CITY OF CORCORAN RESOLUTION 2007-18 MOtlOtl By: T h o m a s Seconded By: (;r a h n u�c k i APPROVING FINAL PLAT AND DEVELOPMENT CONTRACTS FOR "CORCORAN BUSINESS PARK" FOR UNITED PROPERTIES ON PROPERTY LOCATED AT THE NORTHEAST QUADRANT OF THE INTERSECTION OF HIGHWAY 55 AND PIONEER TRAIL WHEREAS, United Properties has requested approval of a final plat to allow the creation of 3 lots and 3 outiots on the 54.10-acre to be known as "Corcoran Business Park" on property legally described in Appendix A. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request by United Properties for a final plat for Corcoran Business Park and, FURTHER, that the development contracts for said plat shall be completed by city staff and the Mayor and that the City Administrator be authorized to execute the development contract on behalf of the City; and FURTHER, that the following conditions be met prior to release of the final plat for recording with the County: 1. A final plat is approved to create 3 lots and 3 outlots for Corcoran Business Park, in accordance with the plans and application received by the City on October 23, 2006 and the revised plans received by the City on February 19, 2006, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the final PUD development plan, development contract and Business Subsidy Agreement. 3. The development contracts (including the business subsidy agreement) must be executed by the developer and the City and must be filed with the final plat. 4. Development is subject to the preliminary approvals in Resolutions 2006- 45, 2006-46-, 2006-47 and 2006�8. 5. The developer shall comply with all conditions of final PUD development plan approval (Resolution 2007=). Resolution 2007- Page 2 6. The extension of sanitary sewer and municipal water is required to serve this site. Approval of this final PUD development plan is contingent upon extension of these services to the site. 7. The development is contingent upon completion of the backage road. 8. The developer must submit a final PUD development plan and final plat for each future phase of development. No final approvals are granted at this time for Phase II and Phase III. 9. A 60-foot drainage and utility easement shall be provided on the south lot line of Outlot C. This is consistent with the easement on Lot 1 and would allow space for a future expansion of the Highway 55 right-of-way. 10.Park dedication shall be cash in lieu of fees due at the time of final plat, subject to the park dedication policy in effect at the time the final plat is released for filing. a. The developer may choose to pay the park dedication at this time for the entire site, or b. The developer may choose to pay park dedication for only Phase I. i. Park dedication for future phase would be due at the time of final plat and would be subject to park dedication fees in place at the time the final plat for each phase is released for filing. ii. The developer must provide net areas for Phase I, Phase II and Phase III. 11. The applicant shall comply with all requirements of the City Engineer's memo, dated February 20, 2007. 12.The applicant shall comply with all recommendations of Brad Schleeter's storm water memo dated February 20, 2007. 13.The applicant shall provide the approved final plat and final plan drawings to the city in an electronic format. FURTHER, that the following conditions be met prior to issuance of building permits: 1. All drainage and utility easements shall be staked, surveyed and properly recorded prior to beginning any work on site. 2. All permanent wetland buffer monument signs must be erected along the wetland buffer line as required by Section 1050.010, Subd. 7 of the City Code. The final locations must be inspected and approved by City staff. Resolution 2007- Page 3 3. The applicant must file the final plat for phase at Hennepin County within 2 years of the date of approval or the approval shall expire. 4. The approved trail/sidewalks easement document for the off-road trail must be filed with the final plat at Hennepin County. 5. The applicant shall provide proof of recording the final plat, resolutions, development contract and business subsidy agreement at Hennepin Council.
