creation of Lot l, Block 1; Lot 1, Block 2 and Outlots A and B in accordance with the plans and application received by the City on October 15, 2007, except as amended by this resolution. 2. A waiver from the requirement for a topographic survey for Lot l, Block 1 and Outlots A and B was granted on September 13, 2007. 3. Lot l, Block 1 and Outlots A and B will continue to be farmed and, therefore, shall be exempt from the wetland buffer, setback and permanent monument signage requirements. When development occurs, the site shall be subject to the wetland buffer, setback and permanent monument signage requirements in place at that time. 4. Any future subdivision of Lot 1, Block 1 and Outlots A and B shall comply with the City's minimum lot standards in place at that time. 5. There are fifteen (15)building entitlements remain for future development on Lot 1, Block 1 and Outlots A and B. 6. All conditions of the preliminary plat must be met. 7. That all wetlands, ponds, creeks, etc be shown on all lots and outlots within the final plat, pursuant to State Statute 505.02. 8. Prior to release of the final plat, the Developers shall satisfy the amount of the Transportation Area Charge by submitting an irrevocable letter of credit in the amount of$8,000 to the City in a form acceptable to the City. The letter of credit shall remain in place for a period of one-year from the date of submission and shall be payable at the bank issuing the letter upon presentation by the City, whether in person or by mail, of a signed statement evincing the assessment of the charge. A11 costs associated with obtaining the letter of credit shall be paid by the Developer. 9. Prior to release of the final plat, the Developers shall pay Park Dedication fees for the one (1) lot, subject to the park dedication requirements at the time of the release of the final plat for filing. Cunently the "cash" donation would total $6,000. 10. The applicant must file the final plat at Hennepin County 11.
