HomeMy WebLinkAboutRES 2007-06 AUTHORIZING NOTIFICATION TO PROPERTY OWNERS OF INTENT TO TAKE TITLE AND POSSESSION OF LAND RESOLUTION NO.2007-06 RESOLUTION AUTHORIZING NOTIFICATION TO PROPERTY OWNERS OF INTENT TO TAKE TITLE AND POSSESSION OF LAND WHEREAS,the City of Corcoran has authorized the development of a project known as the Commercial Business Park located north of Highway 55 between Pioneer Trail and Rolling Hills Road; and WHEREAS,as part of that project the City will construct a"backage road"that will connect the business park with Rolling Hills Road on the east; and WHEREAS,the City is presently negotiating with owners of the property needed to complete construction of the backage road and it is hoped that these negotiations will be successful; and WHEREAS,MN/DOT is contributing significant funds to the project and they require that the City have title and possession of the property necessary for this backage road project by the spring of 2007; and WHEREAS,if negotiations are not successful the City will need to condemn the required property for the roadway and this will be accomplished under Minn. Stat. §117.042, commonly known as the"quick take law"; that this section requires a 90 day notification to property owners prior to gaining title and possession of the needed property. NOW,THEREFORE,the Corcoran City Council RESOLVES: 1. That City sta.ff is hereby authorized to notify the following property owners that condemnation,under Minn. Stat. §117.042,may be necessary to complete the Highway 55 backage road project: a. Dabrowski, 22400 Highway 55, Corcoran, MN PID: 32-119-23-44-0003 b. Dvoracek, 22400 Highway 55, Corcoran, MN PID: 32-119-23-44-0001 c. Medina Electric, 22510 Highway 55, Corcoran, MN PID: 3 2-119-23-44-0013 2. That City staff is further directed to continue negotiations with the above property owners in an effort to reach a mutually satisfactory negotiation and to avoid the need for condemnation. 1 Moved by Councilmember Grabowski, seconded by Councilmember Thomas The following voted in favor of said Resolution: Guenthner, Thomas, Grabowski, Hudok, and Jacobs The following voted against the same: None.
