HomeMy WebLinkAboutRES 2006-63 APPROVING PRELIMINARY PLAT FOR EDWARD KEMNA FOR "RUSH CREEK HEADWATERS ADDITION" ON PROPERTY LOCATED AT 23850 COUNTY ROAD 50 CITY OF CORCORAN RESOLUTION 2006-63 Motion by: Grabowski Seconded by: Jacobs APPROVING PRELIMINARY PLAT FOR EDWARD KEMNA FOR "RUSH CREEK HEADWATERS ADDITION" ON PROPERTY LOCATED AT 23850 COUNTY ROAD 50 WHEREAS, Edward Kemna has requested approval of a preliminary plat to create finro lots on the property legally described as follows: The West Half of the Southwest Quarter of Section 19, Township 19 North, Range 23 West of the Fifth Principal Meridian WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request by Edward Kemna for a preliminary plat, subject to the following findings and conditions: 1. A preliminary plat is approved to allow the creation of Lots 1 and 2 in accordance with the plans and application received by the City on December 29, 2005 and revisions received on August 25, 2006, except as amended by this resolution. 2. A waiver from the requirement for an electronic file of the plat is granted because the applicant's surveyor has indicated that he does not have access to digital technology. 3. Lot 2 will continue to be farmed and, therefore, shall be exempt from wetland buffer monument signage requirements. When development occurs, the site shall be subject to the wetland buffer monument signage requirements in place at that time. 4. There are 7 building rights remaining on Lot 2. 5. Any future development of Lot 2 shall comply with the following requirements: a) Access shall be provided to the properties to the east. b) Only one driveway access onto County Road 50 will be permitted and the driveway access shall be located near the southeast corner of the lot. Resolution 2006-63 Page 2 Final access shall be subject to review and approval by the City Engineer � and Hennepin County. c) All future subdivisions shall meet the City's minimum lot standards in place at that time. d) All future subdivisions shall meet the City's wetland and shoreland setback and buffer requirements in place at that time. 6. Prior to release of the final plat for filing with the County, the applicant shall: a) Revise the plat to show that Lot 1 is a minimum of 10 acres in size. b) Revise the plans to accurately dimension the 50-foot '/ right-of-way for County Road 50 by shifting the property line 17 feet to the north. c) Dedicate a 10-foot-wide trail easement adjacent to the 50-foot '/ right-of- way for County Road 50. d) Revise the plat to show the gross and net area within the trail easement. e) Submit trail easement documents for review and approval by the City Attorney. fl Pay park dedication fees for the 1 new lot, subject to the park dedication requirements at the time of release of the final plat for filing. i. Park dedication credit shall be given for the net area of the land within the trail easement adjacent to County Road 50. g) Revise the plat to show the location of the existing and alternative septics on Lot 1 and the proposed and alternative septics on Lot 2. h) Revise the plat to dimension all required septic setbacks. The plat must comply with all minimum septic and well setback requirements. i) The existing septic system must be inspected by the City Building Inspector to ensure that the system is not a failing system that poses an imminent health threat. If the system is failing and poses an imminent health threat, it must be replaced in compliance with City and State regulations. j) Obtain approval of the wetland delineation from the Elm Creek Watershed Management Commission (ECWMC). k) The wetland delineation identifies areas A, B and C as non-wetland; however, these areas are being shown on the plat as wetlands. If the � Resolution 2006-63 Page 3 ECWMC also determines that these areas are non-wetland areas they will need to be removed from the plat. I) There is an existing silo that is currently proposed to be located on Lot 2. Due to the existing historic nature of the silo, the City encourages preservation of the silo on Lot 2, as an existing, legal non-conforming structure. m) Revise the plat to show the 100-year floodplain elevation at 1004.25. n) The applicant shall comply with all conditions in the City Engineer's memo dated September 25, 2006. 7. Prior to the issuance of a building permit, the applicant shall: a) Submit final septic system designs for review and approval by the Building Official. b) Stake, survey and properly record all drainage and utility easements prior to beginning any work on site. c) Stake both the proposed and alternative septic sites with steel posts and snow fencing prior to beginning any work on site, which must be left in place untit issuance of a Certificate of Occupancy.
