HomeMy WebLinkAboutRES 2007-73 APPROVING THE PRELIMINARY PLAT FOR "HEITKE FARM" ON PREOPERTY LOCATED AT 7200 ROLLING HILLS ROAD � . � City of Corcoran County of Hennepin State ofMinnesota CITY OF CORCORAN RESOLUTION 2007-73 MOTION BY: Thomas SECONDED BY: Grabowski A RESOLUTION APPROViNG THE PRELIMINARY PLAT FOR"HEITKE FARM"ON PROPERTY LOCATED AT 7200 ROLLING HILLS ROAD P.I.D.No.'s 28-119-23-31-0003 WHEREAS, Mr. Clinton Heitke has requested approval of a preliminary plat to create two (2) lots and three (3)outlots on the property legally described as follows: "The Southwest Quarter of Section 28, Township 119 North, Range 23 West of the Fifth Principal Meridian, according to the Government Survey thereof, subject to existing public roads and highways. Except that part thereof described as follows: The South 264 feet of the West 165 feet of the East 495 feet of the Northeast Quarter of the Southwest Quarter of Section 28, Township 119 North, Range 23 West of the Fifth Principal Meridian, subject to an existing easement for road purposes over the South 33 feet thereof, as appeais of record in the U.S. Government Survey thereof. Also except that part thereof described as follows: That part of the Southwest Quarter of the Southwest Quarter, Section 28, Township 119, Range 23, Hennepin County,Minnesota,described as follows: Commencing at the Northeast corner of said Southwest Quarter of the Southwest Quarter; thence on an assumed bearing of North 89 degrees 51 minutes 20 s�conds West along the North line of said Southwest Quarter of the Southwest Quarter, a distance of 766.43 feet to the point of beginning; thence South 00 degrees 54 minutes 56 seconds East, a distance of 498.76 feet; thence North 89 degrees 51 minutes 20 seconds West, para11e1 with the North line of said Southwest Quarter of the Southwest Quarter, a distance of 365.95 feet; to the center line of Rolling Hills Road; thence North 31 degrees OS minutes 30 seconds East along said center line, a distance of 581.44 feet to the North line of said Southwest Quarter of the Southwest Quarter; thence South 89 degrees S 1 minutes 20 seconds East along said North line, a distance of 57.72 feet to the point of beginning. Subject to public road easement." WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval; 1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, NIINNESOTA, that it should and hereby does approve the request by Mr. Clinton Heitke for a preliminary plat, subject to the following findings and conditions: l. A preliminary plat is approved to a11ow the creation of Lot 1, Block 1; Lot l, Block 2; and Outlots A,B and C in accordance with the plans and application received by the City on July 23 19,2007 except as amended by this resolution. 2. Pay Pazk Dedication fees for the one (1) lot, subject to the park dedication requirements at the time of the release of the final plat for filing. Currently the"cash"dona.tion would total$6,000. 3. Pay a Transportation Fee for one (1) lot. Currently the Transportation Fee would total $8000. The Transporta.tion Fee is subject to City Council review and approval prior to payment by the Heitke's. 4. Outlot B shall be deleted and combined with Outlot A. Outlot C shall be renamed Outlot B. 5. A temporary easement sha11 be provided for the azea cunently covered by Outlot B and granted in favor of the owner of'7000 Rolling Hills Road. The easement shall a11ow for the continued use of the properiy for use of their septic system, until such time as the system needs to be replaced and relocated onto their property. At this point in time the easement shall expire and all encroachments removed. 6. All wetlands shall be shown and identified on the preliminary and final plats as being non- delineated. A drainage easement shall be shown at least 10 feet from the edge of all wetlands. 7. A 20 foot wide drainage easement shall be centered on the creek in Lot l,Block 1 and shown on the preliminary and final plat. 8. The right of way width for the westerly half of Rolling Hills Road, shall be widened to 40 feet and shown on the preliminary and final plat. 9. The existing culvert in the road ditch by the northwest corner of Lot 1, Block 2 shall be allowed to remain. 10. Driveway culverts sha11 be installed for Lot 1, Block 2 and Outlot A. Culvert size, type, location and purchase shall be coordinated with the City Public Works staff. Drainage calculations shall be submitted to the City Engineer to verify the sizing of the culverts. 11.
