A RESOLUTION AMENDING
CHAPTER 70: TRAFFIC RULES
WHEREAS, Chapter 70 of the Corcoran City Code entitled "Traffic Rules" adopts
and incorporates state law for regulating the use of highways, streets and alleys within the
City, as well as the sta.te penalties for violations of those state laws; and
WI-�REAS, Chapter 132 of the Corcoran City Code entitled"Administrative
Offenses"provides for administrative penalties for oi�enses set forth under state law; and
WHEREAS, Chapter 70 needs to be modified in order to comport with the
offenses and penalties provisions of Chapter 132.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Corcoran that Chapter 70 is hereby amended as follows:
70.01 STATE PROVISIONS ADOPTED.
The regulatory provisions of M.S. Chapters 169 and 171 Annota.ted,
together with all amendments thereto, are hereby adopted as a traffic code
regulating use of highways, streets and alleys within the city and are hereby
incorporated and made a part of this section as completely as if set out
herein full.
The penalty for violations of the provisions of state statutes adopted by
reference in this section shall be identical with the penalties provided for in
the sta.tutes for the sazne offence�unless otherwise provided for under
Corcoran CityCode Chapter 132 and any resolution adopted thereunder.
The choice of penalty shall be in the discretion of the Corcoran Police
Department.
Notwithstandin� anv other ordinance, onlv licensed peace officers have
authority to enforce trafFic re�ulations adopted herein.
All other provisions of Chapter 70 remain unchanged.
