RESOLUTION ADOPTING A PLAN AMENDMENT TO THE
HEALTH REIMBURSEMENT ARRANGEMENT
The undersigned, Beatrice Lindberg, serving as the City Clerk to the City of Corcoran (the
"Employer"), duly organized and existing under the laws of the State of Minnesota, does hereby
certify that the following resolution was adopted:
WHEREAS, the City of Corcoran previously adopted the City of Corcoran Health
Reimbursement Arrangement on January 1, 2006; and
WHEREAS, the City of Corcaran desires to amend the Plan;
NOW, TI�REFORE, pursuant to the authority reserved in the Plan to allow amendments to the
Plan, Section 6.2 of the Plan"No Employee Contributions" shall be amended as follows:
6.2. Other Allowed Contributions. Contributions are allowed to an HRA account as
described in Section 5.11 to continue coverage. Contributions of unused vacation and/or
sick time from Employees upon termination of employment may be made to their HRA
account. No other contributions will be accepted.
This is not an administrative change but a clarification in the Plan's language. This procedure
has been administered in this manner since the adoption of the Plan.
NOW, TI-�REFORE, BE IT RESOLVED, that the City of Corcoran Health Reimbursement
Arrangement be amended effective January l, 2006; and
BE IT FLTRTI�R RESOLVED,that the City Council shall authorize such contributions from the
funds of the Employer as are necessary to carry out the provisions of said plan at any time; and
BE IT FURTHER RESOLVED,that in the event any conflict arises between the provisions of
said Plan and the Employee Retirement Income Security Act of 1974 (ERISA) or any other
applicable law or regulation(as such law or regulation may be interpreted or amended), the
Company shall resolve such conflict in a manner which complies with ERISA or such law or
regulation.
