' Ciry of Coroomn County of Hennepin State oJMinnesota CITY OF CORCORAN RESOLUTION 2007-60 MOTION BY: H u d o k SECONDED BY: G r a b o w s k i A RESOLUTION APPROVING AN INTERIM USE PERMTT FOR A CONDITIONAL HOME OCCUPATION LICENSE 19705 COUN1'Y ROAD NO. 30 PID NO. 12-119-23-32-0001 WHEREAS, the applicants John and Jackie Boos have requested an Interim Use Permit for a Conditional Home Occupation License to operate a repair facility for mechanical problems on Corvette's.; and WHEREAS, the Corcoran City Planning Commission has reviewed and approved the Interim Use Permit at a duly called Public Hearing held on August 2, 2007; and WHEREAS, the Corcoran City Planning Commission adopted Findings of Fact, recommending approval of the Interim Use Permit; NOW THEREFORE BE IT RESOLVED that the Corcoran City Council does hereby adopt the following resolution: l. That the site plans approved by the Planning Commission are in compliance with and have no effect on the Comprehensive Plan, including public facilities and capital improvement plans. 2. The establishment, maintenance or operation of the Interim Use will promote and enhance the general public welfare and will not be detrimental to or endanger the public's health, safety, morals or comfort. 3. The Interim Use is not injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor does it substantially diminish and impair property values within the neighborhood. 4. The establishment of an Interim Use does not impede the normal and orderly development and improvement of sunounding property uses permitted in the district. 5. There are adequate public facilities and services available for the proposed use. 6. The Interim Use confortns in all other respects to the applicable regulations of the district in which it is located. 7. The Interim Use and site plan conforms to the performance standards in the City Code. 8. That car delivery and pickup sha11 be restricted to the hours between 8:00 a.m. and 5:00 p.m. . 9. That no bodywork or painting shall be performed at the site. 10. All Corvette's shall be stored and worked on within the 2400 square foot accessory building. No outside storage of parts, materials or vehicles shall be allowed. 11. That the Interim Use Permit prohibits the use of the building for Commercial or Industrial uses. 12. That the Fire Chief inspect and approve of the storage facilities for all used oils and fluids and that all applicable fire codes are met for the intended use. 13. That an Oil & Flammable Liquid Separator must be installed in the floor drain system prior to discharging from the building. No other building modifications are required for the intended use. 14. That the Interim Use Permit shall be reviewed every three years for compliance with this resolution and the then current City of Corcoran Municipal Code. Failure to comply with the requirements of this resolution or the City of Corcoran Municipal Code may result in the termination of this Interim Use Permit. Termination of the Interim Use Permit shall be at the City Council's sole discretion, 15. This Interim Use Permit is not transferable to a third party and shall immediately terminate if the Boos's sell the property.
