RESOLUTION 2006-46
APPROVING FINDINGS OF FACT FOR REZONING FOR UNITED
PROPERTIES FOR "CORCORAN BUSINESS PARK" ON PROPERTY �AND
LOCATED NORTH OF HIGHWAY 55 AND EAST OF PIONEER TRAIL
WHEREAS, United Properties has requested reclassification of the zoning from
A (Agriculture) and BP (Business Park) to PUD (Planned Unit Development) for a
54.10-acre parcel, legally described in Appendix A.
WHEREAS, the Planning Commission has reviewed the request at a duly called
Public Hearing and recommends approval, and;
WHEREAS, the City Council has adopted an ordinance rezoning the affected
parcel from A and BP to PUD;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does
support the request by United Properties for the reclassification of the zoning
from A and BP to PUD for the 54.10-acre property, based on the following
findings:
1. The developer's proposal for 544,720 square feet of retail and industrial
uses is consistent with the intent of the Comprehensive Plan, which plans
for industrial development in this area to provide opportunities for
expansion of local businesses and creation of a strong
commercial/industrial tax base in this area of the city will access to
Highway 55 and municipal services.
2. The PUD would allow the developer to mix a limited amount of retail land
uses in with the office/industrial uses, which could not be accomplished
under the BP zoning district. This provides for a variety retail services to
support the new industrial tax base and existing residents as envisioned in
the Comprehensive Plan.
3. The applicant has met the minimum standards outlined in the Zoning
Ordinance and generally complies with the design guidelines adopted as
Appendix A of the Zoning Ordinance. The benefits of this project primarily
relate to the public improvements anticipated as part of this project. The
developer will dedicate the right-of-way for the new frontage road within
their project and will be responsible for working with the City of Corcoran
to extend municipal sewer and water from the City of Medina to this site.
The developer would provide common design elements throughout the

project. Details of these design elements will be discussed in the PUD
Preliminary Plan section of this report.
4. The PUD will protect and promote the health, safety, comfort, aesthetics,
economic viability and general welfare of the City, by establishing strong
tax base and providing opportunities for jobs and business expansion
within the City.
5. The developer will improve the efficiency of public streets by providing
right-of-way for construction of the new Highway 55 frontage road and
providing landscaping and trails/sidewalks adjacent to this right-of-way.
The landscaping within this street right-of-way would be planted and
maintained by the developer, thereby reducing the burden on the City's
public works staff. Furthermore, the City has completed a traffic study and
the developer would be required to make any other public street
improvements required by the AUAR. The developer will improve the
efficiency of the public utilities by extending public water and sanitary
sewer from the City of Medina to the City of Corcoran. Bringing these
utilities to the City of Corcoran will ultimately allow service of the entire
Southwest District with municipal sewer and water.
6. The project ensures appropriate transitions between differing land uses.
The developer complies with all setback requirements around the
perimeter of the site adjacent to the residential land uses. Typically,
transitions would be expected between industrial uses and adjacent
residential uses and the ordinance anticipates the need for this transition
by increasing the minimum setback from 20 feet to 50 feet when non-
residential uses are adjacent to residential. The applicant's plan complies
with this requirement.
