RESOLUTION NO.2006-69
RESOLUTION DENYING SEPTIC PERMIT
APPLICATION OF AMAIN HOMES
WHEREAS,Amain Homes, Inc. ("Applicant")made application to the City of Corcoran for a
building permit at 7795 Corcoran Trail West, Corcoran,Minnesota;that the permit was dated
August 2nd, 2006 and was received by the City August 3rd,2006;
WHEREAS,the Applicant submitted building plans and septic design with the building permit;
that the septic design was prepazed by Soderstrom Soil Testing and contained an attachment
letter from University of Minnesota representative, Dan Wheeler, dated January 24th,2006; and
WHEREAS,the septic design submitted by Soderstrom Soil Testing was for a standard septic
system to be placed in the primary septic area on the above-referenced lot; and
WHEREAS,this application,together with plans, was submitted to the city building official,
Metro West Inspections,for review and the building official by correspondence dated August
23rd, 2006 rejected the septic permit and advised Applicant to submit both its building plans and
septic design to the Wastewater Commission for review and a determination; and
WHEREAS,additional clarification for the denial of the septic permit was given to the
Wastewater Commission dated October 16th,2006; that the primary reason given for the septic
permit rejection was the fact that the primary septic area contained a significant amount of fill
and did not contain original soils that would support a standard septic system under the rules,
7080; and
WHEREAS,in Applicant's original submittal by Soderstrom with the Wheeler attachment,it is
recognized that the primary septic area contains fill and a recommendation was made that this fill
material be removed and the original soils be retested to determine if they meet the 7080
requirements for a standard septic system; and
WHEREAS,Applicant appeared before the Wastewater Commission on November 1 st,2006
and the Wastewater Commission denied the septic permit incorpora.ting the reports of the
building oi�'icial dated August 23rd,2006 and the supplemental report dated October 16th,2006
as reasons for the denial(minutes not completed); and
WHEREAS,the City also received a report from the building official dated November 13th,
2006 relating to a soils investigation made by the building official and performed on November
6th,2006; said report concluding that the area proposed for absorption of effluent contained
saturated soils and is not adequate for a standard septic system under the requirements of rules,

WHEREAS,Applicant came before the Corcoran City Council on November 20th, 2006 on
appeal of the Wastewater Commission decision.
NOW,THEREFORE,the Corcoran CiTy Council makes the following:
FINDINGS OF FACT
1. The above paragraphs are adopted as Findings of Fact.
2. The area proposed by Applicant for its primary septic site at 7795 Corcoran Trail
West contains a significant amount of fill and the azea proposed for absorption of
effluent contains sa.turated soils.
3. The area proposed by Applicant for its primary septic system does not contain
original soils that would allow the conshuction of a standard septic system
pursuant to rules, 7084.
CONCLUSION
1. Based on the above information,the Corcoran City Council hereby denies the
septic pernut application of Amain Homes,Inc.

The following voted in favor of said Resolution: Lymangood, T'homas, and Cossette
The following voted aga.inst the same: Jacobs and Grabowski
The following abstained: None.
Whereupon said Resolution was declared duly passed and adopted, and was signed by the
Mayor and attested by the Clerk dated this 20th day of November,2006.
