NO. 30-119-23-44-0002 � 1 City of Corcoran County of Hennepin State of Minnesota CITY OF CORCORAN RESOLUTION 2007-52 MOTION BY: Hudok SECONDED BY: Grabowski A RESOLUTION APPROVING THE PRELIlVIINARY PLAT FOR"DO1vITA" ON PROPERTY LOCATED ON P.I.D.No.30-119-23-44-0002 WHEREAS, Donita Properties L.P. have requested approval of a preliminary plat to create two (2) lots and one(1)outlot on the property legally described as follows: "The South Ha1f of the Southeast Quarter of Section 30, Township 119, Range 23, Hennepin County,Minnesota, subject to roads, Except the South 200.00 feet of the West 325.00 feet of the South Half of the Southeast Quarter of Section 30,Township 119 North,Range 23, AND Except that part of the South Ha1f of the Southeast Quarter of Section 30, Township 119, Range 23, Hennepin County,Minnesota,described as follows: Commencing at the Southwest corner of said South Half of the Southeast Quarter; thence North along the West line thereof a distance of 322.00 feet to the actual point of beginning of the line to be described;thence North along the West line of said South Half of the Southeast Quarter, a distance of 640.00 feet;thence East, parallel to the South line of said South Half of the Southeast Quarter, a distance of 940.00 feet; thence Southwesterly for a distance of 900.00 feet, more or less, to a point on a line drawn East from the actual point of beginning and parallel to the South line of said South Half of the Southeast Quarter,a distance of 325.00 feet East of said point of beginning;thence West to the actual point of beginning,and there terminating, AND Except the East 326.7 feet of the West 651.7 feet of the South 200.00 feet of the Southeast Quarter of Section 30,Township 119,Range 23,Hennepin County,Minnesota, AND Except the North 200.00 feet of the West 325.00 feet of the South Half of the Southeast Quarter of Section 30,Township 119,Range 23." WHEREAS, the Planning Commission has reviewed the preliminazy plat at a duly called Public Hearing and recommends approval; 1 �� ♦ NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request by Donita Properties,L.P. for a preliminary plat,subject to the following findings and conditions: 1. A preliminazy plat is approved to allow the creation of Lots 1 and 2, Block 1 and Outlot A in accordance with the plans and application received by the City on April 23, 2007, except as amended by this resolution. 2. Pay Park Dedication fees for the two (2) lots, subject to the pazk dedication requirements at the time of the release of the final plat for filing. Currently the"cash"donation would total $12,000. 3. Pay a Transportation Charge for the two (2) lots, at the time of the release of the final plat for filing. Currently the Transportation Charge would total$16,000. 4. That a final Driveway Easement Agreement across Outlot A, shall be provided to the City of Corcoran for review and approval by the City Attomey prior to approval of the Final Plat. 5. The applicant sha11 comply with the recommendations cited in the June 28, 2007, Memorandum to the Planning Commission and comment letters received from Bonestroo, the Elm Creek Water Management Commission, Hennepin County Transportation Department and the Hennepin County Human Services Department and any amendments thereto. 6. That five(5)building entitlements remain for future development on Outlot A.
