A RESOLUTION RESCINDING RESOLUTION N0. 2007-41 AND CORRECTING THE CITY
RECORDS FOR THE APPROVAL OF THE PRELIMINARY PLAT FOR"MEADOW
ESTATES" ON PROPERTY LOCATED AT 10435 COUNTY ROAD NO. 19

WHEREAS, on June 28, 2007 the Corcoran City Council adopted Resolution No. 2007-41 granting
approval of the preliminary plat identified as"Meadow Estates"; and
WHEREAS, it has been found that there were errors in the description of the preliminary plat and
therefore the rescinding of that resolution and the passage of this resolution to correct the City records
is hereby required.
SO THEREFORE BE IT RESOLVED that the City of Corcoran does hereby acknowledge that Mr.
Michael Leuer has requested approval of a preliminary plat to create thirteen (13) lots and three (3)
outlots on the property legally described as follows:
"The South 40 rods of the NoRh 60 rods of the Southwest Quarter of Section 6, Township 119, Range
23, Hennepin County, Minnesota. (In 2 earlier deeds, Doc. No. 491725, Recorded May 6, 1908 and
Doc. No. 795930, Recorded April 7, 1915, this property was described as "the Center 40 acres of the
North Ha1f of the Southwest Quarter".)
and
The North 20 acres of the North Ha1f of the Southwest Quarter of Section 6, Township 119, Range 23,
Hennepin County, Minnesota."
and;
WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public
Hearing and recommends approval; and,
WHEREAS,the City Council has reviewed the preliminary plat at its meeting of June 28'h, 2007; and,
WHEREAS, on June 28, 2007 the City Council adopted Resolution 2007-41, which is hereby
rescinded in its entirety; and
WHEREAS, the City Council does hereby approve this resolution reaffirming their approval of the
preliminary plat

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORCORAN, MINNESOTA, that it should and hereby does approve the request by Mr. Michael
Leuer for a preliminary plat, subject to the following findings and conditions:
l. A preliminary plat is approved to allow the creation of Lot 1, Block 1; Lots 1-7, Block 2; Lot l,
Block 3; Lots 1-2, Block 4; Lots 1-2, Block 5 and Outlots A, B and C in accordance with the plans
and application received by the City on March 19, 2007 and the plan revisions dated May 1, 2007
and May 23, 2007, except as amended by this resolution.
2. Outlots A, B and C sha11 be owned and maintained by a Homeowners Association established by
Mr. Leuer.
3. Pay Park Dedication fees for the twelve (12) lots, subject ta the park dedication requirements at the
time of the release of the final plat for filing. Currently the"cash" donation would total $72,000.
4. That the trail be constructed as an 8 foot wide bituminous trail to a design standard determined by
the City Engineer. Provide perpetual trail easements for recordal as a separate document. Recordal
of the easement shall occur concurrently with the Final Plat.
5. That an easement for roadway, grading, drainage, utility and trail installation purposes be provided
to the City of Corcoran, across Outlot B.
6. The applicant shall comply with the comment letters received from Bonestroo, the Elm Creek
Water Management Commission, Hennepin County Transportation Department and the Hennepin
County Human Services Department and any amendments thereto.
7. Prior to release of the final plat, the developer shall submit the final Homeowners Association
documents for review and approval by the City Attorney. The City of Corcoran will not enforce
these private documents.
8. Provide a copy of the deeds whereby ownership of all Outlots is shown with the Homeowners
Association. Provide a conservation easement or deed restriction in favor of the City of Corcoran
across Outlots A, B and C for review and approval by the City Attorney.
9. Provide additional overstory trees on each lot. Apply native seeding to a11 areas covered by the 100
foot buffer strip.
10. That no e�ension of Oakdale Drive and Meadow Creek Court is required as part of this project.
11. The existing home, located on Lot 2, Block 2 currently sits within the setback area for County
Road No. 19 and would be considered a legal non-conforming use for the future. Access may
remain onto County Road No. 19 until such time as the usage were to change.
12. Confirm e�sting residence is in compliance with septic inspection and reporting requirements.
